\r\nWhy did the Lowndes County Commission make\r\n\r\nthis exclusive franchise<\/a>\r\nwith a Florida or Alabama or New York company\r\n\r\n<\/a>\r\nand then\r\n\r\nsue a local Lowndes County company<\/a> after\r\n\r\nthe VDT reported the previous spring<\/a> that any contract\r\nwould be non-exclusive and wouldn’t put anybody out of business?\r\n<\/p>\r\n

\r\nHere, obtained by LAKE through an open records request,\r\nis the\r\n\r\ncontract with ADS of Middle Georgia, LLC<\/a>.\r\nThe\r\n\r\nthe agenda item<\/a> for the 11 December 2012 Commission meeting at which\r\nthis contract was approved\r\nsays ADS of Central Alabama, Inc.\r\n\r\nThe contract says ADS is “a Florida corporation”,\r\nand we know ADS is owned by\r\n\r\nHighstar Capital of New York City<\/a>.\r\n\r\n<\/a>\r\nOnce again,\r\n\r\nwhy is granting a cheap monopoly to an out-of-state company<\/a>\r\nmore important than either letting local companies compete for the service\r\nor having the county continue to provide a public service directly to\r\nits taxpayers and citizens?\r\n<\/p>\r\n

\r\nThe termination clause\r\n\r\nI pointed out to the Commission<\/a>\r\nafter \r\nan ADS executive made excuses for nonperformance<\/a>\r\nis\r\n\r\nParagraph 18 of the contract<\/a>:\r\n<\/p>\r\n

\r\n\r\n<\/a>\r\n<\/p>\r\n

\r\nThe current Commission does not have to continue to\r\n\r\neat its own<\/a>.\r\nIt can change the path the previous Commission of last year set.\r\nIt can choose not to sue Deep South Sanitation.\r\nIt can choose to modify the contract with ADS.\r\nIt can even terminate the contract with ADS.\r\nIf it wants to.\r\n<\/p>\r\n
