\r\nI don’t have any interest at all in this board enforcing covenants like that.\r\n<\/blockquote>\r\nCommissioner Richard Raines said that at yesterday morning’s Work Session about\r\na covenant<\/a> the neighbors want\r\na rezoning applicant to sign, yet it was Commissioner Raines\r\nwho made the motion last fall to let an Exclusive Franchise\r\nwith Advanced Disposal Services;\r\na covenant the county is now trying to enforce by suing\r\nlocal business Deep South Sanitation.\r\nThey said nothing about\r\n\r\nthat 100 foot wide pipeline barrelling through the county<\/a>.\r\nThey vote tonight, 5:30 PM.\r\n

\r\nCounty sound still wasn’t working, going on a month now, back in the videoing pen in the \r\nback of the room, so what you hear is what we hear back there, as recorded by the LAKE camera.\r\n

    \r\nOnce again, Chairman Bill Slaughter directed Commissioners to\r\nget any changes to the County Clerk.\r\n<\/p>\r\n

      \r\nApplicant wants to put existing house on county water and sewer on James Road,\r\nand subdivide to build another house on a piece.\r\nSome of the neighbors object.\r\nCounty Planner Jason Davenport said the subdivided lot size would\r\nbe similar to existing lot sizes.\r\nA group of neighbors says they won’t object if the applicant signs\r\nan agreement they have drafted that apparently says he would abide\r\nby the same restrictions they have on their properties.\r\nThe neighbors ask the county to put a condition in the rezoning\r\nabout that covenant.\r\nCounty Planner has a concern about the county being in a position\r\nof enforcing such a covenant.\r\nHe asked the Commission for direction.\r\n

      \r\nCommissioner Joyce Evans asked if this was across the street from\r\nwhere there was a previous issue with rezoning for a Habitat house.\r\nPlanner said yes.\r\nCommissioner said the issue was setback.\r\nPlanner said this one was different.\r\nPlanner said this house would be larger.\r\nPlanner agreed and said that was one of the neighbors’ concerns;\r\nalso they wanted to make sure whatever he builds is compatible\r\nor better than what they have.\r\n

      \r\nCommissioner Richard Raines asked if the structure the applicant\r\ncurrently proposed addressed those concerns, which were presented\r\nby the neighbors at the relevant Planning Commission meeting.\r\nPlanner said there may need to be some modifications to the roof,\r\nwhich he has agreed to.\r\n

      \r\nCommissioner Evans\r\nasked if that would meet all the neighbors’ concerns.\r\nPlanner said yes ma’am, but he hadn’t seen the agreement\r\nsigned by applicant’s attorney.\r\n

      \r\nCommissioner Demarcus Marshall\r\nwanted to know the extent of the covenant: just that block, or what?\r\n

      \r\n\r\n\"James<\/a>\r\nChairman Bill Slaughter said he thought it was just the houses behind.\r\nPlanner said these covenants were in place for\r\nJeff Place, Jason Circle, and Holland Circle,\r\nand other lots across Lynnhaven Road had different covenants.\r\n

      \r\nCommissioner Raines opined:\r\n<\/p>\r\n

      \r\nI think if we got into the business of enforcing covenants,\r\nI don’t think we could hire enough personnel to make sure everyone’s\r\ngrass was cut….\r\nI don’t have any interest at all in this board enforcing covenants like that.\r\n<\/blockquote>\r\n

      \r\nApparently Commissioner Raines does have an interest in enforcing\r\ncovenants like the\r\n\r\nExclusive Franchise<\/a> that\r\n\r\nhe moved<\/a> and the Commissioners\r\napproved with\r\n\r\nAdvanced Disposal Services,\r\nowned by investors in New York City<\/a>.\r\nwhich they are now enforcing by suing a local business.\r\nI wonder how much the county is paying for that?\r\n<\/p>\r\n

    4. \r\n\r\nFor Consideration<\/a> \r\n

      \r\nCounty Manager Joe Pritchard\r\nsaid at their last meeting\r\n(\r\n25 June 2013<\/a>) Commissioners had approved the idea so that\r\nstaff could come back with a\r\npurchase order, statement of work, and contract, which\r\nthey now have. He quoted the prices as:\r\n
