{"id":507,"date":"2012-09-10T09:14:38","date_gmt":"2012-09-10T13:14:38","guid":{"rendered":"http:\/\/www.l-a-k-e.org\/blog\/2012\/09\/public-schools-to-be-treated-less-favorably-than-charter-schools.html"},"modified":"2012-09-10T09:14:38","modified_gmt":"2012-09-10T13:14:38","slug":"public-schools-to-be-treated-less-favorably-than-charter-schools","status":"publish","type":"post","link":"http:\/\/www.l-a-k-e.org\/blog\/2012\/09\/public-schools-to-be-treated-less-favorably-than-charter-schools.html","title":{"rendered":"Public schools to be treated less favorably than state-dictated charter schools?"},"content":{"rendered":"<p>\nDo you want to pay more local taxes for state-dictated and state-run\ncharter schools?\n<a href=\"http:\/\/www.l-a-k-e.org\/govt\/state.php#blackEllis\">\n<img decoding=\"async\" style=\"float:right;border:none;\" class=\"at-xid-6a0120a58214e4970b017744a29f00970d\" src=\"\/blog\/images\/6a0120a58214e4970b017744a29f00970d-pi.jpg\"  alt=\"Ellis Black (R-174)\"  \/><\/a>\nIn\n<a href=\"http:\/\/www.legis.ga.gov\/legislation\/en-US\/display\/20112012\/HB\/797\">\nHB 797<\/a>,\none of the state laws we&#8217;re being asked to ratify with the charter school referendum\non the ballot in November,\nin addition to the magic accounting rules that would\n<a href=\"\/blog\/2012\/08\/georgia-would-send-much-more-money-per-student-to-charter-schools-than-to-public-schools.html\">\ngrant charter schools much more money per student than public schools,<\/a>\nit would create a state-wide charter school board that will take away\nall oversight from the local school board for any charter schools the\nstate imposes on any locality.\nYet it does <em>not<\/em> provide additional state funding for the extra\nmoney per student for charter schools, and it <em>does<\/em>\nexplicitly address assessed valuation of local taxes.\n<\/p>\n<p>\nThe state takes all control over local chartered\nschools from the local school board in section 2A(7), last paragraph:\n<\/p>\n<blockquote>\n<p>\n<a href=\"http:\/\/www.legis.state.ga.us\/legis\/2009_10\/house\/bios\/carterAmy\/carterAmyBio.htm\">\n<img decoding=\"async\" style=\"float:right;border:none;\" class=\"at-xid-6a0120a58214e4970b016764560414970b\" src=\"\/blog\/images\/6a0120a58214e4970b016764560414970b-pi.jpg\"  alt=\"Amy Carter (R-175)\"  \/><\/a>\nThe local board shall not be responsible for the fiscal management,\naccounting, or oversight of the state chartered special school.\n<\/p>\n<\/blockquote>\n<p>\nYet the state provides no additional funding for the additional money\nper student for charter schools:\n<\/p>\n<blockquote>\n<p>\n<a href=\"http:\/\/www.l-a-k-e.org\/govt\/state.php#shawJason\">\n<img decoding=\"async\" style=\"float:right;border:none;\" class=\"at-xid-6a0120a58214e4970b017744a29f08970d\" src=\"\/blog\/images\/6a0120a58214e4970b017744a29f08970d-pi.jpg\"  alt=\"Jason Shaw (R-176)\"  \/><\/a>\n2A(5) No deduction shall be made to any state funding which a local school\nsystem is otherwise authorized to receive pursuant to this chapter\nas a direct result or consequence of the enrollment in a state\ncharter school of a specific student or students who reside in the\ngeographical area of the local school system.\n<\/p>\n<p>\n(6) Funding for state chartered special schools pursuant to this\nsubsection shall be subject to appropriations by the General\nAssembly and such schools shall be treated consistently with all\nother public schools in this state, pursuant to the respective\nstatutory funding formulas and grants.\n<\/p>\n<\/blockquote>\n<p>\nThe bill also inserts each of those paragraphs again elsewhere,\nin case the point wasn&#8217;t clear enough.\n<\/p>\n<p>\nSo where is the extra money to come from?\nHere&#8217;s a hint:\n<\/p>\n\n<!--more-->\n<blockquote>\n<p>\n<a href=\"http:\/\/www.l-a-k-e.org\/govt\/state.php#goldenTim\">\n<img decoding=\"async\" style=\"float:right;border:none;\" class=\"at-xid-6a0120a58214e4970b017744a29f0c970d\" src=\"\/blog\/images\/6a0120a58214e4970b017744a29f0c970d-pi.jpg\"  alt=\"Tim Golden (R-8th)\"  \/><\/a>\n20-2-2089 (a)(3)(A) &#8216;Assessed valuation&#8217; is defined as 40 percent of\nthe equalized adjusted property tax 307 digest reduced by the amount\ncalculated pursuant to subsection (g) of Code Section 308 20-2-164.\n<\/p>\n<\/blockquote>\n<p>\nWhat isn&#8217;t appropriated by the General Assembly?\nFederal taxes, but there&#8217;s language that seems to say federal\nmoney can&#8217;t be allocated differently for charter schools.\nWhat&#8217;s left?\nLocal property taxes and local sales taxes.\nSo the extra money per student to charter schools would have to come\nfrom local property tax millage and E-SPLOST.\n<\/p>\n<p>\nThe last sentence of section 2A(7) sums it up:\n<\/p>\n<blockquote>\n<p>\nWhere feasible, the state board shall treat a state chartered\nspecial school no less favorably than other public schools within\nthe state with respect to the provision of funds for transportation\nand building programs.\n<\/p>\n<\/blockquote>\n<p>\nNowhere does it say public schools shall be treated no less\nfavorably than charter schools about anything.\n<\/p>\n<p>\nAnd we get to pay for the state&#8217;s favorable treatment of state-dictated\nand state-controled charter schools\nthrough our local property and sales taxes.\nThe charter school referendum on the November ballot isn&#8217;t about\nimproving education.\nIt&#8217;s about using centralized state control to funnel our local tax money\nto private companies running charter schools.\nWe can vote that down in November.\n<\/p>\n<p>\nWhile voting, it could be useful to remember who said Yea for HB 797\nin the legislature.\nIn the\n<a href=\"http:\/\/www.legis.ga.gov\/Legislation\/en-US\/vote.aspx?VoteID=9132\">\nHouse,<\/a>\nEllis Black (R-174), Amy Carter (R-175), and Jason Shaw (R-176) voted for it.\nIn the\n<a href=\"http:\/\/www.legis.ga.gov\/Legislation\/en-US\/vote.aspx?VoteID=9132\">\nSenate,<\/a>\nTim Golden (R-8th) voted for it.\n<\/p>\n<p>\n-jsq\n<\/p>\n","protected":false},"excerpt":{"rendered":"Do you want to pay more local taxes for state-dictated and state-run charter schools?
