\r\n<\/a>\r\nNRC PR 7 August 2013,\r\n\r\nNRC Webinar Aug. 21 to Discuss Regulations On Foreign Ownership of U.S. Reactors<\/a>,\r\n

\r\nNRC staff will hold a webinar on Aug. 21 to discuss the agency’s\r\nregulations regarding foreign ownership of U.S. nuclear power\r\nplants. The staff is responding to\r\n\r\nCommission direction<\/a> on assessing\r\nforeign ownership issues and considering if any changes to NRC\r\nguidance or practice would be appropriate.\r\n<\/p>\r\n

\r\nThe\r\n\r\nwebinar<\/a> and associated teleconference will run from 9 a.m. to\r\nnoon. NRC staff will first describe current regulations and then\r\ndiscuss previous stakeholder comments on the issue. Interested\r\ngroups and the public will have the opportunity to ask questions and\r\nprovide additional feedback on the matter. \r\nThe Atomic Energy Act and NRC regulations disqualify any applicant\r\nfor a nuclear power plant operating license if the applicant is\r\nowned, controlled or dominated by a foreign national, a foreign\r\ncorporation or a foreign government. In recent years, a number of\r\nlicensing actions before the NRC have involved complex issues of\r\nforeign ownership, control and domination. This is likely due to the\r\nincreased globalization of the electric power industry and\r\ncomplexity of corporate structures generally.\r\n<\/p>\r\n

\r\nThe Commission directed the staff in March to provide its assessment\r\nand proposals by Dec. 31. At this time, no specific changes to\r\nguidance or regulation are under consideration.\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nThe staff should provide a fresh assessment on issues relating to\r\nforeign ownership including recommendations on any proposed\r\nmodifications to guidance or practice on foreign ownership,\r\ndomination, or control that may be warranted. As part of this\r\ngeneric review, the staff should obtain stakeholder views and\r\npresent staff’s conclusions and recommendations in a voting paper\r\nfor Commission review and approval. This voting paper should be\r\nprovided to the Commission no later than December 31, 2013, and\r\ninclude recommendations on the path forward, recognizing that the\r\nCommission would provide formal notice and opportunity for public\r\ncomment should it propose to endorse or make significant changes in\r\npolicy.\r\n<\/p>\r\n

\r\nThe staff’s assessment should include, but not necessarily be\r\nlimited to, the following issues:\r\n<\/p>\r\n

\r\nThe limitation on foreign ownership contained in section 103d of the\r\nAtomic Energy Act and the potential to satisfy statutory objectives\r\nthrough an integrated review of foreign ownership, control, or\r\ndomination issues involving up to and including 100 percent indirect\r\nforeign ownership; criteria for assessing proposed plans or actions\r\nto negate direct or indirect foreign ownership or foreign financing\r\nof more than 50 percent but less than 100 percent, and the adequacy\r\nof guidance on these criteria; the availability of alternative\r\nmethods such as license conditions for resolving — following\r\nissuance of a combined license — foreign ownership, control or\r\ndomination concerns; and the agency’s interpretation of the\r\nstatutory meaning of “ownership,” and how that\r\ndefinition applies in various contexts, such as total or partial\r\nforeign ownership of a licensee’s parent, co-owners, or owners who\r\nare licensed to own but not to possess or operate a facility.\r\n<\/p>\r\n\r\n
