Lowndes County’s 2007 and 2012 favors for the same developer

According to the Lowndes County Commission’s minutes, the developer for whom the Commission now proposes to change the zoning code back in 2007 got $130,000 in road construction labor from the Commission.

In the 26 June 2007 Lowndes County Commission Regular Session Minutes:

County Engineer, Mike Fletcher, presented an item that was brought to the Commission during the previous work session regarding the paving of Davidson Road. Further, Mr. Clint Joyner was in the process of building a previously approved development that was being affected by an unforeseen Department of Transportation requirement regarding a costly intersection improvement. Mr. Fletcher further stated that Mr. Joyner was required to pave a portion of Davidson Road; however, due to the intersection cost he was offering to purchase the materials for the funding of the entire road, if the county would provide the road construction labor at a cost of approximately $130,000.00. Commissioner Lee made a motion to approve the request, Vice Chairman Carter and Commissioner Roberts offered a second. Motion carried.

Somebody help me here, is not that the same Clint Joyner back in 2007 getting a $130,000 subsidy from the County Commission who last month got invited to talk to the Commission in a Work Session with nobody else invited to speak? The same one for whom the same Commission is now proposing to change the zoning code? For another development on the same Davidson Road? A development the Chamber and Moody and the Planning Commission are all opposing, while the VDT channels Ashley Paulk in promoting it?

What is it about this Clint Joyner or Joyner Realty or Davidson Road that the County Commission should favor him or them so? It can’t be the individual Commissioners: not a one of them is the same now from 2007. What is the same then and now?

Maybe we should find out before the Commission grants any more favors.

Chamber opposes zoning code change for developer near Moody

Apparently it’s the Chamber and Moody and the Planning Commission Red arrows on MAZ and the TRC all against Ashley Paulk on the Moody rezoning-and-zoning-code case, with the VDT sidling towards Paulk. The VDT claimed Lowndes County Chairman stated something that’s not true according to the agenda and LAKE’s videos of the recent Planning Commission meeting. And the VDT buried opposition by the Chamber of Commerce’s relevant committee at the end of its article.

Jason Schaefer wrote for the VDT today, County disagrees with proposed zoning amendment, Paulk: Military intervention could prevent development near base, and the caption of the picture on the right says:

The Greater Lowndes Planning Commission proposed a text amendment to the Unified Land Development Code in November that would reduce lot density restrictions from 2.5 acres to one acre, allowing landowners within the Moody Activity Zoning (MAZ) district “more flexibility” to parcel off their land holdings, Paulk said.

The Planning Commission’s own agenda says TEX-2012-02 was proposed by “Lowndes County Board of Commissioners”. And the Planning Commission voted to recommend against approving that text amendment to the ULDC. According to Planning Commissioner John Page, that vote was following the recommendation of the Technical Review Committee (TRC), which consists of staff of Lowndes County and the City of Valdosta. Page is also an incoming Lowndes County Commissioner, to take office next month. So either Paulk said something he as the Chairman of the Lowndes County Commission should know not to be true, or the VDT wrote erroneously.

Developer didn’t get his way: change the zoning code! @ GLPC 2012-11-26

A developer didn’t get his way at the Lowndes County Commission last month, so now the county is proposing to change the zoning code for him! To change zoning right next to Moody Air Force Base, the largest employer in this area. A change opposed by Moody because of flight safety and safety of property, and “the longterm viability of Moody Air Force Base.” A change that would set a precedent for further sprawl, as Moody indicated indirectly when the related rezoning first came before the Planning Commission. Apparently a developer can get whatever he wants around here, no matter how much it threatens the livelihoods or well-being of the rest of the citizens. Does that seem right to you? To their credit, the Planning Commission at its 26 November 2012 meeting unanimously voted against this TEX-2012-02 just as they did the rezoning case REZ-2012-17 last month. Both will be decided by the Lowndes County Commission at its 11 December 2012 meeting.

County Planner Jason Davenport introduced this item.

TEX-2012-02 ULDC changes Ultimately at the end of the day this text amendment is a request to change the minimum lot sizes allowed and the minimum residential densities allowed in a MAZ-3 zoning district. We have those changes highlighted on the screen but they have also been highlighted in the packet…. At the end of the day that is what has happened.

Well, yes, at the end of that day. At the end of many future days this zoning code amendment if approved will be used as a precedent for more sprawl right next to Moody Air Force Base, which is by far the biggest employer in this area. The packet he referred to is not available to the public. The changes he mentioned are not on his Unified Land Development Code (ULDC) web page. A view of them as seen from the back of the room is shown on the right here. Can you read them?

Davenport added that he had received one open records request and a response from Moody. Plus state law requires 30 days for Moody to respond and it had been 31 days. Then he walked through some history using pages in Commissioners’ packets that we the taxpayers, voters, and residents of Lowndes County can’t see.

Changes to Lowndes County’s Unified Land Development Code (ULDC) @ GLPC 2012-08-27

Did you know last night’s Planning Commission meeting included a public hearing about changes to the county’s Unified Land Development Code (ULDC) related to land disturbances and water quality? You wouldn’t have found out about that in the agenda, because it wasn’t posted anywhere you’d be likely to see it. (Where does GLPC post the one physical copy of the agenda required by law, anyway?) Supposedly it was advertised in the Valdosta Daily Times, but a search of Public Notices in Statewide Database of Public Notices from Georgia’s Legal Organ Newspapers for 1 June 2012 through 27 August 2012 finds nothing.

Here’s what the agenda item for the 27 August 2012 GLPC meeting (that we only know about because Gretchen went to that GLPC meeting and asked County Planner Jason Davenport) says:

From a procedural standpoint the amendment has been advertised in the Valdosta Daily Times to fulfill legal requirements. Beyond legal requirements staff has plans to post this agenda item and draft ULDC on the Lowndes County Website at http://www.lowndescounty.com/content.asp?pid=23&id=224. Regarding staff review of the amendments, the TRC recommended for their approval at their 08/16 regular meeting.

I’m really trying to develop the property as full as it could be. —Jason Davenport @ GLPC 2012-04-30

In a rezoning case we heard the de facto motto of the Lowndes County Commission:

“I’m really trying to develop the property as full as it could be.”

This was in discussion about REZ-2012-07 McNeil Property, 6888 & 6870 McNeil Road, Hahira, on the agenda for the Greater Lowndes Planning Commission meeting of 30 April 2012. According to the tax assessors’ database, they spelled it wrong: it’s McNeal Road. This rezoning was for lot width, such as would have to happen for the Gloria Dave property to be subdivided. Nathan Smith spoke for, representing multiple people. There was concern among the GLPC board that the rezoning would permit more houses than were currently being requested.

This was the only case in that meeting with speakers against. Elizabeth Daniels, lives nearby (I think she said across the road), pointed out that four lots on one section would permit 4 lots on another section, and that would be a problem on that narrow road.

Donya Rigal, 6840 McNeal Road, the property next door, pointed out dust from traffic and other problems. McNeal Road is a county road, 35 feet wide.

County Planner Jason Davenport said:

“They did actually reserve 12 and a half feet of each of these properties in anticipation of improvement, but I don’t know that that’s on any list for improvement any time soon”

Rezoning density outside of Hahira @ LCC 2012 05 07

Two rezonings had no comments. The third, just north of Hahira, got opposition at the Planning Commission, which recommended a qualification, which County Planner Jason Davenport interpreted as trying to limit the density of development of the property.

At the Lowndes County Commission at its 7 May 2012 Work Session during the discussion on

7.c. REZ-2012-07 McNeal Property, McNeal Road E-A to R-A, Well & Septic, 25 acres

Crawford Powell, Commissioner for District 3, which is the south end of the county, asked a question, while Richard Raines, Commissioner for District 2, which is the north end of the county including Hahira, sat silent, although he did nod his head.

A neighbor sent a letter with details of opposition. I wonder what’s in it? If you want to know, you can submit an open records request to the county. Of course, with the three day time limit for the county to respond, the Commission will have already voted on it this evening before you find out what’s in the letter.

Minutes on website? @ GLPC 2012 01 30

Whatever happened to the agendas and minutes of the Greater Lowndes Planning Commission (GLPC) that used to be on the SGRC website? Gretchen asked at the January GLPC meeting whether they would be posted again. The chair said he didn't know. County Planner Jason Davenport added:

The regional commission used to do the minutes on the website for us. We have the minutes. Ms Gretchen, if you'll email us, we have the ability to email those minutes back to you, but we don't have plans right now to put those minutes back on the web.

The chair suggested "Maybe at some point in the future would be good." Jason Davenport reiterated that they had no plans to do that.

Last year the agreement between the SGRC and the various local governments regarding the GLPC responsibilities changed. This website is a result of those changes. I have your request and will plan on getting direction and clarification about how to deal with these types of requests.

There has been a little bit of improvement. The GLPC chair faxed LAKE the April agenda.

There are many injustices of socialism and redistribution of wealth (or garbage) and I’m glad to see you recognize this in the shifting of illegal dumping costs to landowners. I am also glad to see that at least the county is talking about privatization and not public/private partnerships (so far). When Hahira almost succeeded in placing a regional waste transfer station on city owned property

I was concerned that the county was complacent in this because the Lowndes Board of Commissioners November 2007 meeting minutes showed they agreed to rezone the property for the purpose of the transfer station against the recommendations of the county planner, Jason Davenport. That rezoning action replaced a DRI (Development of Regional Impact) request for waste transfer station rezoning so it was easy to assume the county and possibly the region had a mutual agenda for the transfer station. During a recent discussion on the dangers of regional government with Valdosta mayor, Larry Hanson, I asked if the transfer station was a regional interest. He assured me the City of Valdosta had no knowledge and no interest in that transfer station prior to articles in the Valdosta Daily Times. I’ve not had an opportunity to discuss the possibility of mutual agenda with the county and if it comes up again in the future I am assuming proper procedures will be followed which mandate public meetings and input into the planning before a third DRI is entered, not after.

Some answers and some remaining questions about the Comprehensive Plan

When I spoke at the Greater Lowndes Planning Commission (GLPC) about the Short Term Work Projects (STWP) document on Monday, November 28th, I had questions about several sections, and many of the deleted or modified items. The next day I met with Lowndes County Planner Jason Davenport to discuss my questions. Some of my questions were answered to my satisfaction, some I still had concerns about, and some are still unanswered because they were not actually in his area of expertise.

The document covers all the cities in Lowndes County as well as the unincorporated area. I did get some questions about Valdosta projects answered by Valdosta City Planner Matt Martin in a telephone conversation.

Wellhead Protection Overlay, TXT-2010-01 2010 ULDC

Lowndes County Commission 8 June 2010 This is about exclusion zones around wells, and maybe about restrictions on putting new wells next to pollution sources such as cotton fields.

At their 8 June 2010 regular meeting, the Lowndes County Board of Commissioners, at the recommendation of County Planner Jason Davenport, tabled revisions to the Uniform Land Development Code (ULDC) about wellhead protection. Such protections are a new requirment by the Georgia EPD, and it’s taking a while to figure out what is appropriate for the ten wells operated by the county and the 140 private community wells, many of which have trust indentures with the county that require the county to take them over if their current operators do not supply enough water, or of good enough quality.
