{"id":8463,"date":"2014-04-20T11:01:05","date_gmt":"2014-04-20T15:01:05","guid":{"rendered":"http:\/\/www.l-a-k-e.org\/blog\/?p=8463"},"modified":"2014-04-20T11:02:18","modified_gmt":"2014-04-20T15:02:18","slug":"second-mistrial-of-lula-smart-of-the-quitman-10-2","status":"publish","type":"post","link":"http:\/\/www.l-a-k-e.org\/blog\/2014\/04\/second-mistrial-of-lula-smart-of-the-quitman-10-2.html","title":{"rendered":"Second mistrial of Lula Smart of the Quitman 10 + 2"},"content":{"rendered":"<p>\r\n<a href=\"https:\/\/www.youtube.com\/watch?v=jy9Mt6Hb0eg\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"https:\/\/i1.ytimg.com\/vi\/jy9Mt6Hb0eg\/mqdefault.jpg\"><\/a>\r\nHow many mistrials does it take before the whole Quitman 10 +2\r\ncase gets thrown out of court?\r\nTwo and counting, as of Friday.\r\n<p>\r\nGeorge Boston Rhynes interviewed Brooks County Commissioner James Maxwell\r\noutside the courthouse in Quitman on a rainy day:\r\n<blockquote style=\"font-size:120%\">\r\nMistrial!\r\nAnother mistrial.\r\n<\/blockquote>\r\n<p>\r\nAnd the prosecutor wants to schedule <em>another<\/em> trial.\r\nGeorge asked the Commissioner how much another trial would cost Brooks County.\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nIt will cost quit a bit of money.\r\nWe could use that money on a day like today\r\nto repair roads.\r\nPeople can&#8217;t get in and out and here we are wasting the\r\ntaxpayers on another mistrial.\r\n<p>\r\nNo evidence!\r\nNo evidence!\r\nAnd another mistrial.\r\n<\/blockquote>\r\n<p>\r\nHere&#8217;s\r\n<a href=\"https:\/\/www.youtube.com\/watch?v=jy9Mt6Hb0eg\">\r\nPart 1 of 2:<\/a><!--more-->\r\n<\/p>\r\n<p style=\"text-align:center;font-size:80%\">\r\n<iframe loading=\"lazy\" title=\"YouTube video player\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/jy9Mt6Hb0eg\" frameborder=\"0\" allowfullscreen><\/iframe>\r\n<\/p>\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nAnd they&#8217;re spending the taxpayers&#8217; money.\r\nWhile the taxpayers are hollering and screaming \r\nabout the condition in Brooks County.\r\nWe are a poor community.\r\nDon&#8217;t have manufactures,\r\ndon&#8217;t have jobs, but yet we are spending the\r\ntaxpayers money, you understand, on another mistrial.\r\n<\/blockquote>\r\n<p>\r\nGeorge pointed out the mistrial might show deeper problems\r\nsince it revealed a postal worker getting &#8220;information off of \r\nofficial mail and give it to an agent&#8221;.\r\nThe Commissioner agreed: &#8220;Eighteen years in the\r\npostal service &#8230; and don&#8217;t know the rules and regulations of the postal service.&#8221;\r\n<p>\r\nGeorge also asked if a former Brooks County Board of Education member\r\nhad hired a private investigator to look into this case.\r\nThe Commissioner said yes, he was.\r\nGeorge wondered if that didn&#8217;t reveal a deeper undercurrent.\r\n<p>\r\nCommissioner James Maxwell summed up:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nWhat we need to do as the governing body&#8230;\r\nis money being spent on something that end up in another mistrial.\r\nIf the state does not have adequate proof of what took place\r\nthey really need to drop it.\r\nBecause all we&#8217;re doing is just spending taxpayer money.\r\n<\/blockquote>\r\n<p>\r\nGeorge also noted that other news media were not there.\r\nAnd he had been told to get off of courthouse grounds to video.\r\nUnlike in every other place he had done similar videos.\r\n<blockquote style=\"font-size:100%\">\r\nThe American people want to know what is going on in their nation,\r\nin their communities.\r\n<\/blockquote>\r\n<p>\r\n<a href=\"https:\/\/www.youtube.com\/watch?v=-L7LTDpRNVA\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"https:\/\/i1.ytimg.com\/vi\/-L7LTDpRNVA\/mqdefault.jpg\"><\/a>\r\nGeorge Boston Rhynes also stood on the rainy bricks outside\r\nthe courthouse and asked more questions about what will happen\r\nabout the new information of apparent postal service infractions\r\nand the statement by an employee of the Georgia Secretary of State\r\nthat apparently caused this mistrial.\r\n<\/p>\r\n<p>\r\nHere&#8217;s\r\n<a href=\"https:\/\/www.youtube.com\/watch?v=-L7LTDpRNVA\">\r\nPart 2 of 2:<\/a>\r\n<\/p>\r\n<p style=\"text-align:center;font-size:80%\">\r\n<iframe loading=\"lazy\" title=\"YouTube video player\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/-L7LTDpRNVA\" frameborder=\"0\" allowfullscreen><\/iframe>\r\n<\/p>\r\n<p>\r\nFinally, Patrick Davis wrote for examiner.com Saturday,\r\n<a href=\"http:\/\/www.examiner.com\/article\/second-mistrial-declared-brooks-co-absentee-ballot-case\">\r\nSecond mistrial declared in Brooks Co. absentee ballot case<\/a>,\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nIn essence, it was &#8216;same script, different cast&#8217; as Superior Court\r\nJudge Richard Porter resided over a case which has had several twist\r\nand turns since July 2010.\r\n<\/p>\r\n<p>\r\nThe Lula Smart trial which began on Monday, April 14, lasted five\r\ndays and just like the first trial, the State of Georgia&#8217;s\r\npresentation and explanation of evidence relating to absentee ballot\r\nfraud had fallen apart in open court within the first week and the\r\nSuperior Court judge decided to declare a mistrial.\r\n<\/p>\r\n<p>\r\nThis was the second mistrial declared in the last seven months. The\r\nfirst one occurred when Superior Court Judge Ronnie Lane from\r\nSeminole County made a similar motion after hearing the case after\r\njust five days.\r\n<\/p>\r\n<p>\r\nThe State of Georgia couldn&#8217;t prove that Lula Smart and\/or the\r\nQuitman 10+2 committed absentee ballot fraud.\r\n<\/p>\r\n<p>\r\nEven though Porter didn&#8217;t reside over the first mistrial, the Sonny\r\nPerdue judicial appointee in 2009 was instrumental in allowing\r\nwrite-in candidates&mdash;Myra Exum and Gary Rentz&mdash; to appear\r\non the ballot for the Brooks County School Board contest back in\r\n2010.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nI have to wonder why someone who was directly involved in the\r\ncase on trial was the judge for the trial.\r\nFurther,\r\nPatrick Davis points out letting those write-in candidates on the ballot\r\nmay have violated this Georgia law:\r\n<blockquote style=\"font-size:100%\">\r\n(d) No person shall be eligible as a write-in candidate in a general or\r\nspecial election if such person was a candidate for nomination or election\r\nto the same office in the immediately preceding primary.
