\n\n\"John<\/a>\nA videographer in Valdosta is taking legal action against Georgia\nDistrict 8 State Senator Tim Golden.\n<\/p>\n

\nJohn Quarterman says video he shot was used in an “Attack Ad”\nagainst Senate candidate Bikram Mohanty without his permission.\n<\/p>\n

\n“A video posted on Youtube that clearly says that attribution is\nrequired. And there’s no attribution, no sources sighted, and he\ndidn’t ask permission. That’s mis-use of our material,” Quarterman\nsaid.\n<\/p>\n<\/blockquote>\n\n\n

\n

\n\n\"LAKE<\/a>\nQuarterman is a videographer for the Lowndes Area Knowledge Exchange\nknown as “LAKE”. He is also a Committee Member for the Lowndes\nDemocratic Party.\n<\/p>\n

\nQuarterman learned of the advertisement using his video this week.\nHe immediately took it to his lawyer who is serving Senator Golden’s\ncampaign a cease and desist letter.\n<\/p>\n<\/blockquote>\n

\nThat license (in the Description under the video) links to this\ndefinition:\n<\/p>\n

\nCreative Commons licenses provide a standard way for content\ncreators to grant someone else permission to use their work. YouTube\nallows users to mark their videos with a Creative Commons CC BY\nlicense [attribution\u2014reuse allowed]. These videos are then\naccessible to YouTube users for use in their own videos via the\nYouTube Video Editor. Attribution is automatic under the CC BY\nlicense, meaning that any video you create using Creative Commons\ncontent will automatically show the source videos’ titles underneath\nthe video player. You retain your copyright and other users get to\nreuse your work subject to the terms of the license.\n<\/p>\n<\/blockquote>\n

\nIt clearly says attribution is required, and Golden’s campaign\ndid not include any attribution.\n<\/p>\n

\n“He’s only doing this for political means,” said Howard Mead,\ncampaign spokesman. “When he uploaded his video onto Youtube he\nagreed to a Youtube license that specifically grants anyone on\nYoutube the right to re-use and edit the video.”\n<\/p>\n<\/blockquote>\n

\nThat’s not what the license notice right under the video says,\nand that’s not what YouTube’s definition of that license says.\nThat YouTube definition also includes a further link to\n\n\"Creative<\/a>\n\nthis Creative Commons\nlicense definition:<\/a>\n<\/p>\n

\nThe CC license continues saying the copyright holder (that’s LAKE)\ncould give permission to waive the license:\nGolden’s campaign never asked for permission.\n<\/p>\n

\nAfter the telephone recording of Golden’s campaign admitting they\nlifted the LAKE video and claiming an erroneous reading of the license,\nthe WCTV video cuts to Golden’s attack ad here:\n<\/p>\n

\nApparently so.\nInteresting behavior for an incumbent state Senator who is supposed\nto be representing his constituents.\n<\/p>\n
