Purpose of article<\/h2>\nThe purpose of this article is to encourage owners of land to make\nland and water areas available to the public for recreational\npurposes by limiting the owners&#8217; liability toward persons entering\nthereon for recreational purposes.\n<\/blockquote>\n<p>\nDoes that include boating?\n<\/p>\n\n<!--more-->\n<blockquote>\n\u00a751-3-21.\n(4) &#8220;Recreational purpose&#8221; includes, but is not limited to, any of the\nfollowing or any combination thereof: hunting, fishing, swimming, boating,\ncamping, picnicking, hiking, pleasure driving, nature study, water skiing,\nwinter sports, and viewing or enjoying historical, archeological, scenic,\nor scientific sites.\n<\/blockquote>\n<p>\nYes, it includes boating, hiking, picnicking, and other things people\nmight be doing on or nearby a river.\nSo what liability is covered?\n<\/p>\n<blockquote>\n<h2>\u00a751-3-22. Duty of owner of land to those using same for recreation generally<\/h2>\nExcept as specifically recognized by or provided in Code Section 51-3-25,\nan owner of land owes no duty of care to keep the premises safe for\nentry or use by others for recreational purposes or to give any warning\nof a dangerous condition, use, structure, or activity on the premises\nto persons entering for recreational purposes.\n<p>\nHISTORY: Ga. L. 1965, p. 476, s 3.\n<\/p>\n<h2>O.C.G.A. \u00a7 51-3-23 (1994)<\/h2>\n<h2>\n\u00a751-3-23. Effect of invitation or permission to use land for recreation\n<\/h2>\nExcept as specifically recognized by or provided in Code Section 51-3-25,\nan owner of land who either directly or indirectly invites or permits\nwithout charge any person to use the property for recreational purposes\ndoes not thereby:\n<p>\n(1) Extend any assurance that the premises are safe for any purpose;\n<\/p>\n<p>\n(2) Confer upon such person the legal status of an invitee or licensee\nto whom a duty of care is owed; or\n<\/p>\n<p>\n(3) Assume responsibility for or incur liability for any injury to person\nor property caused by an act of omission of such persons.\n<\/p>\n<p>\nHISTORY: Ga. L. 1965, p. 476, s 4.\n<\/p>\n<\/blockquote>\n<p>\nThere&#8217;s a bit more in the statute, and while I&#8217;m not a lawyer,\nit looks to me like unless a landowner deliberately makes it unsafe\nfor people to step ashore or gain access, the landowner is not liable\nif someone falls and breaks a leg or is otherwise injured after coming\nashore from a river.\n<a href=\"\/blog\/2013\/02\/why-did-lowndes-county-do-nothing-about-a-blocked-public-road.html\">\n<img decoding=\"async\" style=\"float:right;border:none;\" class=\"at-xid-6a0120a58214e4970b017d412d9439970c\" src=\"\/blog\/images\/6a0120a58214e4970b017d412d9439970c-pi.jpg\"    \/><\/a>\nI don&#8217;t know what it would take to be liable; maybe not even\n<a href=\"\/blog\/2013\/02\/why-did-lowndes-county-do-nothing-about-a-blocked-public-road.html\">\ndeliberately closing off a public road leading to a river<\/a>,\nif people could still walk over the barricade.\n<\/p>\n<p>\n-jsq\n<\/p>\n","protected":false},"excerpt":{"rendered":"Suppose you owned land next to a river.
