See <a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/08\/videos-developer-property-rights-and-effects-on-neighbors-leninco-roger-budd-lake-park-lcc-2014-08-12.html\">Videos: developer property rights and effects on neighbors, Leninco, Roger Budd, Lake Park @ LCC 2014-08-12<\/a>.\r\n<p><a href=\"http:\/\/youtu.be\/UEgdVpdJUI4\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"https:\/\/i.ytimg.com\/vi_webp\/UEgdVpdJUI4\/mqdefault.webp\"><\/a>\r\nWith little notice local citizens didn&#8217;t have time to organize opposition\r\nto a rezoning for three companies domiciled outside Lowndes County\r\non behalf of a developer who doesn&#8217;t even own the property next to them.\r\nYet again no agenda was posted for the Planning Commission last month\r\nso few people showed up.\r\nMore spoke at the Lowndes County Commission this month.\r\nBut with so little time, only 38 people signed a petition,\r\nand there were no\r\ncitizen-organized meetings, unlike for\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/05\/no-to-brookhaven-rezoning-lake-park-2014-05-06.html\">\r\nthe Brookhaven rezoning back in March and April<\/a>.\r\nUnlike the Lake Park City Council, which\r\nheld a <a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/05\/citizens-lawyers-and-developers-lake-park-2014-04-28.html\">special public hearing<\/a>,\r\nthe Lowndes County Commission plowed ahead on its usual schedule\r\nand voted on a bare majority to approve anyway for a developer on which\r\nthey are on a first-name basis,\r\nwhile local neighbors went un-named and unheeded.\r\nDoes this seem right to you?\r\n<p>\r\nToma Hawk\r\n<a href=\"http:\/\/youtu.be\/UEgdVpdJUI4\">\r\nvideoed and edited together<\/a> the Work Session of 11 August 2014\r\nand the Regular Session of 12 August 2014\r\nto emphasize this item from <a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/08\/construction-board-nelson-hill-and-creekwood-lcc-2014-08-11.html\">the agenda<\/a>:<!--more-->\r\n<blockquote style=\"font-size:100%\">\r\n6.b. All were in\r\nopposition, but it did not make much difference, as plans were\r\ncarried out anyways.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nSee also the LAKE video of the Roger Budd \r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/08\/family-dollar-on-roger-budd-property-near-francis-lake-in-lake-park-glpc-2014-07-28.html\">\r\nthe 28 July 2014 Planning Commission meeting<\/a>.\r\n<p>\r\nIn the Work Session in Toma Hawk&#8217;s video,\r\nyou can hear County Planner Jason Davenport say about\r\nthe applicant:\r\n<p>\r\n<blockquote style=\"font-size:100%\">\r\nMr. Budd has a proposed tenant and a proposed sale for that property\r\nto Family Dollar.\r\nThe problem with that proposed tenant and that proposed sale\r\nis that the layout of the Family Dollar wants is going to require Roger to\r\nacquire some additional property\r\nnext to that &#8230; to square that off to a rectangle.\r\nIt&#8217;s kind of got an odd non-trapezoid shape right now.\r\n<p>\r\nIn order to do that, Roger approached the adjacent property owner, which is \r\nLENINCo or Francis Lake Golf Course, or John Leonard Jr.\r\nAnd through those negotiations,\r\nfor about \r\n50 to 100 feet of property,\r\nRoger agreed to buy the entire four acre piece.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nDavenport didn&#8217;t mention that he hasn&#8217;t actually bought that property; see below.\r\n<blockquote>\r\n<p>\r\nSo I believe his main motivation is to allow Family Dollar to locate on his property.\r\nBut in addition to that he&#8217;s also looking long-term speculative uses\r\nof the property, so you&#8217;re going\r\nto see things going on.\r\nIf Family Dollar did not have such a deal with Mr. Budd I don&#8217;t think\r\nthis case would be before you.\r\nSo that&#8217;s his main motivation.\r\n<\/blockquote>\r\n<p>\r\nNotice it&#8217;s familiarly &#8220;Roger&#8221;, &#8220;Roger&#8221;, &#8220;Roger&#8221;, but nobody among\r\nthe opposition is named even formally.\r\n<blockquote>\r\n<p>\r\nAt the Planning Commission meeting we had two people speak in opposition.\r\nSince that time opposition has ramped up.\r\nI&#8217;ve had about six people come by my office or call me.\r\nWe received one letter of opposition you have in your packets.\r\nAnd one petition we&#8217;ve verified for about 38 properties\r\nwho&#8217;ve signed that particular petition.\r\n<\/blockquote>\r\n<p>\r\nUm, verified by Lowndes County?\r\nWith no citizen inspection?\r\nBelieve that if you also believe in unicorns.\r\nI&#8217;ll be happy to remind everybody why.\r\n<p>\r\nDavenport continued:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nYou also have a map within your packets\r\nthat shows you where the property owners are,\r\nand listing their addresses.\r\n<\/blockquote>\r\n<p>\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/if-effingham-county-can-do-it-why-not-lowndes.html\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm3.staticflickr.com\/2892\/8904039358_1c57e0dd1b_m.jpg\"><\/a>\r\nThe packet that only Commissioners got and that is not online,\r\nbecause mighty Lowndes County can&#8217;t manage to do what\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/if-effingham-county-can-do-it-why-not-lowndes.html\">\r\nEffingham County, half the size, does<\/a>.\r\nDitto\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/01\/nash-county-nc-has-agendas-and-minutes-for-many-local-boards-online.html\">\r\nNash County, NC<\/a>.\r\nSuwannee County, FL doesn&#8217;t, but <a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/06\/a-suwannee-county-commissioner-publishes-agenda-packets.html\">one of its Commissioners does<\/a>,\r\nand I&#8217;m told its County Clerk will email the packet to anybody who asks,\r\n<em>before<\/em> the meeting.\r\n<p>\r\nSo the opposition doesn&#8217;t have that map, and even if they filed an\r\nopen records request after the Work Session, they wouldn&#8217;t get it until\r\nthree days after the Commission voted in the Regular Session the following evening.\r\n<p>\r\nWhy doesn&#8217;t Lowndes County put its board packets online?\r\nSecrecy could lead people to think it&#8217;s because Commission and staff\r\ndon&#8217;t want citizens to know, because then the opposition might\r\nbe more than a nameless mass to be outvoted on behalf of first-name-basis\r\ndevelopers who don&#8217;t even own the land being rezoned.\r\nAs the\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/02\/transparency-in-government-is-essential-to-the-public-trust-vdt.html\">\r\nVDT editorialized 3 March 2012<\/a>:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nWhen officials act like they have something to hide, they often do,\r\nand when they begin to consider the government&#8217;s business as their\r\npersonal business, it&#8217;s time for the public to become concerned.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nDoes that sound like the situation you just saw in these videos?\r\n<p>\r\nFarther on,\r\nCommissioner Demarcus Marshall asked whether the applicant owned the property.\r\nDavenport said they&#8217;d checked into LENINCO, and it is a partnership between\r\nJohn Leonard Jr and his father.\r\nThey have a contract with Roger Budd, but if the development falls through\r\nthere would be no sale.\r\nSo in other words, no, the applicant listed on the agenda,\r\nRoger Budd Jr., does <em>not<\/em> own the property.\r\n<p>\r\nAccording to the Georgia Secretary of State,\r\n<a href=\"https:\/\/cgov.sos.state.ga.us\/Account.aspx\/ViewEntityData?entityId=1010312#\">\r\nLENINCO, LLC Control Number: K706031\r\n<\/a>\r\ndoesn&#8217;t list any officers, only a registered agent:\r\nH DAVID MOORE,\r\nCorder Road, Suite 200,\r\nWarner Robins, Georgia \t31088.\r\n<p>\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/?attachment_id=9808\">\r\n<img decoding=\"async\" style=\"float:right;border:none\" src=\"http:\/\/www.l-a-k-e.org\/blog\/wp-content\/uploads\/2014\/08\/68abe47926425332384d17bdfa6bfba01.jpg\"><\/a>\r\nThe\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/08\/family-dollar-on-roger-budd-property-near-francis-lake-in-lake-park-glpc-2014-07-28.html\">\r\nproperty shape shown at the Planning Commission<\/a>\r\nis entirely owned by LENINCO as Parcel Number\r\n<a href=\"http:\/\/qpublic7.qpublic.net\/ga_display.php?county=ga_lowndes&#038;KEY=0199%20%20050\">0199 050<\/a>,\r\naccording to\r\nthe Lowndes County Tax Assessor.\r\nWhich also lists the owner of two properties\r\njust to the west of LENINCO, parcel numbers\r\n<a href=\"http:\/\/qpublic7.qpublic.net\/ga_display.php?county=ga_lowndes&#038;KEY=0198%20%20193\">0198 193<\/a>\r\nand\r\n<a href=\"http:\/\/qpublic7.qpublic.net\/ga_display.php?county=ga_lowndes&#038;KEY=0198%20%20041\">0198 041<\/a>,\r\nas owned by\r\nBUDD COMMERCIAL REAL ESTATE LLC,\r\n308 7TH ST, SAINT SIMONS ISLAND, GA 31522.\r\nThose aren&#8217;t the properties of the rezoning, but that is the corporation Roger Budd Jr. apparently usually uses in Lake Park.\r\n<p>\r\nFamily Dollar is incorporated in Delaware and based at\r\n10401 Monroe Road, Matthews, North Carolina 28105,\r\naccording to <a href=\"http:\/\/secfilings.nasdaq.com\/edgar_conv_html%2f2013%2f10%2f28%2f0000034408-13-000015.html#FIS_BUSINESS\">its FY 2013 SEC FORM 10-K<\/a>.\r\n<p>\r\nMany citizens stood up and spoke, but apparently they weren&#8217;t on\r\na first-name basis with county staff and commissioners.\r\nThere was some concern by Crawford Powell about lighting\r\nnext to a Ms. Miller.\r\nHe then made a motion to approve with &#8220;all eleven conditions&#8221;\r\nwhich you, dear reader, have not seen, because the county does not\r\npublish its board packets.\r\nDemarcus Marshall seconded.\r\nI can see Joyce Evans vote no, but I can&#8217;t tell who the\r\nother No vote was.\r\n<p>\r\nSo the Lowndes County Commission voted to rezone on behalf of three\r\ncorporations domiciled outside Lowndes County,\r\nover the objections of at least 38 actual nearby property owners.\r\n<p>\r\nHere&#8217;s Toma Hawk&#8217;s description of his edited video:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nLowndes County, Ga. Board of Commissioners had a meeting on 8\/11 and\r\n8\/12 of 2014 concerning a few issues, mainly one involving residents\r\nof the Francis Lake Golf Course community. Rodger Budd Jr of\r\nValdosta, is one versus 38-plus property owners in opposition to his\r\nplan to sell land, converted from residential to commercial to\r\nDollar General.\r\n<\/p>\r\n<p>\r\nAfter a vote of 3-2 in favor of the commercial zoning decision,\r\nresidents walk out of the meeting in dismay.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nMost people who don&#8217;t regularly go to County Commission meetings\r\nwould be similarly confused about that last part.\r\nIt&#8217;s a chronic problem that citizens only show up for the one\r\nitem that directly affects them, and walk out afterwards,\r\nno matter what the item or the outcome.\r\nThis is a big reason why developers are on a first name basis\r\nwith county staff and citizens are nameless &#8220;opposition&#8221;.\r\n<p>\r\nMaybe some citizens should proactively try to change that.\r\nMaybe by floating a petition for the Commission to post board packets\r\nand to allow sufficient time for citizens to read and organize\r\nbefore the Commission votes.\r\n<p><a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/04\/effingham-county-youtubes-its-commission-meetings.html\"><img decoding=\"async\" style=\"float:right;border:none\" src=\"https:\/\/i1.ytimg.com\/vi\/0jb8jiazbFs\/mqdefault.jpg\"><\/a>\r\nWhile they&#8217;re at it, remember\r\ntiny Effingham County\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/04\/effingham-county-youtubes-its-commission-meetings.html\">\r\nYouTubes its own Commission meetings<\/a>.\r\nAs of course does\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2012\/04\/leon-county-commission-agenda-packets-and-videos.html\">\r\nLeon County, FL, like a real metropolitan area<\/a>.\r\nMighty Lowndes County brags about collecting\r\nhalf its SPLOST tax from people outside the county.\r\nIts Development Authority wants to attract businesses that like\r\nmetropolitan areas.\r\nWhy don&#8217;t the Lowndes County Commission\r\nand the Planning Commission and the Development Authority\r\nand the Valdosta City Council video and post their\r\nown meetings like a real metropolitan area?\r\nMaybe citizens should insist.\r\n<\/p>\r\n<p>\r\n -jsq\r\n<\/p>","protected":false},"excerpt":{"rendered":"Update 2014-08-25: There was some rationale for why the Commission voted to approve.
