Unanimously voted down: Miller Bridge Road subdivision @ LCC 2022-02-08

The Commissioners unanimously denied the rezoning for the subdivision on Miller Bridge Road. Applicants spoke a minute over their time, yet did not present the slides they said the previous morning they were going to present; we include scans of those slides here for historical reference, for when the next subdivision like this comes up, next week or next year.

Commissioners unanimously approved the other two rezonings.

They also unanimously approved 6.a. Transportation Investment Act (TIA) Local Project – Coleman Road NW and 6.b. Transportation Investment Act (TIA) Local Project Kinderlou-Clyattville Rd. Road building and improvement projects attract subdivisions. But the opponents to the Miller Bridge Road subdivision had already left after that one item. Chairman Bill Slaughter mentioned that the crowd was gone in 6.c. Internal Network Firewalls.

How did we get them? The County Manager handed them to LAKE’s Gretchen Quarterman at the previous morning’s Work Session.

The developer’s last point in their Justification for Zoning Request does identify a widespread problem:

7. Almost every subdivision built in Lowndes County is adjacent to some form of agriculture or timber production

However, there is no need to make it worse.

Another point in that same slide is plain wrong:

5. There will be minimal impact to County facilities or services, while increasing the taxes of the county approximately $70k per year

As Dr. Dorfman summarized in a different presentation,

Local governments must ensure balanced growth, as
sprawling residential growth is a certain ticket to fiscal ruin*

It’s interesting that the developers put Groundwater Recharge Area first in their OPPOSITION POINTS ADDRESSED:

While probably all these points are true (I haven’t checked each location), most of them precede current concerns about groundwater recharge, and there is no need to make the problem worse.

In a milestone for Valdosta’s ongoing upgrades to its sewer system, tonight the Mayor and Council will approve the last two of 37 emergency standby generators for lift stations.

BUDGET IMPACT/FUNDING SOURCE: User Fees

HISTORY: To ensure continued sewage lift station operations during power outages and to satisfy the Georgia Environmental Protection Division requirements, the Utilities Department developed a scope of work to purchase two emergency standby generators. These generators are needed to prevent lift station failures due to power outages from storms or other unexpected causes. Several years ago, the City initiated a program to purchase standby generators or emergency standby diesel pumps for all of its existing sewage lift stations. These are the final two generators needed to complete the Program. Once they are installed, all 37 of our lift stations will have some form of dedicated emergency backup capability from generators and/or backup diesel pumps. Additionally, this will complete Condition 18 of the EPD Consent Order which requires the installation of fixed generators and/or backup pumps at all lift stations by September, 2023. Moving forward, all new City lift stations will include a dedicated emergency backup capability as part of their construction.

Roads, Wastewater, and Trash @ VCC 2022-02-24

A twelve-foot alligator surfaced twice at the briefest Valdosta City Council meeting of recent memory, in Special Recognitions and Citizens to Be Heard, related to the Mayor and Chairman’s Paddle organized by WWALS, with Suwannee Riverkeeper John S. Quarterman as a speaker.

Two Hahira variances, two Lowndes County rezonings, four Valdosta rezonings and an annexation @ GLPC 2022-02-28

Update 2022-03-07: LAKE videos.

Two small lot variances in Hahira, two small lot rezonings in Lowndes County, three small rezonings in Valdosta, and one big annexation and rezoning by Valdosta, 35 acres for Murray Staten Farms, LLC, 3550 Lake Laurie Drive, all on the agenda this evening for the Greater Lowndes Planning Commission (GLPC). GLPC recommends, and the elected bodies decide. For an annexation, the Lowndes County Commission will have to state whether it objects before the Valdosta Mayor and Council decide.

There’s no parcel listed for 3550 Lake Laurie Drive by the Lowndes County Tax Assessors. Why the agenda can’t just tell us which parcels is mysterious.

The developer of the proposed 5.c. REZ-2022-03 Windy Hill Subdivision, 7532 Miller Bridge Rd. plans to make a presentation this evening at the voting Regular Session, we heard at yesterday morning’s February 7, 2022, Work Session of the Lowndes County Commission.

Board’s Pleasure should be Deny: Miller Bridge Road rezoning @ LCC 2022-02-07

Update 2022-03-08: Ten minute Work Session @ LCC 2022-02-07.

On the agenda for tomorrow morning’s Lowndes County Commission Work Session, county staff included the petition against REZ-2022-03 Windy Hill Subdivision, 7532 Miller Bridge Rd.. County staff note “RECOMMENDED ACTION: Board’s Pleasure or Deny”, unlike the other two options, where the second option is “Approve”. Those who do not want that rezoning to pass would do well to contact their Commissioners before the meetings, and then show up at the meetings, or at least the Tuesday 5:30 PM voting Regular Session.

For REZ-2022-01 Hamilton Green Townhomes, Bemiss Rd., 045D 006A, they cited a parcel that does not exist. The correct parcel number, 0145D 006A, was in the Planning Commission agenda.

As usual, county staff say rezonings do not cost the county anything. Nevermind that subdivisions far from county services will never pay enough in property taxes to fund sending school buses, fire trucks, and Sheriff vehicles, so all the taxpayers subsidize those costs.

Recommend deny 8:3, Miller Bridge Road Subdivision @ GLPC 2022-01-31

Update 2022-02-06: Board’s Pleasure should be Deny: Miller Bridge Road rezoning @ LCC 2022-02-07.

Everything else sailed through, but the Miller Bridge Road rezoning took half an hour.

Nick Clark from Quitman spoke for the rezoning. As Brad Folsom remarked on behalf of the opponents, the only significant difference between this and the previous request is the lot size, with the newly requested R-A zoning for 6. REZ-2022-03 Windy Hill Subdivision 7532 Miller Bridge Rd., E-A to R-A.

Some new arguments were heard against. Gretchen Quarterman said the taxpayers don’t need any more community wells that the county has to assume and pay for if there are problems with it. Chase Gregory said the current zoning is working well. People do buy larger size parcels (4-80 acres); he gave several examples.

Tommy Kenny, spoke against as immediate neighbor to north and active local farmer.

The Planning Commissioners voted to recommend denial, 8 for, and 3 against.

The Lowndes County Commission decides next Tuesday at 5:30 PM.

Videos: Stealth Commission district reapportionment and half million dollar developer giveaway @ LCC 2022-01-25

As expected, the Lowndes County Commission at its Regular Session passed the half million dollar bailout for a developer.

Not expected, they changed the agenda at the beginning of the meeting to approve new Commission district maps and a resolution supporting them, for immediate transmission to the state.

One citizen wishing to be heard spoke about the never ending noise from the 15 month old Arglass factory.

Developer Bailout

For 5.k. Property Purchase – Building Valdosta, LLC County Manager Paige Dukes said staff acted at the direction of the Commissioners, seeming to distance herself and staff from this action.

Packet: Staff says growth over agriculture and forestry for Miller Bridge R-A Rezoning @ GLPC 2022-01-31

Update 2022-01-31: Dasher packet item: 10 minutes from SGRC vs. too many days from Lowndes County @ GLPC 2022-01-31.

Lowndes County staff says “existing development pattern and growth of the community” is more important than agriculture and forestry for 6. REZ-2022-03 Windy Hill Subdivision, 7532 Miller Bridge Rd., 0010 022, ~34 ac., E-A to R-A on the agenda for the Monday, January 31, 2022, meeting of the Greater Lowndes Planning Commission. Nevermind the surrounding community overwhelmingly opposes this rezoning and it is the Lowndes County Commission (and the Chamber and others) causing this “pattern and growth” heading north into places it should not go and that the county will never be able to collect enough property taxes to support school buses, fire trucks, and Sheriff calls.

Also, they’ve found one R-1 lot nearby and apparently the Rural Residential Character Area on Morven Road counts heavily as “proximity to the Rural Residential Character Area”. And they’ve ignored numerous requirements of the Comprehensive Plan for for the Agriculture/Forestry/Conservation Character Area, as well as what used to be a hard-no county road safety requirement.

In case you had any doubt, this rezoning is not just about this case, it is about the “precedent set by this case for other similarly sized and located properties in Lowndes County.”

Discussion of court grants and Loch Laurel Road project, little of property subsidy @ LCC 2022-01-24

Update 2024-10-21: The county is finally generating some income from that half a million dollar subdivision buyout. Agenda: DRC Emergency Services and VSU South Campus Purchase @ LCC 2024-10-21.

At yesterday morning’s Lowndes County Commission Work Session, there was no discussion by the Commissioners about 5.k. Property Purchase – Building Valdosta, LLC, but new wrinkles did come to some small light.

County Manager Paige Dukes said “This is a follow up on the Building Valdosta purchase of property we have discussed with you several times…” In what public meeting did those discussion take place? She also said the county attorney had worked out an agreement with Building Valdosta, yet that agreement was not in the board packet. And she remarked, “Any other claims related to this will continue through, um, any process with ACCG that they may have for lost profits.” She immediately called for an Executive Session for “Client-privileged communication regarding potential or pending litigation and for the purchase of property.”

Sounds like the county got sued by a developer, or was threatened with a lawsuit, and is resolving that by bailing out the developer with half a million of our tax dollars.

How can any developer who did the slightest due diligence not know that the subject property on GA 122 east of Bemiss Road is in the Moody Activity Zone (MAZ)? If that’s not their beef, what is?
