\r\nMaybe filing the lawsuit in the first place was “premature”,\r\nto use Chairman Bill Slaughter’s word in the VDT yesterday\r\nabout a possible appeal.\r\nCommissioner Demarcus Marshall\r\nhad the common courtesy on WCTV to\r\n\r\napologize to DSS<\/a> for the\r\n\r\nunnecessary lawsuit<\/a>.\r\nHow much did the Commission spend on that waste of time and effort?\r\n

\r\nEditor Kay Harris wrote on the front page of the Valdosta Daily Times yesterday,\r\n\r\nCompany wins fight to stay in business:\r\nDeep South wins case brought by County<\/a>,\r\n

\r\n

\r\n\r\n<\/a>\r\nSouthern Circuit Judge Harry J. Altman issued a ruling Monday in the\r\ncivil action filed by Lowndes County against Deep South Sanitation,\r\nLLC to enjoin Deep South from continuing its garbage business.\r\nAdvanced Disposal Services was later added as an intervenor\r\nplaintiff in the case against Deep South as well.\r\n<\/p>\r\n

\r\nIn the ruling, Altman denied the County’s request for an injunction\r\nto put Deep South out of business. The order addresses the County’s\r\nordinance passed in 2012, saying that to “simultaneously\r\ninvoke an exclusive franchise agreement with one company would, in\r\neffect … permit Lowndes County to construct a monopoly while\r\nsimultaneously putting pre-existing companies out of\r\nbusiness.”\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nWell, it appears the judge thought it was\r\n\r\nabout right or wrong<\/a>.\r\n

\r\nThe county Chairman’s view now?\r\n

\r\n

\r\nLowndes County Commission Chairman Bill Slaughter said the County\r\nCommission has not had the opportunity to review and discuss the\r\njudge’s ruling yet.\r\n<\/p>\r\n

\r\n“It’s too premature to say yet whether or not there will be an\r\nappeal,” he said.\r\n<\/p>\r\n

\r\nWhen asked if Advanced Disposal can pursue an appeal even if the\r\nCounty doesn’t, Slaughter said he believes the company can, but does\r\nnot know if it will.\r\n<\/p>\r\n

\r\n“The County does have an exclusive franchise agreement with\r\nAdvanced Disposal, but now Deep South can continue doing business as\r\nthey have, and there’s not a lot the County can do about\r\nthat,” he said.\r\n<\/p>\r\n

\r\nAltman stated that the court did not have to address the validity of\r\nthe County’s ordinance or the exclusive franchise agreement with\r\nAdvanced Disposal, but “those may be issues in a future case\r\nwith facts different from this case.”\r\n<\/p>\r\n<\/blockquote>\r\n

\r\n\r\n<\/a>\r\nMaybe if the county had followed state law in the first place,\r\nby holding\r\n\r\nthe public hearing the law requires<\/a> before\r\n“entering into a contract for the sale, lease, or management of a landfill or solid waste disposal facility owned by such county”\r\nthey wouldn’t have privatized the waste disposal sites and gotten\r\ninto this trashy “exclusive franchise” mess.\r\n

\r\nThe Chairman got away with making up a rule<\/a> to limit supporters of DSS from speaking\r\nin a Commission meeting, but the Commission didn’t get away with putting \r\na local company out of business for the benefit of an “exclusive franchise”\r\nbacked by investors from New York City.\r\n

\r\nCary Scarborough once again gets\r\n\r\na standing ovation<\/a>.\r\n

\r\n\r\n<\/a>\r\n\r\n<\/a>\r\n

\r\n\r\nOrder<\/a> isn’t enough.\r\nThe people, and now the judge, demand freedom.\r\n
