Quarterman @ LCC 2013-05-14"},"content":{"rendered":"<p>Chairman Bill Slaughter said<br \/>\n&#8220;At this time we can&#8217;t discuss that issue&#8221;<br \/>\nof why the Commission thinks its a good use of taxpayer funds to<br \/>\nsue a local business with a valid business permit,<br \/>\nafter the Commission apparently recently<br \/>\ndidn&#8217;t want to defend against a potential lawsuit against itself.\n<\/p>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=ej8QTXRYHxc&#038;list=PLshUv86fYkiEu6dUa-AGMxN-mx3UYi3Ak&#038;index=14\"><br \/>\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"https:\/\/i2.ytimg.com\/vi\/ej8QTXRYHxc\/default.jpg\"><\/a><br \/>\nIn the<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/videos-paving-and-suing-lcc-2013-05-14.html\"><br \/>\nLowndes County Commission Regular Session Tuesday 13 May 2013<\/a>,<br \/>\nI spoke in Citizens Wishing to Be Heard, noting<br \/>\na trust indenture is a legal contract, and since<br \/>\nas building a well often leads to development, as someone<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/religious-freedom-and-the-neighbors-lcc-2013-05-14.html\">(Commissioner Page a few minutes before)<\/a><br \/>\npointed out, why don&#8217;t trust indenture decisions lead to public hearings?<br \/>\nThis might be a legal question for the state (although I would guess<br \/>\nthe County Commission could hold a public hearing on whatever it likes,<br \/>\neven if the state doesn&#8217;t require it).<\/p>\n<blockquote><p>\nBut a lot of commissions actually let the public speak on any item.<br \/>\nFor example, the Tallahassee Council lets anyone sign up at the beginning<br \/>\nand say I want to speak on X. It&#8217;s a thought.<\/p>\n<p>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/religious-freedom-and-the-neighbors-lcc-2013-05-14.html\"><br \/>\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"http:\/\/farm8.staticflickr.com\/7331\/8758168316_3c5b87cf1a_m.jpg\"><\/a><br \/>\nBut during that particular item I found it particularly refreshing to<br \/>\nhear Commissioner Page say that he was concerned about what the majority<br \/>\nof the neighbors and property owners think about the use or potential use<br \/>\nof the property, and nearby property owners and the majority of people<br \/>\nwho live in that area.<\/p>\n<p>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/02\/videos-commission-voted-against-the-people-lcc-2013-02-26.html\"><br \/>\n<img decoding=\"async\" style=\"float:right;border:none;\" width=\"100\" src=\"http:\/\/www.l-a-k-e.org\/blog\/images\/6a0120a58214e4970b017d414ec705970c-pi.jpg\"><\/a><br \/>\nNow it&#8217;s curious how we did not hear much concern about that<br \/>\non an item a few meetings back about<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/02\/videos-commission-voted-against-the-people-lcc-2013-02-26.html\"><br \/>\nOld State Road<\/a>.<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/02\/really-really-shocking-and-surprising-that-this-road-would-be-closed-as-much-public-purpose-that-it-serves-april-huntley.html\"><br \/>\nThe majority of the people who live in that area<\/a><br \/>\ndid not want that road closed.<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/02\/make-sure-that-the-people-in-my-age-group-know-who-theyre-voting-for-brett-huntley-lcc-2013-02-26.html\"><br \/>\nThe majority of the property owners<\/a>, as near as I can tell from the names<br \/>\non the petition, did not, but no one seemed concerned about that.<br \/>\nIt is a nice concern to have.<\/p>\n<p>\nNow at that time I heard through various people that the main reason,<br \/>\nand correct me if I&#8217;m wrong here,\n<\/p><\/blockquote>\n<p><!--more--><\/p>\n<blockquote><p>\nthe main reason the Commission decided to close that road was that they<br \/>\nwere afraid that the applicant might sue.<br \/>\nNow I cannot believe that any Commissioners personally would be afraid<br \/>\nof that, because you&#8217;re all veterans of elections, so why would you<br \/>\nbe afraid of a simple lawsuit; surely things happen in elections that<br \/>\nare much worse than that.<br \/>\nSo I&#8217;m guessing it must have been because of the expense, of the legal expense<br \/>\nof a lawsuit.<br \/>\nI&#8217;m guessing you wouldn&#8217;t want the taxpayers to have to pay for a thing like that.<br \/>\nEven though I assume you have Directors and Officers insurance, but still.<\/p>\n<p>\nSo that leads to my question, which is:<br \/>\nWhy, if it wasn&#8217;t a good use of taxpayer money to defend a lawsuit<br \/>\nthat was only potential,<br \/>\nthat might not even happen,<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/lowndes-county-v-deep-south-sanitation-why.html\"><br \/>\n<img decoding=\"async\" style=\"float:right;border:none;\" src=\"https:\/\/fbcdn-profile-a.akamaihd.net\/hprofile-ak-ash3\/c24.0.100.100\/p100x100\/158001_383648428367515_533686057_n.jpg\"><\/a><br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/lowndes-county-v-deep-south-sanitation-why.html\"><br \/>\nwhy is it a good use of taxpayer money to initiate<br \/>\na lawsuit against a business in the county that has a valid business permit<\/a>?<br \/>\nLike<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/why-cant-we-choose-our-trash-pickup-service-tom-hallman-lcc-2013-05-14.html\"><br \/>\none of the previous speakers<\/a>, I don&#8217;t really understand that.<br \/>\nAnd I&#8217;m wondering if perhaps the Commissioners<br \/>\nand the Chairman could explain that to the public,<br \/>\nnot just to an individual.<br \/>\nThat&#8217;s my question.\n<\/p><\/blockquote>\n<p>\n<a href=\"http:\/\/www.lowndescounty.com\/content.asp?pid=22&#038;id=118\"><br \/>\n<img decoding=\"async\" style=\"float:right;border:none;\" width=\"100\" src=\"http:\/\/www.l-a-k-e.org\/php\/include\/govt\/chairmanslaughter13.jpg\"><\/a><br \/>\nAnd the Chairman&#8217;s answer:\n<\/p>\n<blockquote><p>\nAt this time we can&#8217;t discuss that issue.\n<\/p><\/blockquote>\n<p>\nSo I thanked them and sat down.<br \/>\nThey proceeded to go into<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/videos-paving-and-suing-lcc-2013-05-14.html#Executive Session\"><br \/>\nExecutive Session for the purpose of attorney-client communication<\/a>.<br \/>\nHm, I wonder what legal case they could be discussing?<br \/>\nThe Chairman didn&#8217;t say why they couldn&#8217;t discuss the trash case at this time,<br \/>\nbut could it be because of the lawsuit?<br \/>\nIf so, they apparently spent much longer in Executive Session discussing it than<br \/>\nit took me and Tom Hallman to ask the questions that never got answered.<br \/>\nWhy does the County Commission think it&#8217;s a good use of taxpayer funds<br \/>\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/lowndes-county-v-deep-south-sanitation-why.html\"><br \/>\nto sue a legitimate local business on behalf of investors in New York City<\/a>,<br \/>\nand why won&#8217;t they explain that to the public?\n<\/p>\n<p>\nHere&#8217;s<br \/>\n<a href=\"https:\/\/www.youtube.com\/watch?v=ej8QTXRYHxc&#038;list=PLshUv86fYkiEu6dUa-AGMxN-mx3UYi3Ak&#038;index=14\"><br \/>\nthe video:<\/a>\n<\/p>\n<p style=\"text-align:center;font-size:80%\">\n<iframe loading=\"lazy\" title=\"YouTube video player\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/ej8QTXRYHxc\" frameborder=\"0\" allowfullscreen><\/iframe><br \/>\n<br \/>\nFiscal responsibility and legal actions &#8211;John S.
