Attorney Talley announced that enough registered voters petitioned for the referendum. He also read from a Georgia Supreme Court case that indicated that the council more or less had to approve the referendum.

Sonny Vickers asked what would happen if council did not approve it. The mayor clarified that it would cost money out of the city’s budget to defend not approving it. Yet he added that no council member is required to vote for the referendum. The mayor said that after getting advice from the city attorney and manager that he thought even a vote no would end up with the city in the same place after spending money to defend that vote. Then he asked for a motion before debate.
