All anti-amnesty directives I have seen call for\r\nthe illegals being deported back to their country of origin ASAP. How\r\ndoes this equate to available prison labor for private prisons?\r\n<\/blockquote>\r\nOK, let&#8217;s go look at the anti-immigrant law passed by Arizona.\r\n<a href=\"http:\/\/www.50states.com\/flag\/azflag.htm\">\r\n<img decoding=\"async\" style=\"float:right;border:none;\"   src=\"http:\/\/www.50states.com\/flag\/image\/nunst004.gif\"><\/a>\r\nIt&#8217;s littered with &#8220;federal custody&#8221; and\r\n&#8220;imprisoned not more than thirty days&#8221; and\r\n&#8220;imprisoned not more than six months&#8221; and\r\n&#8220;A person who is sentenced pursuant to this section is not eligible\r\nfor suspension or commutation of sentence or release on any basis until\r\nthe sentence imposed is served.&#8221;\r\nand\r\n&#8220;class 1 misdemeanor&#8221;\r\nand\r\n&#8220;class 3 felony&#8221;\r\nand\r\n&#8220;class 4 felony&#8221;\r\nand\r\n&#8220;twenty days in jail&#8221; and\r\n&#8220;thirty days in jail&#8221;.\r\n<p>\r\n<a href=\"http:\/\/www.keytlaw.com\/blog\/2010\/04\/anti-illegal-immigration-law-part-1\/\">\r\nArizona Revised Statutes Section 11-1051<\/a>\r\n<blockquote>\r\nD.  Notwithstanding any other law, a law enforcement agency may securely\r\ntransport an alien who the agency has received verification is unlawfully\r\npresent in the united states and who is in the agency\u2019s custody to a\r\nfederal facility in this state or to any other point of transfer into\r\nfederal custody that is outside the jurisdiction of the law enforcement\r\nagency.  a law enforcement agency shall obtain judicial authorization\r\nbefore securely transporting an alien who is unlawfully present in the\r\nUnited States to a point of transfer that is outside of this state.\r\n<\/blockquote>\r\n<p>\r\n<a href=\"http:\/\/www.keytlaw.com\/blog\/2010\/04\/anti-illegal-immigration-law-part-2\/\">\r\n13-1509.  Trespassing by illegal aliens; assessment; exception; classification<\/a>\r\n\r\n<!--more-->\r\n<blockquote>\r\nA.  In addition to any violation of federal law, a person is guilty of\r\ntrespassing if the person is both:\r\n<p>\r\n1.  Present on any public or private land in this state.\r\n<p>\r\n2.  In violation of 8 United States Code section 1304(e) [KEYTLaw Comment\r\n&#8211; Section 1304(e) states: &#8220;Every alien, eighteen years of age and over,\r\nshall at all times carry with him and have in his personal possession\r\nany certificate of alien registration or alien registration receipt\r\ncard issued to him pursuant to subsection (d) of this section. Any\r\nalien who fails to comply with the provisions of this subsection shall\r\nbe guilty of a misdemeanor and shall upon conviction for each offense\r\nbe fined not to exceed $100 or be imprisoned not more than thirty days,\r\nor both.&#8221;] or 1306(a).  [KEYTLaw Comment &#8211; Section 1306(a) states: &#8220;Any\r\nalien required to apply for registration and to be fingerprinted in the\r\nUnited States who willfully fails or refuses to make such application\r\nor to be fingerprinted, and any parent or legal guardian required to\r\napply for the registration of any alien who willfully fails or refuses\r\nto file application for the registration of such alien shall be guilty\r\nof a misdemeanor and shall, upon conviction thereof, be fined not to\r\nexceed $1,000 or be imprisoned not more than six months, or both.]\r\n<p>\r\n&#8230;\r\n<p>\r\nDC.  A person who is sentenced pursuant to this section is not eligible\r\nfor suspension or commutation of sentence or release on any basis until\r\nthe sentence imposed is served.\r\n<p>\r\nED.  In addition to any other penalty prescribed by law, the court shall\r\norder the person to pay jail.\r\n<p>\r\n&#8230;\r\n<p>\r\nG.  A violation of this section is a class 1 misdemeanor, except that\r\na violation of this section is:\r\n<P>\r\n1.  A class 3 felony if the person violates this section while in\r\npossession of any of the following:\r\n<p>\r\n(a)  A dangerous drug as defined in section 13-3401.\r\n<p>\r\n(b)  Precursor chemicals that are used in the manufacturing of methamphetamine in violation of section 13-3404.01.\r\n<p>\r\n(c)  A deadly weapon or a dangerous instrument, as defined in section 13-105.\r\n<p>\r\n(d)  Property that is used for the purpose of committing an act of terrorism as prescribed in section 13-2308.01.\r\n<p>\r\n2.  A class 4 felony if the person either:\r\n<p>\r\n(a)  Is convicted of a second or subsequent violation of this section.\r\n<p>\r\n(b)  Within sixty months before the violation, has been removed from\r\nthe United States pursuant to 8 United States Code section 1229a or has\r\naccepted a voluntary removal from the United States pursuant to 8 United\r\nStates Code section 1229c.\r\n<p>\r\nH.  A violation of this section is a class 1 misdemeanor, except that\r\nthe maximum fine is one hundred dollars and for a first violation of\r\nthis section is: the court shall not sentence the person to more than\r\ntwenty days in jail and for a second or subsequent violation the court\r\nshall not sentence the person to more than thirty days in jail.\r\n<\/blockquote>\r\n<p>\r\nCase closed.\r\n<p>\r\n-jsq\r\n","protected":false},"excerpt":{"rendered":"Somebody recently asked: I have seen no verification that the private prisons intend to make money from inmate labor &#038; the recent article claiming prison labor would displace more citizen jobs if illegals were jailed as a positive for amnesty was ridiculous.
