Dillard, presented the item. Mr.\r\nDillard stated this request represents a change in zoning from\r\nMedium Density Residential (R-21) to Highway Commercial (C-H)\r\nzoning. Mr. Dillard further stated the applicant would like to\r\nobtain single commercial zoning on the subject property for\r\nspeculative commercial marketing. Further, Mr. Dillard stated the\r\nPlanning Commission recommended approval and the TRC finds this\r\nrequest inconsistent with existing land use patterns, but had no\r\nadditional objectionable comments.\r\n<p>\r\nMrs. Tina Stewart, 2621 US Hwy 84\r\nWest, spoke against the request. Mrs. Stewart stated she&#8217;s been a\r\nresident for over thirty years and in her opinion rezoning this\r\nproperty will lead to more accumulation of items on this property\r\nwhich are unnecessary. Mrs. Stewart stated she has pictures\r\navailable for viewing, if needed.\r\n<\/p>\r\n<p>\r\nMr. Brent Stewart, 2621 US Hwy 84 West, spoke against the request.\r\nMr. Stewart stated he rezoned this property in 1986 and he as well\r\nas other neighbors in the area are very upset about the possible\r\nrezoning of this property. Mr. Stewart stated Highway 84 West is a\r\nbusy highway and changing the zoning would increase traffic and\r\npossibly decrease property values. Mr. Stewart stated he spoke with\r\nGene Rentz, with Georgia Department of Transportation, and GDOT has\r\nissues regarding this rezoning as well.\r\n<p>\r\nNo one spoke in favor of the request.\r\n<p>\r\nCommissioner Orenstein asked County Engineer, Mike\r\nFletcher, regarding the allegation that Georgia Department of\r\nTransportation (GDOT) is opposed to this rezoning, Mr. Fletcher\r\nstated he has not spoken to anyone with GDOT.\r\n<\/p>\r\n<p>\r\nCommissioner Orenstein asked Mr. Dillard regarding a sales\r\nconsignment lot, are there rules that govern or is that allowed by\r\nright and\/or C-H zoning, Mr. Dillard stated there are supplemental\r\nstandards, including buffering to adjacent properties. Commissioner\r\nOrenstein asked if there would have to be fencing or buffer\r\nrequirements, Mr. Dillard responded yes.\r\n<p>\r\nCommissioner Orenstein\r\nasked if the house on the property would be demolished, Mr. Dillard\r\nstated that decision would be made by a potential buyer.\r\n<p>\r\nCommissioner Marshall asked if there was anything we could do\r\nregarding the\r\nstockpile of items at this location, Chairman Slaughter asked County\r\nManager, Paige Dukes, to follow up with code enforcement regarding\r\nthis matter. Mrs. Dukes stated there is currently an open case and\r\nsteps are being followed that the court requires for us to\r\ndemonstrate that we have worked with\r\nthe property owner over a certain amount of time.\r\n<p>\r\nCommissioner\r\nOrenstein made a motion to approve the request as presented,\r\nCommissioner Marshall second. Vice Chairman Evans and Commissioner\r\nWisenbaker opposed. Chairman Slaughter voted to break the tie with\r\nhis vote being against the request, since the property is located in\r\nthe middle of a residential area.
