\r\nBack in May 23, 2022, the Greater Lowndes Planning \r\nrecommended denial by 7:2<\/a>.\r\nNonetheless,\r\nthe Lowndes County Commission \r\napproved this rezoning on 2022-06-16<\/a> with\r\nthe Chairman breaking\r\na tie<\/a>.\r\n

\r\nAfter an attorney for opponents dug in,\r\n\r\nthat vote was determined invalid<\/a>, because the county had not advertised the Public Hearing according to \r\n\r\nstate law specific to Transitional Care Facilities<\/a>.\r\nThe first of two new Public Hearings was held\r\n\r\n2022-09-13<\/a>.\r\n

\r\nThe Board of Commissioners of Lowndes County will hold a public\r\nhearing pursuant to OCGA § 36-66-4(A) at 5:30 p.m., Tuesday,\r\nMarch 28, 2023, in the Lowndes County Judicial and Administrative\r\nComplex, Commission Chambers, 2nd Floor, 327 North Ashley Street,\r\nValdosta, Georgia, in Case Number REZ-2022-10 regarding all or part\r\nof Tax Map 0186 Parcel 107 and Tax Map 0187 Parcel 082 on the\r\napplication by Redeemed Living, c\/o Charles B. Moore, Jr., on behalf\r\nof Parkerson Properties, LLC\/Thomas A. Parkerson, to amend the\r\nZoning Map of Lowndes County, Georgia, to rezone 23 acres located at\r\n2193 Howell Road, Valdosta, Georgia, from E-A (Estate Agriculture)\r\nzoning district to PD (Planned Development) zoning district for uses\r\nto include a Transitional Care Facility. The Lowndes County Unified\r\nLand Development Code defines Transitional Care Facility to mean “A\r\nbuilding or buildings in which is provided long-term but not\r\npermanent living accommodations for one or more persons who are in\r\nneed of short term or long-term housing assistance, and in which may\r\nalso be provided meals and social services including physical\r\ntherapy, social therapy, emotional therapy, counseling,\r\nrehabilitation, or substance abuse recovery assistance.” The legal\r\ndictionary definition of halfway house is “A transitional housing\r\nfacility designed to rehabilitate people who have recently left a\r\nprison or medical-care facility, or who otherwise need help in\r\nadjusting to unsupervised living.”\r\n\r\nThe proposed zoning decision\r\nrelates to or will allow the location or relocation of a halfway\r\nhouse, drug rehabilitation center, or other facility for the\r\ntreatment of drug dependency.\r\n<\/strong>\r\n<\/p>\r\n

\r\nAny comments may be presented at the public hearings, or filed in\r\nwriting prior to the public hearings. Also, review of the above\r\napplications is available in the Office of the County Planner\r\nlocated at 327 North Ashley Street.\r\n<\/p>\r\n

\r\nPursuant to O.C.G.A. 36-67A-3, any opponent of this proposed\r\nrezoning who has made campaign contributions aggregating $250.00 or\r\nmore to a local government official of Lowndes County Board of\r\nCommissioners, within two years immediately preceding the filing of\r\nthe application, is required to file a disclosure statement, at\r\nleast five days prior to the hearing, with the Zoning Administrator\r\nor County Planner, stating the name and position of the local\r\nofficial to whom contributions were made, the amount, description\r\nand date of each campaign contribution.\r\n<\/p>\r\n
