R-1 and R-21 to R-10, LC Water and Sewer, ~0.71 acres<\/a>\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\n<a href=\"http:\/\/www.flickr.com\/photos\/98706376@N00\/9267695825\/sizes\/m\/\" title=\"REZ-2013-07 map 1\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm8.staticflickr.com\/7362\/9267695825_2fedda37bf_m.jpg\" alt=\"REZ-2013-07 map 1\"><\/a>\r\nCounty Planner presented the case\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/07\/videos-water-sewer-video-arraignment-and-backups-lcc-2013-07-08-lcc-2013-07-08.html#REZ-2013-07\">\r\nthe same way he did the previous morning at the Work Session<\/a>.\r\nThis time they had a copy of the agreement with the neighbors signed by\r\nthe applicant.\r\nThe neighbors still wanted the Commission to guarantee that covenant.\r\n<p style=\"text-align:center\">\r\n<a href=\"http:\/\/www.flickr.com\/photos\/98706376@N00\/9270479164\/sizes\/z\/\" title=\"REZ-2013-07 map 2\">\r\n<img decoding=\"async\" style=\"border:none;\" src=\"http:\/\/farm4.staticflickr.com\/3754\/9270479164_2f711dcc60_z.jpg\" alt=\"REZ-2013-07 map 2\"><\/a>\r\n<H3>Speaking Against<\/h3>\r\n<p style=\"font-style:normal\">\r\n<a href=\"http:\/\/www.youtube.com\/watch?v=Eub9-2Nrdpk&#038;feature=youtu.be&#038;t=3m20s\">\r\nCurtis Hankins, 2109 Jeff&#8217;s Place<\/a>, said<!--more-->\r\n<blockquote>\r\n<a href=\"http:\/\/www.flickr.com\/photos\/98706376@N00\/9270480874\/sizes\/z\/\" title=\"Curtis Hankins with pictures\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm4.staticflickr.com\/3758\/9270480874_c9629c86a2_n.jpg\" alt=\"Curtis Hankins with pictures\"><\/a>\r\nI&#8217;ve spoken with everyone in the neighborhood on that street,\r\nand no one wants Mr. Leatherwood to build that house.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nHankins also said the house was going to face a different direction\r\nthan originally proposed. Hankins said he had photos and a petition,\r\nand everyone in his neighborhood was concerned about their property\r\nvalues. That plus they all want the neighborhood covenant enforced.\r\n<p style=\"font-style:normal\">\r\nCommissioner John Page asked for Hankins to pass the pictures around\r\nso the Commissioners could see.\r\nCommissioner Demarcus Marshall asked how the covenant played into this.\r\nChairman Bill Slaughter said the applicant had signed it and would abide by it.\r\n<p style=\"font-style:normal\">\r\n<a href=\"http:\/\/www.flickr.com\/photos\/98706376@N00\/9270484410\/sizes\/z\/\" title=\"Brandy Dykes 3\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm4.staticflickr.com\/3686\/9270484410_94210b32fd_n.jpg\" alt=\"Brandy Dykes 3\"><\/a>\r\n<a href=\"http:\/\/www.youtube.com\/watch?v=Eub9-2Nrdpk&#038;feature=youtu.be&#038;t=6m40s\">\r\nBrandy Dykes<\/a>, 2095 Jason Circle,\r\nsaid separating the property was an attempt to build another residence\r\n<blockquote>\r\nliterally right on top of the one he already owned.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\n<a href=\"http:\/\/www.flickr.com\/photos\/98706376@N00\/9270485130\/sizes\/z\/\" title=\"Kenneth Graham\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm4.staticflickr.com\/3722\/9270485130_255b339523_n.jpg\" alt=\"Kenneth Graham\"><\/a>\r\n<a href=\"http:\/\/www.youtube.com\/watch?v=Eub9-2Nrdpk&#038;feature=youtu.be&#038;t=7m41s\">\r\nKenneth Graham, 2107 Lynnhaven Road<\/a>\r\nsaid he&#8217;d been there since 2007, so\r\n<blockquote>\r\nour home value has taken a major hit with the economy,\r\nand we don&#8217;t need anything else to drag it down.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\n<a href=\"http:\/\/www.flickr.com\/photos\/98706376@N00\/9267702883\/sizes\/s\/\" title=\"County Chairman Bill Slaughter one more speaker\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm8.staticflickr.com\/7320\/9267702883_1c7e23e9ba_m.jpg\" alt=\"County Chairman Bill Slaughter one more speaker\"><\/a>\r\n<a href=\"http:\/\/www.youtube.com\/watch?v=Eub9-2Nrdpk&#038;feature=youtu.be&#038;t=8m50s\">\r\nChairman Slaughter asked<\/a> if there was anyone else who\r\nwanted to speak against, and remarked\r\n<blockquote>\r\nAll right, we&#8217;ll take one more.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nI don&#8217;t know that he gets to decide that on a public hearing.\r\nThis isn&#8217;t\r\n<a href=\"#Citizens\">\r\nCitizens Wishing to Be Heard<\/a>, with its arbitrarily\r\nenforced arbitrary rules.\r\n<p style=\"font-style:normal\">\r\n<a href=\"http:\/\/www.flickr.com\/photos\/98706376@N00\/9270486278\/sizes\/z\/\" title=\"Doc Baldwin\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm8.staticflickr.com\/7425\/9270486278_ac8ff091f6_n.jpg\" alt=\"Doc Baldwin\"><\/a>\r\n<a href=\"http:\/\/www.youtube.com\/watch?v=Eub9-2Nrdpk&#038;feature=youtu.be&#038;t=9m\">\r\nDoc Baldwin of 2079 Lynnhaven Road<\/a>\r\nsaid he&#8217;d moved there from Portland, Oregon,\r\nand talked about covenants and restrictions, complaining\r\nthe applicant wanted to put too many houses on too few square feet.\r\n<H3>Speaking in Favor<\/H3>\r\n<p style=\"font-style:normal\">\r\n<a href=\"http:\/\/www.flickr.com\/photos\/98706376@N00\/9270486956\/sizes\/z\/\" title=\"Leatherwood\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm3.staticflickr.com\/2815\/9270486956_9775b6944b_n.jpg\" alt=\"Leatherwood\"><\/a>\r\nThe applicant,\r\n<a href=\"http:\/\/www.youtube.com\/watch?v=Eub9-2Nrdpk&#038;feature=youtu.be&#038;t=9m50s\">\r\nJohnnie Leatherwood, 2406 James Road<\/a>,\r\nsaid he would abide by all covenants.\r\nHe seemed to say that with county water and sewer he couldn&#8217;t\r\nbuild a smaller house.\r\n<p style=\"font-style:normal\">\r\nCommissioner Joyce Evans asked if his front would be facing\r\nLynnhaven. He said, &#8220;yes ma&#8217;am.&#8221;\r\nHe also asserted he had 12,000 square feet, not 10,000.\r\nCommissioner Page quizzed him about the covenant again,\r\nand the applicant said he had agreed to it.\r\n<H3>Commissioner Questions<\/H3>\r\n<p style=\"font-style:normal\">\r\nCommissioner Evans asked Planner Davenport whether the house\r\nfacing Glynnhaven would meet the covenant restrictions.\r\nHe said yes, except he wasn&#8217;t aware of a minimum lot size\r\nin the covenants.\r\nApplicant would, however, have to change his roof\r\n(as mentioned the previous morning).\r\nHowever, he said the covenants the Commissioners had \r\nseen were for the cul-de-sacs on the north side of Lynnhaven,\r\n<p style=\"font-style:normal\">\r\nCommissioner Raines said in his opinion\r\n<blockquote>\r\nthe question before this board is is this a legitimate use of\r\nthis property.\r\nAnd I think if we get too far beyond the scope of that question\r\nthen we have exceeded our authority as a board of commissioners.\r\nSo the question before this board is: is what he wants to do with\r\nthat property and acceptable use for this piece of property.\r\nI think the issue involving covenants is for\r\na different entity than this board.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nHe didn&#8217;t indicate what other entity that might be.\r\nAnd he didn&#8217;t indicate the county should stop suing a local business\r\nabout a waste collection covenant.\r\n<H3>Motion and Vote<\/H3>\r\n<p style=\"font-style:normal\">\r\nCommissioner Evans made a motion to approve and Commissioner Page seconded.\r\nUnanimous approval.\r\n<\/p>\r\n<p>\r\nVideo\r\n<a href=\"http:\/\/www.youtube.com\/watch?v=Eub9-2Nrdpk&#038;feature=youtu.be&#038;t=1m55s\">\r\nhere<\/a>.\r\n<\/p>\r\n<p>\r\n -jsq\r\n<\/p>","protected":false},"excerpt":{"rendered":"&#8220;All right, we&#8217;ll take one more!&#8221; said County Chairman Bill Slaughter in a public hearing at the 9 July 2013 Regular Session of the Lowndes County Commission.
