\r\nWhy is Lowndes County suing a local business\r\nfor the benefit of investors in New York City?\r\nI guess we’ve discovered the litigation \r\nlast month’s Lowndes County Commission executive session was about<\/a>.\r\nWhy is this a good use of taxpayer money?\r\n<\/p>\r\n

\r\n\r\n<\/a>\r\nOn Deep South Sanitation’s facebook page\r\n\r\nyesterday<\/a>,\r\n<\/p>\r\n

\r\nFriends, we all watch the news and we see governments making changes\r\nthat are unacceptable to the American people. Well, it is happening\r\nright here in our hometown. LOWNDES COUNTY has issued a CIVIL ACTION\r\nLAWSUIT against DEEP SOUTH. The preliminary hearing is set for\r\nFRIDAY, JUNE 14, 2013 at 9:30AM in Courtroom 5D of the Lowndes\r\nCounty Judicial Complex. The purpose of the hearing is to force DEEP\r\nSOUTH to shutdown on that day! (We are a small, local, family owned\r\nand operated business.) We need your support because this hearing\r\nwill effect almost every one of you. “IF” we are forced out,\r\nAdvanced Disposal will be your “ONLY CHOICE” for garbage service.\r\nThat means there will be a MONOPOLY for garbage service in Lowndes.\r\nThe County maintains that it is not MANDATORY for the citizens to\r\nuse Advanced Disposal so then who else can we choose? CHOICE keeps\r\nbusiness healthy and HONEST. Please help support this matter for\r\nyour sake and ours by calling LOWNDES COUNTY and voice your\r\nconcerns. \r\n\r\n<\/a>\r\nUnnamed Lowndes County “representatives”\r\n\r\nspelled out in the VDT back in January<\/a>\r\nthat\r\n<\/p>\r\n

\r\n“According to the solid waste ordinance, Advanced Disposal will\r\nbe the only residential hauler licensed to serve unincorporated Lowndes\r\nCounty.”\r\n<\/blockquote>\r\n

\r\nA few hours later yesterday, also on\r\n\r\nDSS’s facebook page<\/a>,\r\n<\/p>\r\n

\r\nRegarding the Lawsuit against Deep South Sanitation by Lowndes\r\nCounty: The County’s grounds for the lawsuit is based on the\r\nagreement they made with Advanced Disposal to be the sole provider\r\nof residential garbage disposal service in Lowndes County. In a\r\n“normal” exclusive contract for garbage service, the City \/ County\r\nwill collect the funds from the citizens via property tax and then\r\nin turn, issue payment to the service provider. This is not the case\r\nhere in Lowndes. Even if it were so, the citizens always have a\r\nchoice. The whole purpose of the lawsuit is to force Deep South out\r\nof business so that Advanced Disposal has sole ownership of all\r\ngarbage services in the unincorporated areas of Lowndes County which\r\nis basically all of Lowndes County. \r\n\r\n<\/a>\r\nThe same Commission that\r\n\r\nwas not willing to exercise the termination clause in the ADS contract<\/a>\r\nafter\r\n\r\nlack of performance that caused Dave Shepler, regional manager of Advanced Disposal, to reschedule from Biloxi to come apologize<\/a>;\r\nthat same Lowndes County Commission finds time and money to sue\r\na local business that is doing its job.\r\nDoes that seem right to you?\r\n<\/p>\r\n

\r\n\r\n<\/a>\r\nThe same Lowndes County Commission that \r\n\r\ncan’t even produce a list<\/a> of the 5,000 people to whom it sold\r\nsolid waste collection center cards.\r\nThe same Lowndes County Commission that sent\r\n\r\nan unsigned letter<\/a> to those 5,000 residents\r\nsaying sign up with ADS or else.\r\n(The “or else” turned out to be\r\n\r\nor the county will fine anybody who leaves trash by the road<\/a>;\r\nhow many such cases “are prosecuted successfully”?)\r\nIt’s curious the county knew who to send those letters to,\r\nyet can’t produce a list of who they sent them to.\r\nThe same Lowndes County Commission that\r\n\r\nignored public objections over years<\/a>\r\nand\r\n\r\nclosed those solid waste sites<\/a>\r\nand\r\n\r\ngranted a monopoly to ADS<\/a>.\r\n<\/p>\r\n

\r\n\r\n<\/a>\r\nThe same Lowndes County Commission that\r\n\r\nclosed the only access to the Alapaha River in Lowndes County<\/a>\r\nagainst the wishes of hundreds of petitioners\r\nbecause the one applicant might sue; that Commission\r\nnow finds funds to start its own lawsuit against a local business.\r\n<\/P>\r\n

\r\nWhy does this County Commission care more about investors in New York City\r\nthan it does about you the taxpayers or a local business?\r\n<\/p>\r\n
