\r\nApparently somebody sued and the county is going to tidy up by\r\ninvalidating its previous decision on the Howell Road Halfway House rezoning and\r\nhold yet another Public Hearing before making what will likely be the same decision.\r\nThat will be this Monday, June 12, 2023, at 5:30 PM.\r\n

\r\nHow five days’ notice solves the legal problem of lack of previous notice,\r\nI don’t know.\r\nAlso why they could not wait one day and hold this Public Hearing in their\r\nregularly-scheduled Regular Session of this Tuesday is mysterious.\r\nPerhaps the County Attorney will explain it all.\r\n

\r\nMeanwhile, the county’s apparent lack of concern for the Character Areas of the Comprehensive Plan does not bode well for other rezonings elsewhere.\r\n

\r\nCOUNTY ACTION REQUESTED ON: REZ-2022-10 The Campus Transitional\r\nFacility — Validity of April 11, 2023, Decision\r\n<\/p>\r\n

\r\nHISTORY, FACTS AND ISSUES: On March 28, 2023, the Board began and\r\nvoted to table the public hearing ona request to rezone property\r\nlocated at 2193 Howell Road from Estate Agricultural (E-A) to\r\nPlanned Development (P-D) for uses including a Transitional Care\r\nFacility until the April 11, 2023, Board meeting, at which the Board\r\ncontinued the public hearing on the request and voted to rezone the\r\nproperty to Planned Development (P-D).\r\n<\/p>\r\n

\r\nThe County has received a challenge to the validity of the April 11,\r\n2023, decision based on the notice to the public.\r\n<\/p>\r\n

\r\nDeclaring the April 11, 2023, zoning decision invalid and\r\nreconsidering rezoning the property will make this challenge moot.\r\n<\/p>\r\n

\r\nOPTIONS: 1. Declare the April 11, 2023, zoning decision invalid.\r\n
\r\n2. Redirect\r\n

\r\nRECOMMENDED ACTION: Board’s Pleasure\r\n

\r\nThis case could be an indication of how little Lowndes County Staff and Commissioners\r\ncare about Character Areas;\r\nsee\r\nRezoning Case REZ-2022-10 The Campus Transitional Facility, 2193 Howell Road.pdf<\/a>:\r\n

\r\n

\r\nOverall, staff found the request inconsistent with the Character\r\nArea, but consistent with the goals and policies of the\r\nComprehensive Plan.\r\n<\/blockquote>\r\n

\r\nI would have thought the Character Areas were geographic details of the\r\ngoals and policies of the Comprehensive Plan.\r\n

\r\nInstead Staff wrote:\r\n

\r\n

The largest concerns for the TRC were ensuring\r\nthat the proposed use was able to be developed on the subject\r\nproperty and that its impacts to the surrounding area were\r\nmanageable. At this point, it is the hope of staff that the benefit\r\nthe proposed use brings to the community and the proposed site plan\r\nwith its buffering and setbacks will mitigate any potentially\r\nnegative effects on surrounding properties.\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nRegarding the alleged benefits, there is still the question of\r\nwhether the facility will have qualified medical staff, which the county rezoning agenda sheet says it will not:\r\n

\r\n

\r\nThis potential facility is not currently licensed for substance\r\nabuse recovery assistance. Beyond a support group or outside visit\r\nfrom a licensed counselor, clients with substance abuse needs will\r\nbe referred to other facilities, organizations, or counselors\r\nlicensed for such care.\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nSo this facility appears to be basically a church group,\r\nwith no more competence in dealing with “clients with substance abuse needs”\r\nthan any other church group.\r\n

\r\nThere are many objections from people nearby,\r\nwhich I would think would be one reason Character Areas were established.\r\n

\r\nBefore the Lowndes County Commission, the Planning Commission had a different opinion:\r\n

\r\n

\r\nThe Planning Commission heard the request and the concerns of the\r\nneighbors, and recommended denial by a vote of (8-2).\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nSo this decision does not bode well for rezonings elsewhere in the county.\r\n
