REZ-2012-16 Cook County Land Ventures<\/a>\n<br>\nSW corner of Georgia Highway 122 East and Cat Creek Road, Hahira\n<br>\nRequest to rezone ~2 acres from E-A (Estate Agriculture) to C-C (Crossroads Commercial)\n<\/blockquote>\n<p>\nCounty Planner Jason Davenport said the\nowner wants commercial zoning for a store, since previous\nconditional use had expired, and\nthere was concern about prohibiting alcohol,\nespecially if\n\n<!--more-->\na store was opened at the end of the\nproperty next to the next-door church.\n<\/p>\n<p>\n<a href=\"http:\/\/www.youtube.com\/watch?v=N-gHJCwGP74&#038;\">\n<img decoding=\"async\" style=\"float:right;border:none;\"   src=\"http:\/\/i3.ytimg.com\/vi\/N-gHJCwGP74\/default.jpg\"><\/a>\nThe owner, Dr. Russell Acree of Adel,\n<a href=\"http:\/\/www.youtube.com\/watch?v=N-gHJCwGP74&#038;\">\nspoke for.<\/a>\nSomeone from Hahira (Joe Davis?) <a href=\"http:\/\/www.youtube.com\/watch?v=hBSqmfnmngU\">also spoke for.<\/a>\n<\/p>\n<p>\nDavid Fields, who owns property across Cat Creek Road and just south of\nthe subject property,\n<a href=\"http:\/\/www.youtube.com\/watch?v=DWGUMBPjWAo\">\nspoke against,<\/a>\n<\/p><a href=\"http:\/\/www.youtube.com\/watch?v=DWGUMBPjWAo\">\n<img decoding=\"async\" style=\"float:right;border:none;\"   src=\"http:\/\/i1.ytimg.com\/vi\/DWGUMBPjWAo\/default.jpg\"><\/a>\n<blockquote>\nAll you have to do is have one change of ownership&#8230;.\n<\/blockquote>\n<p>\nnoting as reasons for requiring no alcohol: the church,\nchildren catching the school bus,\nthe trailer park,\nand an Alcoholics Anonymous group\nthat meets in his old house directly across the road.\nHe said the one time alcohol was allowed, in 1986,\na 38-year-old man was murdered and alcohol was involved.\n<\/p>\n<p>\nIn discussion,\n<a href=\"http:\/\/www.youtube.com\/watch?v=wFUEmIVNIN8\">\nCounty Planner Jason Davenport said<\/a>\nthe church to alcohol sales distance limit was door-to-door either 100 or 300 feet,\nwhich would limit the southwest building, but not the previous store building.\nHe said he didn&#8217;t know whether the Commission could prohibit alcohol sales\nin the store and he would like to ask the County Attorney.\nIn discussion of package store, convenience store, restaurant, he said:\n<blockquote>\nI don&#8217;t think you want to limit the applicant&#8230;.\nI think if you want to move on this tonight,\nI don&#8217;t know of a way to split a convenience store and a restaurant\nwithout directly going after the alcohol,\ntrying to get the applicant the fair use of it,\nbut still restrict that aspect.\nSo I think that if you do want to go that direction\nit might just be that you place that condition\nand let the county manager use the county attorney to test that\nbefore it gets to the county commission.\n<\/blockquote>\n<p>\nDavenport also clarified that limiting a package store use was standard practice,\nbut he didn&#8217;t have any confidence in limiting\nalcohol at a convenience store or restaurant and would have to check.\n<\/p>\n<p>\nThey\n<a href=\"http:\/\/www.youtube.com\/watch?v=hITzpupfIpI\">\nvoted to recommend prohibiting alcohol sales with a request to the county attorny for clarification.<\/a>\n<\/p>\n<p>\nNobody mentioned that\nDr. Acree could have been gotten the use he wanted as a variance from ZBOA.\nGretchen confirmed afterwards that the county staff had not told him that.\nSuch a variance would not have led to the problem of what happens after\nhe some time in the future sells the property.\n<\/p>\n<p>\n<a href=\"\/blog\/2012\/11\/video-playlist-lcc-2012-11-12.html#REZ-2012-16\">\n<img decoding=\"async\" style=\"float:right;border:none;\"   src=\"http:\/\/i3.ytimg.com\/vi\/26ADcFoQP3g\/default.jpg\"><\/a>\nAt the\n<a href=\"\/blog\/2012\/11\/video-playlist-lcc-2012-11-12.html#REZ-2012-16\">\nCounty Commission&#8217;s 12 November Work Session<\/a>\nthe discussion was mainly about the alcohol prohibition.\nThe distance from the church was still vague.\n<\/p>\n<p>\nAt the\n<a href=\"\/blog\/2012\/11\/video-playlist-lcc-2012-11-13.html#REZ-2012-16\">\nCounty Commission&#8217;s 13 November Regular Session<\/a><a href=\"\/blog\/2012\/11\/video-playlist-lcc-2012-11-13.html#REZ-2012-16\">\n<img decoding=\"async\" style=\"float:right;border:none;\"   src=\"http:\/\/i3.ytimg.com\/vi\/vQZ3qIJilOc\/default.jpg\"><\/a>\nthey approved the rezoning with a condition eliminating any package store use.\nThat doesn&#8217;t address the convenience store or restaurant uses.\nAnd still nobody mentioned ZBOA could have granted a variance\nwithout leaving open the future potential\nproblems for the rest of us neighbors.\n<\/p>\n<p>\n-jsq\n<\/p>\n","protected":false},"excerpt":{"rendered":"The old store at the corner of GA 122 and Cat Creek Road was the subject of debate over alcohol at the Planning Commission&#8217;s 29 October 2012 Regular Session.
