\nDid you know\nlast night’s Planning Commission meeting included\n\n<\/a>\na public hearing about changes to the county’s\nUnified Land Development Code (ULDC)\nrelated to land disturbances and water quality?\nYou wouldn’t have found out about that in the agenda,\nbecause\n\nit wasn’t posted anywhere you’d be likely to see it.<\/a>\n(Where does GLPC post the one physical copy of the agenda required by law,\nanyway?)\n\n<\/a>\nSupposedly it was advertised in the Valdosta Daily Times,\nbut a search\n\nof Public Notices in Statewide Database of Public Notices from Georgia’s Legal Organ Newspapers<\/a>\nfor 1 June 2012 through 27 August 2012 finds nothing.\n<\/p>\n

\n\n<\/a>\nHere’s what\n\nthe agenda item for the 27 August 2012 GLPC meeting<\/a>\n(that we only know about because Gretchen went to that GLPC meeting\nand asked County Planner Jason Davenport)\nsays:\n<\/p>\n

\nFrom a procedural standpoint the amendment has been advertised in\nthe Valdosta Daily Times to fulfill legal requirements. Beyond\nlegal requirements staff has plans to post this agenda\nitem and draft ULDC on the Lowndes County Website at \nhttp:\/\/www.lowndescounty.com\/content.asp?pid=23&id=224<\/a>. Regarding\nstaff review of the amendments, the TRC recommended for their approval\nat their 08\/16 regular meeting.\n<\/p>\n<\/blockquote>\n

\nPlease be advised that the Greater Lowndes Planning Commission\n(GLPC) and the Lowndes County Board of Commissioners (LCBOC) intend\nto hold public hearings to consider text amendments to the Unified\nLand Development Code (ULDC). ULDC Text Amendment TXT-2012-01\nprimarily addresses the Land Disturbance portion of the ULDC\n(Appendix A). TXT-2012-01 also addresses the adoption of a version\nof the ULDC that removes underline and strikethrough editing on\namendments previously approved by the Lowndes County Board of\nCommissioners (LCBOC). The proposed changes and additional\nbackground are available for downloading at the link below. Please\nbe patient when accessing or downloading the file as it is\napproximately 6 MB. These amendments are scheduled to be considered\nby the GLPC for recommendation on August 27th at 5:30 pm and then by\nthe LCBOC for a decision on September 11th at 5:30 pm. \nSo you just missed the Planning Commission public hearing,\n\n<\/a>\nand your only chance for a public hearing is 11 September 2012\nat the Regular Meeting of the Lowndes County Commission.\nUnless of course they cancel that one too,\n\nlike they cancelled the one today.<\/a>\n<\/p>\n

\nWhat is this ULDC amendment about?\nAccording to the agenda item:\n<\/p>\n

\n

\nULDC Text Amendment TXT-2012-01 primarily addresses the Land\n\n<\/a>\nDisturbance portion of the ULDC (Appendix A). TXT-2012-01 also\naddresses the adoption of a version of the ULDC that removes\nunderline and strikethrough editing on amendments previously\napproved by the Lowndes County Board of Commissioners (LCBOC).\nRegarding the Land Disturbance Amendments, in 2011 the Georgia\nEnvironmental Protection Division (EPD) Watershed Protection Branch\n\n<\/a>\ncompleted a review of the Land Disturbance portion of the ULDC (Also\nknown as the Lowndes County Soil Erosion, Sedimentation and\nPollution Control Ordinance). The Georgia EPD noted various minor\nchanges that needed to be made in the ordinance. It is important to\nhonor these changes because Lowndes County Engineering has been\nissued a Local Issuing Authority status for the review of Land\nDisturbance Permits, Issuance of Land Disturbance Permits, and Site\nInspections. This Local Issuing Authority status primarily helps\nbecause if there were not a ‘Local Issuing Authority’ the\nvarious responsibilities would be handled in Atlanta instead of\nLowndes County. Maintaining the Land Disturbance portion of the ULDC\nis a vital part of maintaining Local Issuing Authority status. The\nimpacts of these amendments are anticipated to address EPD’s\nchanges so that Lowndes County can maintain Local Issuing Authority\nstatus, remove various typographical errors in the appendix, and\nhelp solidify the intent of the appendix by clarifying the various\ncross references mentioned below. Regarding the Underline and\nStrikethrough Editing, the ULDC requires that amendments be\npresented in a strikethrough and underline format (10.02.07(B)(2)).\nPreviously staff presented the amendments in this format as a part\nof the actual entire ULDC code to be adopted. With the adoption of\nthese amendments staff is presenting the strikethrough and underline\nformat as a part of the staff report so that, should these\namendments be adopted, the amendments within the attached ULDC can\nbe shown and published in a completed and edited format. An example\nof how this works may be seen by comparing the unedited and edited\nULDC versions at the following website\n\nhttp:\/\/www.lowndescounty.com\/content.asp?pid=23&id=224<\/a>.\nThe impacts\nof these amendments are anticipated to solidify a single edited\nversion of the ULDC and provide for the removal of the underline and\nstrikethrough language from previously approved amendments.\n<\/p>\n<\/blockquote>\n

\nSo it appears to be clerical work required by the state EPD.\nBut how could you have known that?\nAnd how could you have known where the specific changes are\nso you could look to see if they matched that description?\n<\/p>\n
