\nThis time they had a copy of the agreement with the neighbors signed by
\nthe applicant.
\nThe neighbors still wanted the Commission to guarantee that covenant.<\/p>\n

\nCurtis Hankins, 2109 Jeff’s Place<\/a>, said<\/p>\n

\nI’ve spoken with everyone in the neighborhood on that street,
\nand no one wants Mr. Leatherwood to build that house.\n<\/p><\/blockquote>\n

\nHankins also said the house was going to face a different direction
\nthan originally proposed. Hankins said he had photos and a petition,
\nand everyone in his neighborhood was concerned about their property
\nvalues. That plus they all want the neighborhood covenant enforced.<\/p>\n

\nCommissioner John Page asked for Hankins to pass the pictures around
\nso the Commissioners could see.
\nCommissioner Demarcus Marshall asked how the covenant played into this.
\nChairman Bill Slaughter said the applicant had signed it and would abide by it.<\/p>\n

\nsaid separating the property was an attempt to build another residence<\/p>\n

\nsaid he’d moved there from Portland, Oregon,
\nand talked about covenants and restrictions, complaining
\nthe applicant wanted to put too many houses on too few square feet.

\nJohnnie Leatherwood, 2406 James Road<\/a>,
\nsaid he would abide by all covenants.
\nHe seemed to say that with county water and sewer he couldn’t
\nbuild a smaller house.<\/p>\n

\nCommissioner Joyce Evans asked if his front would be facing
\nLynnhaven. He said, “yes ma’am.”
\nHe also asserted he had 12,000 square feet, not 10,000.
\nCommissioner Page quizzed him about the covenant again,
\nand the applicant said he had agreed to it.
\n

Commissioner Questions<\/H3><\/p>\n

\nCommissioner Evans asked Planner Davenport whether the house
\nfacing Glynnhaven would meet the covenant restrictions.
\nHe said yes, except he wasn’t aware of a minimum lot size
\nin the covenants.
\nApplicant would, however, have to change his roof
\n(as mentioned the previous morning).
\nHowever, he said the covenants the Commissioners had
\nseen were for the cul-de-sacs on the north side of Lynnhaven,<\/p>\n

\nCommissioner Raines said in his opinion<\/p>\n

\nthe question before this board is is this a legitimate use of
\nthis property.
\nAnd I think if we get too far beyond the scope of that question
\nthen we have exceeded our authority as a board of commissioners.
\nSo the question before this board is: is what he wants to do with
\nthat property and acceptable use for this piece of property.
\nI think the issue involving covenants is for
\na different entity than this board.\n<\/p><\/blockquote>\n

\nHe didn’t indicate what other entity that might be.
\nAnd he didn’t indicate the county should stop suing a local business
\nabout a waste collection covenant.
\n

Motion and Vote<\/H3><\/p>\n

\nCommissioner Evans made a motion to approve and Commissioner Page seconded.
\nUnanimous approval.\n<\/p>\n
