{"id":5147,"date":"2013-08-13T14:48:45","date_gmt":"2013-08-13T18:48:45","guid":{"rendered":"http:\/\/www.l-a-k-e.org\/blog\/?p=5147"},"modified":"2013-08-13T14:51:29","modified_gmt":"2013-08-13T18:51:29","slug":"nelson-hill-waivers-by-staff-2-lcc-2013-08-13","status":"publish","type":"post","link":"http:\/\/www.l-a-k-e.org\/blog\/2013\/08\/nelson-hill-waivers-by-staff-2-lcc-2013-08-13.html","title":{"rendered":"Nelson Hill waivers by staff @ LCC 2013-08-13"},"content":{"rendered":"<p>\r\nBefore\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/08\/rez-2013-09-moody-housing-val-del-rd-lcc-2013-08-12.html\">\r\ntonight&#8217;s vote on Moody Housing on Val Del Road<\/a>,\r\n<a href=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/rezoning\/Nelson_Hill\/\">\r\n<img decoding=\"async\" style=\"float:right;border:none;width:290px\" src=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/rezoning\/Nelson_Hill\/District-2-Nelson-Hill-Development-Binder-4.10-and-5.10-and-13.jpg\"><\/a>\r\nmaybe somebody should review\r\nthese administrative waivers from county staff for Nelson Hill,\r\none for the minimum lot size, and the other for setbacks for the lots along the &#8220;lake&#8221;.\r\nI haven&#8217;t yet found who waived\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/08\/what-happened-at-nelson-hill-on-val-del-road-lcc-2013-08-12.html\">\r\nthe requirement<\/a> for condominiums,\r\nor for their fronts to be staggered,\r\nor for them to be at least 1800 square feet,\r\nor the traffic calming measures,\r\nor how all this fits the submitted site plans,\r\nnor for that matter what happened to\r\nthe gate or guards or the road connecting to Grove Point.\r\nMaybe you can find those things in\r\n<a href=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/rezoning\/Nelson_Hill\/\">\r\nthe materials about Nelson Hill received in response to\r\nan Open Records Request<\/a>.\r\nIf staff can waive all these things without any of them coming up\r\nagain for a vote before the elected Commission in a public hearing,\r\nwhy do we have the elected Commissioners vote in the first place?\r\n<p>\r\n<a href=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/rezoning\/Nelson_Hill\/AAW-2009-06-Laurence-Nelson\/AAW-2009-06-county-approval-letter.html\">\r\n<img decoding=\"async\" style=\"float:right;border:none;width:229px\" src=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/rezoning\/Nelson_Hill\/AAW-2009-06-Laurence-Nelson\/AAW-2009-06-county-approval-letter.jpg\"><\/a>\r\nHere&#8217;s a waiver for lot setbacks next to the pond\r\n<a href=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/rezoning\/Nelson_Hill\/AAW-2009-06-Laurence-Nelson\/AAW-2009-06-county-approval-letter.html\">\r\nby Joe Pritchard &#8220;In my official capacity as County Manager&#8221;<\/a>,\r\n22 September 2009, for AAW-2009-06.\r\n<p>\r\nHere&#8217;s a waiver for minimum lot sizes\r\n<a href=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/rezoning\/Nelson_Hill\/AAW-2011-16-Nelson-Hills-Brad-Folsom-\/mime\/Nelson-Hill-Subdivision-Minimum-Lot-Size-Interpretation.txt\">\r\nby Jason Davenport, County Planner<\/a>, 18 July 2011, for AAW-2011-16:\r\n<blockquote>\r\n<p>\r\nGood afternoon.  Based on recent questions from multiple parties\r\nregarding Nelson Hill we thought it best to respond in writing to all.\r\nFor us the question is \u201cWill the County require a minimum lot size in\r\nNelson Hill?\u201d  and our answer is<!--more--> No.  Lowndes County will not prohibit\r\nsomeone from reducing the minimum lot size.  At a minimum, we will\r\nrequire that the subdivision plats be updated to reflect the new lot\r\nsize and that the various notes and organization of the new plats be\r\nconsistent with the previously approved preliminary and final plats.\r\nHowever, should the option to reduce the sizes of the lots be chosen, we\r\ndo note the following other impacts to consider before pursuing that\r\nparticular direction:\r\n<p>\r\n1.\tOther notes on the plats will need to be modified (e.g. Land Use\r\nChart \u2013 Greenspace\/Residential, Lake Space Note, Minimum Lot Area Note,\r\nMinimum Lot Width Note, etc.)\r\n<p>\r\n2.      We have concerns over the resulting developable area if the lots\r\nare reduced (e.g. Setbacks &#038; Utility Connections).  Please note that\r\nfurther modifications along these lines may trigger a PD Amendment.\r\n<p>\r\nOtherwise, from a staff standpoint, know that with the seemingly new\r\ndirection and expectations of Nelson Hill we would recommend a PD\r\namendment.  In closing, it is our hope that this interpretation will be\r\nuseful moving forward and as a result we will identify that, if\r\nnecessary, it is subject to appeal (ULDC Section 10.04.00).\r\n<\/blockquote>\r\n<p>\r\nNow, this isn&#8217;t about Jason Davenport, who was most helpful in\r\ncompiling all these materials for my recent Open Records Requests.\r\nIt&#8217;s about the county government&#8217;s culture of making concessions\r\nto developers that the public never gets to see without filing\r\nan Open Records Request.\r\nOr, in this case, reading the Minutes from 2007 and driving by\r\nNelson Hill to compare.\r\nDo all these changes without any public review by elected Commissioners\r\nseem right to you?\r\n<p>\r\nAnd if this kind of thing happened in the neighborhood of the\r\nproposed Moody Family Housing development on Val Del Road,\r\nhow do we know things like this won&#8217;t happen for that development, too?\r\n<p>\r\nLawyers for the new proposed development can\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/08\/rez-2013-09-moody-housing-val-del-rd-lcc-2013-08-12.html\">\r\ntry to sweep under the rug as &#8220;a long time ago&#8221;<\/a>\r\nor as\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/08\/no-mold-n-unpaid-contractors-this-time-for-moody-housing-glpc-2013-07-29.html\">\r\n&#8220;the unfortunate issue that took place with the prior development&#8221;<\/a>.\r\nAt least Magnolia Grove is hidden away back from Bemiss Road over by the base.\r\nBut Nelson Hill is right there on Val Del Road where everyone can see.\r\nAnd now you have some idea of what happened at Nelson Hill.\r\n<p>\r\nDo we want another Magnolia Grove or Nelson Hill?\r\nIf not, maybe we can get something better as assurances from the County\r\nCommission and staff for Moody Family Housing than we got for those \r\nprevious two developments.\r\n<p>\r\nOh, and those <a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/08\/videos-moody-moody-acre-water-and-splost-vi-lcc-2013-08-12-lcc-2013-08-12.html\">\r\nOpen Records Requests<\/a> Gretchen filed after yesterday morning&#8217;s\r\nWork Session have not been completed by the county, while it&#8217;s\r\nonly a few hours before the voting Regular Session.\r\nSo you won&#8217;t know what&#8217;s in those 30 pages of updates\r\non Moody Family Housing or what&#8217;s being changed in SPLOST\r\nor what&#8217;s in the SPLOST VII lists the county is likely to approve tonight.\r\n<p>\r\nIt&#8217;s the county way!\r\n<p>\r\nBut should it be?\r\n<p>\r\n -jsq\r\n<\/p>","protected":false},"excerpt":{"rendered":"Before tonight&#8217;s vote on Moody Housing on Val Del Road, maybe somebody should review these administrative waivers from county staff for Nelson Hill, one for the minimum lot size, and the other for setbacks for the lots along the &#8220;lake&#8221;.
