{"id":3436,"date":"2013-05-15T09:35:54","date_gmt":"2013-05-15T13:35:54","guid":{"rendered":"http:\/\/www.l-a-k-e.org\/blog\/?p=3436"},"modified":"2013-05-29T16:17:32","modified_gmt":"2013-05-29T20:17:32","slug":"trash-lawsuit-on-walb-2","status":"publish","type":"post","link":"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/trash-lawsuit-on-walb-2.html","title":{"rendered":"Trash lawsuit on WALB"},"content":{"rendered":"<p>\r\n<a href=\"http:\/\/www.walb.com\/story\/22250408\/lowndes-county-files-lawsuit-against-sanitiona-company\">\r\n<img decoding=\"async\" width=\"200\" style=\"float:right;border:none;\" src=\"http:\/\/walb.images.worldnow.com\/images\/22250408_BG4.jpg\"><\/a>\r\nWALB found the Lowndes County government sticking to the letter of its own recently-passed\r\nordinance and contract, and Deep South Sanitation\r\nconcerned about the county trying to put it out of business.\r\n<\/p>\r\n<p>\r\nLydia Jennings wrote for WALB yesterday,\r\n<a href=\"http:\/\/www.walb.com\/story\/22250408\/lowndes-county-files-lawsuit-against-sanitiona-company\">\r\nLowndes Co. files lawsuit against solid waste company<\/a>,\r\n<\/p>\r\n<blockquote>\r\n<p>\r\nLowndes County leaders are going to court to try to stop a\r\nsanitation company from picking up trash for some county residents.\r\n<\/p>\r\n<p>\r\nCounty leaders say Deep South Sanitation is in violation of a new\r\nordinance that only allows Advanced Disposal to contract with county\r\nresidents.\r\n<\/p>\r\n<p>\r\nAnd if the cease-and-desist order is successful, the owner of Deep\r\nSouth Sanitation worries he&#8217;ll go out of business.\r\n<\/p>\r\n<p>\r\nCary Scarborough owns Deep South Sanitation, a family owned and\r\noperated business he started in 2011 when he saw trash pickup\r\nproblems in unincorporated Lowndes County.\r\n<\/p>\r\n<p>\r\nIn two years, he has seen his business grow with 800 Lowndes County\r\nresident contracts. But his days of picking up trash could be coming\r\nto an end.\r\n<\/p>\r\n<p>\r\n&#8220;It could shut me down,&#8221; said Scarborough.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nSo why did the county give him a business license?\r\nAnd why is it a good use of taxpayer funds to sue him?\r\nThe county&#8217;s answer:\r\n<\/p><!--more-->\r\n<blockquote>\r\n<p>\r\n&#8220;Based on the limits on the ordinance and the contract that the\r\ncounty currently has with Advanced Disposal, it only allows for one\r\ncompany to pick up residential waste in Lowndes County,&#8221; said\r\nLowndes County Clerk, Paige Dukes.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nWhich\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2012\/12\/videos-lcc-2012-12-11.html#Waste\">\r\nordinance<\/a> and\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2012\/12\/videos-lcc-2012-12-11.html#ADS\">\r\ncontract<\/a> the county passed\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2012\/10\/waste-disposal-railroad-by-county-commission-lcc-2012-10-08.html\">\r\nagainst the wishes of the people<\/a>\r\nthey affect\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/05\/lowndes-county-v-deep-south-sanitation-why.html\">\r\nin the unincorporated parts of the county<\/a>.\r\nThe county wouldn&#8217;t even consider a tax district to support\r\nthe county&#8217;s own waste collection sites, but now it&#8217;s using\r\nour tax dollars to enforce a monopoly we didn&#8217;t want,\r\nenforcing it on behalf of investors in New York City.\r\n<\/p>\r\n<blockquote>\r\n<p>\r\nBefore the ordinance was passed several solid waste companies were\r\nable to bid on the contract. Advanced Disposal was chosen on its\r\nproposal to charge county residents about $13 a month for pick-up\r\nservices. Scarborough says his company isn&#8217;t big enough to take on a\r\ncounty-wide contract. &#8220;There&#8217;s no way I could have bid against\r\nthat.&#8221;\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nAnd there&#8217;s no way ADS&#8217;s rates are going to stay that low, either.\r\nWatch and see how fast they go up, especially if DSS is put out of business.\r\n<\/p>\r\n<blockquote>\r\n<p>\r\nThe suit will be heard in court June 4th. \r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\n<a href=\"http:\/\/www.lowndescounty.com\/content.asp?pid=24&#038;id=123\">\r\nLowndes County Superior Court<\/a>\r\ndoesn&#8217;t seem to have\r\n<a href=\"http:\/\/www.lowndescounty.com\/content.asp?pid=24&#038;id=169\">\r\nanything online<\/a>\r\nabout this case, but WALB found the hearing notice,\r\nwhich says it&#8217;s Civil Action File No. 2013-CV-862.\r\nMaybe the judge will throw out not just this lawsuit,\r\nbut also the monopoly contract the county signed.\r\n<\/p>\r\n<p>\r\n -jsq\r\n<\/p>","protected":false},"excerpt":{"rendered":"WALB found the Lowndes County government sticking to the letter of its own recently-passed ordinance and contract, and Deep South Sanitation concerned about the county trying to put it out of business.
