In the previous post I detailed how Lowndes County had referred me to the Southern Georgia Regional Commission (SGRC) to get the board packet item for the Dasher item on the agenda for tonight’s Greater Lowndes Planning Commission (GLPC) meeting, Monday, January 31, 2022.

So I sent email to Loretta Hylton at the SGRC. She returned a PDF of the document within less than ten minutes. No need for an open records request.

That contrasts with more than three days and only after I quoted the open records law Lowndes County was probably violating.

So that Dasher packet item is on the LAKE website along with the others.

You may ask, why did it take me four days to put this packet item online?

Fair question, but I ask: why doesn’t Lowndes County put the entire GLPC board packet online where everyone can see it, like many counties larger and smaller in Georgia and Florida have been doing for years? Continue reading

Packet: Staff says growth over agriculture and forestry for Miller Bridge R-A Rezoning @ GLPC 2022-01-31

Update 2022-01-31: Dasher packet item: 10 minutes from SGRC vs. too many days from Lowndes County @ GLPC 2022-01-31.

Lowndes County staff says “existing development pattern and growth of the community” is more important than agriculture and forestry for 6. REZ-2022-03 Windy Hill Subdivision, 7532 Miller Bridge Rd., 0010 022, ~34 ac., E-A to R-A on the agenda for the Monday, January 31, 2022, meeting of the Greater Lowndes Planning Commission. Nevermind the surrounding community overwhelmingly opposes this rezoning and it is the Lowndes County Commission (and the Chamber and others) causing this “pattern and growth” heading north into places it should not go and that the county will never be able to collect enough property taxes to support school buses, fire trucks, and Sheriff calls.

Also, they’ve found one R-1 lot nearby and apparently the Rural Residential Character Area on Morven Road counts heavily as “proximity to the Rural Residential Character Area”. And they’ve ignored numerous requirements of the Comprehensive Plan for for the Agriculture/Forestry/Conservation Character Area, as well as what used to be a hard-no county road safety requirement.

In case you had any doubt, this rezoning is not just about this case, it is about the “precedent set by this case for other similarly sized and located properties in Lowndes County.”

Miller Bridge Rezoning back as R-A @ GLPC 2022-01-31

Update 2022-01-27: Packet: Staff says growth over agriculture and forestry for Miller Bridge R-A Rezoning @ GLPC 2022-01-31.

As expected, it’s back, on the agenda for the January 31st Planning Commission meeting, this time for R-A, as in probably 2.5-acre instead of 1-acre lots: 6. REZ-2022-03 Windy Hill Subdivision, 7532 Miller Bridge Rd., 0010 022, ~34 ac., E-A to R-A.

I would tell you more, but Lowndes County has not returned the board packet despite having more than the three days the Georgia Open Records Act (GORA) permits for returning such documents. So I’ve included some information provided by the opposition.

That’s one of four subdivision rezonings, one in Dasher, the other three in unincorporated Lowndes County. The Miller Bridge Road one is different because it’s still in an aquifer recharge zone, still far outside any appropriate Character Area in the Comprehensive Pland, and it has overwhelming opposition. See this map that opponents tell me was a house-to-house team effort to get people to sign a petition against the rezoning. It shows the parcels owned by the opponents. Cities and Lowndes County settle service delivery dispute @ LCC 2020-01-08

Update 2020-01-10: Not quite settled. Valdosta still has to agree to it.

These must be golden words indeed, to have been worth the hundreds of thousands of legal fees expended over them:

  1. In regards to water and sewer services:

    The Parties’ current water and sewer service areas are delineated on the service area maps attached to the DCA Forms for water and sewer services approved herewith.

    All existing intergovernmental agreements of the Parties regarding the provision of water and sewer services shall remain in effect.

    Any request for an extraterritorial extension shall be negotiated by the requesting Party and the affected Party. Approval of the affected Party shall not be unreasonably withheld.

The wording is “based on trust,” said Commissioner Clay Griner. “Where’s the document?” responded Commissioner Mark Wisenbaker? “It’s on your ipad,” clarified Chair Bill Slaughter.

As the County Clerk proceeded to hand out paper copies, Griner elaborated:

And it’s all based on trust. It’s us trusting, the County Commission trusting the City Council, whichever municipality it is, to do the right thing. The city council has to trust the County Commission to do the right thing. And the citizens to trust all of us to sit down and do the right thing.

Videos: Service Delivery Strategy (SDS) Meeting: Lowndes County and cities @ SDS 2019-02-04

The longest topic was water and wastewater, when elected officials from Lowndes County and its cities, Valdosta, Lake Park, Dasher, and Hahira (but apparently not Remerton), gathered on neutral ground to discuss tax revenue allocation, in a public meeting. Curiously, the Chairman and the Mayors were not invited. It’s not clear whether omitting them helped or not. There was actually mention that growth close to existing services is better than sprawl.

At least some elected officials from at least Lowndes County and Valdosta will be gathering Monday on neutral ground to discuss tax revenue allocation. Apparently this is a public meeting which anyone can attend.

A usually reliable source says this meeting is for voting Council and Commissioners, and the Mayor and Chairman were not invited. I don’t know if elected members of Council would only be from Valdosta, or also from Remerton, Lake Park, Hahira, and Dasher. If a quorum of any Council or Commissioners for any of these elected bodies is present, Georgia law requires it to be an open meeting which the public may attend. I can’t imagine the county would have posted it publicly if it wasn’t.

Videos: Branham subdivision, Bemiss Knights Academy, Lake Park @ GLPC 2015-09-28

Almost half an hour on the Bill Branham subdivision on Copeland Road resulted in a split denial: the only denial in this Planning Commission Regular Session.

Slightly less time on the Charles Bennett accessory dwelling unit on Green Meadown Drive got unanimous approval with staff conditions.

Ten minutes on the Clint Joyner’s request for Knight’s Development’s 30-acre subdivision rezoning on Bemiss Knights Academy Road got unanimous approval. About the same on Tim Blanton’s rezoning of 45+ acres to residential agriculture passed unanimously. Ditto rezoning for Richard Bonner’s rezoning for a fast-growth corridor between Highway 84 and Interstate 75. Less time for Jon Nijem’s expanded parking on Baytree Road to pass unanimously.

Keith Sandlin’s Lake Park case did sail through, as did John Thomas’ rezoning for a showroom for his show car business.

Commissioner Willis’ term was coming up for reappointment.

The Planning Commission last month welcomed Ed Hightower, appointed earlier that same month by the Lowndes County Commission. They heard one case each from the seldom seen Cities of Dasher, and Remerton (longest at almost 38 minutes on apartments at the old mill site). plus and three from Lowndes County including REZ-2018-02 CR Ventures – Rocky Ford Rd – 71 acres (third longest at 23 minutes), and five from Valdosta including Deep South Sanitation (second longest at more than 37 minutes), which was also separately heard on a related matter by ZBOA a week later.
