Miller &amp; Foreman) (4-3). Motion carried.&rdquo;\r\n<p>\r\nAlso according to those draft minutes:\r\n<ul>\r\n<li>\r\n&ldquo;Commissioner Graham asked if tractor trailers are a concern. Mr.\r\nDillard explained that Condition\r\n#2 addresses that with regard to any change of use and requirements.&rdquo;\r\n<li>\r\n&ldquo;Vice-Chairman Miller asked if\r\nstudies have been done to assess the impacts on groundwater with\r\nsimilar developments. Mr. Langdale explained that new models address\r\nthat with cooling\/recycling water systems.&rdquo;\r\n<li>\r\n&ldquo;Commissioner Foreman asked to verify\r\nthat the development is currently\r\nspeculative. Seemann, 4634 Briarberry Drive,\r\nat\r\n<a href=\"https:\/\/youtu.be\/wKqGfhgnX1A?si=czGSUR24OkMkhNGk&#038;t=911\">\r\n15 minutes and 10 seconds<\/a>.\r\nThat&#8217;s on the west side of Foxbury, about 674 feet from the north\r\nborder of the east tract of the subject property.\r\nShe is worried about drop in home values due to noise from industrial activities.\r\nShe thinks the proposed 200-foot buffer zone is less than a football field,\r\nand is not enough.\r\n<p>\r\nAlso, red cockaged wood peckers and gopher tortoises are prevalent\r\non the subject property, as she observed during a project at VSU.\r\nLess trees means more erosion.\r\n<p>\r\nShe said noise was already a problem because Mr. Motley (who is the\r\n<a href=\"https:\/\/ecorp.sos.ga.gov\/BusinessSearch\/BusinessInformation?businessId=1186599&#038;businessType=Domestic%20Limited%20Liability%20Company&#038;fromSearch=True\">\r\nRegistered Agent for DJ Land &#038; Development LLC<\/a>,\r\nhad recently clearcut the land directly to her west.\r\nShe did not note, but I will, that that would make it easier for any\r\nfuture decision to provide access through that tract to the rezoning subject east tract.\r\n<p>\r\nDr. Seemann would like more protection for all of that than the intent of the current landowner.\r\n<p style=\"text-align:center;font-size:80%;font-style:italic\">\r\n<a title=\"Against: Gretchen Quarterman, 6565 Quarterman Road, 2025-06-30 REZ-2025-11 @ GLPC, LAKE video\" name=\"Stills:Against-Gretchen-Quarterman-6565-Quarterman-Road-20250630-REZ202511-GLPC-LAKE-video\" href=\"http:\/\/www.l-a-k-e.org\/govt\/glpc\/2025-06-30--glpc-potential-datacenter-site-rezoning\/gretchen.html\">\r\n<img decoding=\"async\"  width=\"600\"  border=\"0\" src=\"http:\/\/www.l-a-k-e.org\/govt\/glpc\/2025-06-30--glpc-potential-datacenter-site-rezoning\/gretchen.jpg\"  alt=\"[Against: Gretchen Quarterman, 6565 Quarterman Road, 2025-06-30 REZ-2025-11 @ GLPC, LAKE video]\"><\/a>\r\n<br><a href=\"http:\/\/www.l-a-k-e.org\/govt\/glpc\/2025-06-30--glpc-potential-datacenter-site-rezoning\/gretchen.html\">Against: Gretchen Quarterman, 6565 Quarterman Road, 2025-06-30 REZ-2025-11 @ GLPC, LAKE video<\/a>\r\n<\/p>\r\n<p>\r\nAlso speaking against was Gretchen Quarterman, 6565 Quarterman Road, at\r\n<a href=\"https:\/\/youtu.be\/wKqGfhgnX1A?si=Hh8VxeSNgQc22mfF&#038;t=1185\">\r\n19 minutes and 45 seconds<\/a>.\r\nShe said she wasn&#8217;t necessarily speaking against.\r\nBut the subject property is directly across the Withlacoochee River from\r\nLangdale Park, which is chronically flooded.\r\nShe wants to make sure the river is corrected.\r\nShe noted that while crossing the railroad could be very difficult,\r\nthat doesn&#8217;t mean it is impossible.\r\n<p style=\"text-align:center;font-size:80%;font-style:italic\">\r\n<a title=\"Against: Jeana Strickland, ???? undisturbed buffer shall be required along the Northern,\r\nand Southern property lines abutting current Residential Zoning\r\nDistrict boundaries.\r\n<li> Any lighting located on the property shall be shielded and\r\ndirected to avoid direct illumination of adjacent properties zoned\r\nResidentially.\r\n<li> Any loudspeakers, paging systems, or electromagnetic\r\ninterference generated on or by uses of the property shall be\r\ndesigned, installed and used such that they are not discernable at\r\nany abutting property line zoned Residentially.\r\n<li> Correctional Facilities, Transitional Care Facilities, and\r\nKennels with Outdoor Runs shall not be allowed.\r\n<\/ol>\r\n<H4><a name=\"thevideos\">LAKE videos<\/a><\/H4>\r\n<p>\r\nHere is the LAKE video of that item, with a few notes by Gretchen Quarterman.\r\n<p style=\"font-style:normal\">\r\n4. The general motivation in this case is for the subject\r\nproperty to be developed into a large warehouse type campus.\r\n<\/p>\r\n<p>\r\nProposed access for the subject property is along Coleman Road, a\r\npaved County Collector Road. The property is also split by the\r\nNorfolk Southern Railroad. The Comprehensive Plan Future Development\r\nMap depicts the subject property within the Urban Service Area, with\r\nTract 1 depicted as an Industrial Activity Center Character Area,\r\nand Tract 2 mixed between Community Activity Center, Recreation and\r\nConservation, Suburban, and Transportation and Utilities Character\r\nAreas.\r\n<\/p>\r\n<p>\r\nThe TRC analyzed the request, the standards governing the exercise\r\nof zoning power set forth in 10.01.05 of the ULDC, and factors most\r\nrelevant to this application, including the neighboring land uses,\r\nthe environmentally sensitive wetlands and flood plains, the\r\navailability of County Utilities, the potential scale of the\r\nproposed development, the review process for a Development of\r\nRegional Impact (DRI1), and support of a growing and balanced\r\neconomy.\r\n<\/p>\r\n<p>\r\nTherefore, the TRC recommends Approval of the request with the\r\nfollowing seven (7) conditions:\r\n<\/p>\r\n<ol>\r\n<li> There shall be no access to Briarberry Drive and Quail Hollow\r\nCircle from the subject property.\r\n<li> Should a change in use occur where additional transportation\r\nand\/or water\/sewer infrastructure upgrades are required, the\r\nDeveloper will be responsible for the design, any acquisition of\r\nnecessary right-of-way, relocation of utilities, and construction\r\ncosts for the infrastructure improvements.\r\n<li> All lots shall front interior roads.\r\n<li> A 200&#8242; undisturbed buffer shall be required along the Northern,\r\nand Southern property lines abutting current Residential Zoning\r\nDistrict boundaries.\r\n<li> Any lighting located on the property shall be shielded and\r\ndirected to avoid direct illumination of adjacent properties zoned\r\nResidentially.\r\n<li> Any loudspeakers, paging systems, or electromagnetic\r\ninterference generated on or by uses of the property shall be\r\ndesigned, installed and used such that they are not discernable at\r\nany abutting property line zoned Residentially.\r\n<li> Correctional Facilities, Transitional Care Facilities, and\r\nKennels with Outdoor Runs shall not be allowed.\r\n<\/ol>\r\n<p>\r\nCommissioner Bailey confirmed that the conditions stated are the\r\nactual proposed conditions. Mr. Dillard confirmed. Further\r\ndiscussion focused on allowable uses in M-1 zoning and that they are\r\nvery similar with a few exceptions to those uses allowed in C-H\r\n(Highway Commercial) zoning.\r\n<\/p>\r\n<p>\r\nThere being no questions for staff, Chairman Miller opened the\r\nPublic Hearing portion of the case.\r\n<\/p>\r\n<p>\r\nSpeaking in favor of the request:\r\n<ul>\r\n<li>Pope Langdale, Applicant \u2013 400 Mack Drive\r\n<\/ul>\r\n<p>\r\nMr. Langdale stressed that the intent is to not affect any\r\nresidential neighbor. Buildings will be low enough to not be seen\r\nfrom homes and that there will be significant buffering in place.\r\n<\/p>\r\n<p>\r\nCommissioner Rountree reiterated the 200&#8242; tree buffer as proposed in\r\nCondition #4. Mr. Langdale stated that there will probably be even\r\nmore due to Wetlands and the Conservation District. Commissioner\r\nHightower asked if there is intent to clear-cut the subject\r\nproperty. Mr. Langdale stated there is not. Commissioner Willis\r\nasked if there is any sort of firm plan right now or if everything\r\nis speculative. Mr. Langdale responded that it is mostly speculative\r\nbut there is some interest in a data center. However, there are\r\nconsiderable hurdles that must be addressed first. Mr. Langdale also\r\nstated the train tracks cause an access issue, making it difficult\r\nto even use the east tract.\r\nCommissioner Foreman asked to verify\r\nthat the development is currently\r\nspeculative. Mr. Langdale confirmed. \r\nVice-Chairman Miller asked if\r\nstudies have been done to assess the impacts on groundwater with\r\nsimilar developments. Mr. Langdale explained that new models address\r\nthat with cooling\/recycling water systems.\r\n Commissioner Willis asked\r\nabout water sewer provisions. County Water &amp; Sewer are\r\navailable.\r\n<\/p>\r\n<p>\r\nSpeaking in opposition to the request:\r\n<ul>\r\n<li> LaRae Seeman &mdash; 4634 Briarberry Dr.\r\n<li> Gretchen Quarterman &mdash; 6565 Quarterman Rd.\r\n<li> Jeana Strickland &mdash; 4634 Briarberry Dr.\r\n<li> Windy Scott &mdash; 4629 Briarberry Dr.\r\n<li> Don Dreibelbis &mdash; 4629 Rustic Ridge Rd.\r\n<\/ul>\r\n<p>\r\nMs. Seeman stated she feels threatened by the intent. Concerned\r\nabout home values, environmental impact, health issues, safety\r\nissues, and sound barrier. Stated there is a need for durable\r\nprotection.\r\n<\/p>\r\n<p>\r\nMs. Quarterman stated her concern is about the water flow into the\r\nriver and the flood zone as the property is directly across from\r\nLangdale Park.\r\n<\/p>\r\n<p>\r\nMs. Strickland inquired about whether the zoning classification\r\nstays with the property is it is sold. Also concerned about the\r\nflood zone and run-off.\r\n<\/p>\r\n<p>\r\nMs. Scott&#8217;s concerns involved traffic flow. She asked how that and\r\nflooding issues will be addressed.\r\n<\/p>\r\n<p>\r\nMr. Dreibelbis stated he works for a trucking company and is\r\nconcerned about noise, hazardous materials and crime from the\r\ninterstate, and asked that the eastern portion not be rezoned.\r\n<\/p>\r\n<p>\r\nCommissioner Willis asked if the flood plain has been delineated\r\nyet, if run-off has been looked at yet, and if there has been a\r\ntraffic study conducted. Additionally, he verified that burning\r\ntrees is allowable even now. Mr. Dillard confirmed that burning is\r\npermissible as currently zoned and the flood plain has not yet been\r\ndelineated, Engineering will evaluate the potential run-off, and an\r\noverall traffic study was conducted in the area when the Camelot\r\nCrossing development was proposed. Commissioner Hightower asked\r\nabout an environmental study. Mr. Dillard stated that there will be\r\none done for the entire property. Mr. Bailey asked if the scale\r\nshown in the presentation was actual or hypothetical. Mr. Dillard\r\nexplained it was purely hypothetical.\r\n<\/p>\r\n<p>\r\nCommissioner Graham asked if tractor trailers are a concern. Mr.\r\nDillard explained that Condition\r\n#2 addresses that with regard to any change of use and requirements.\r\nChairman Miller asked about potential chemical. Mr. Dillard\r\nexplained that M-1 zoning is the least intrusive manufacturing\r\nzoning category that restricts that sort of thing. Commissioner\r\nWillis asked for clarification about zoning categories if the\r\nproperty sells. Mr. Dillard explained that zoning classifications\r\nand any conditions imposed run with the property, even if sold.\r\n<\/p>\r\n<p>\r\nThere being no further discussion, Chairman Miller called for a\r\nmotion. Motion by Commissioner Bailey to recommend approval of the\r\nrequest as presented with the seven (7) conditions as recommended by\r\nstaff. Commissioner Hightower second. Four (4) voted in favor, three\r\n(3) opposed (Graham, J. Miller &amp; Foreman) (4-3).
