<\/a>\r\n\r\nGEORGIA COMPREHENSIVE SOLID WASTE MANAGEMENT ACT OF 1990\r\nAS AMENDED THROUGH 2004:\r\nAn Abstract from\r\nOFFICIAL CODE OF GEORGIA ANNOTATED\r\nVolume 10\r\nTitle 12\r\nArticle 2\r\nPart 1\r\nConservation and Natural Resources<\/a>:\r\n<\/p>\r\n\r\n\r\n\u00a7 12-8-24.2. Public hearing prior to entering contract regarding landfill\r\n<\/strong>\r\n\r\n\r\nThe governing authority of any county or municipal corporation and\r\nthe directors or managers of any local authority or special district\r\nshall hold a public hearing before entering into a contract for the\r\nsale, lease, or management of a landfill or solid waste disposal\r\nfacility owned by such county, municipal corporation, local\r\nauthority, or special district. The party responsible for holding\r\nsuch a public hearing shall cause notice of the hearing to be posted\r\nat the site of the landfill or facility and to run in a newspaper of\r\ngeneral circulation serving the county, municipal corporation, local\r\nauthority, or special district not less than 30 nor more than 45\r\ndays prior to the date of the hearing.\r\n<\/p>\r\n<\/blockquote>\r\n
\r\nCan anyone argue that\r\n“or solid waste disposal facility owned by such county”\r\ndoes not include Lowndes County’s former solid waste collection centers?\r\n\r\n
<\/a>\r\nWas the Lowndes County Commission’s approval of\r\n\r\nthe solid waste ordinance that abolished the collection centers<\/a>\r\neven legal?\r\nNo public hearings were held before that vote of 11 December 2012.\r\nNor before\r\n\r\ntheir stealth meeting of 4 June 2012<\/a> in which the VDT reported\r\n
\r\n“Commissioners also plan to outsource waste management services to a private contractor in the next year.”\r\n<\/blockquote>\r\nNor before\r\n\r\ntheir retreat of 31 March 2012<\/a> about which the VDT reported\r\n\r\n“Commissioners decided that getting out of the \u201ctrash business\u201d was best”\r\n<\/blockquote>\r\n\r\nIt’s not clear when they really made their decision.\r\nBut no public hearings were held on the subject at any time in 2012.\r\nActually,\r\nno public hearings about waste disposal have been held by Lowndes County\r\nsince 2009, two Chairs back, at a time when no elected Commissioner\r\nor Chair currently serving was then serving.\r\n<\/p>\r\n
\r\nIt appears that the Lowndes County Commission\r\ndecision to close the county’s waste collection centers did\r\nnot follow state law.\r\n<\/p>\r\n
