he just wants to sell the land for a profit&#8230;.&#8221;\r\nAlso people bought land in that area because it was Estate Agriculture;\r\nthey have horses, riding arenas, etc.\r\nHe cited the Planning Commission saying this rezoning would be a mistake.\r\nHe noted Tom Call said the landowner should be able to make a profit on the land,\r\nbut there&#8217;s no guarantee anybody will make a profit on buying land,\r\nespecially at the expense of the surrounding community.\r\nHe was talking about stormwater runoff when his time ran out.\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nChairman Bill Slaughter said he would allow only two more speakers,\r\nand only if they had something new to say.\r\n<p style=\"font-style:normal\">\r\nHe gave Chuck Dunham only one minute.\r\nDunham said if they approved the zoning tonight,\r\nthey&#8217;d be approving something that was denied by the Planning Commission,\r\nit&#8217;s outside the Comprehensive Plan, and it&#8217;s far out of the\r\ncounty&#8217;s water and sewer.\r\nHe said if they approve that, they&#8217;ll have a hard time legally defending\r\ndenying any rezoning.\r\n<p style=\"font-style:normal\">\r\nJim and Sharon Respess, 6002 Val Del Road\r\nnoted all the professionals said deny it,\r\nall of the Planning Commission except a developer said\r\ndeny it,\r\nand everybody who spoke, except the owner&#8217;s representative,\r\nsaid deny it.\r\nSo he wanted to know why this rezoning was even being voted on.\r\nHe recommended that if this rezoning passed,\r\nthe county should terminate the services of the professionals,\r\nsince they obviously were not needed nor listened to.\r\nAnd get rid of the Zoning Committee [Planning Commission],\r\nsince it&#8217;s irrelevant.\r\nThey asked them to turn it down.\r\n<p style=\"font-style:normal\">\r\nMichael Mehr, 5909 Val Del Road,\r\nsaid there are already flooding problems,\r\nand the developer was doing nothing for children.\r\nHe said the county was liable for runoff.\r\nHe said they should check if it would harm anyone,\r\nbecause the county could be sued.\r\nAnd he didn&#8217;t want to be hurt, nor did he want children hurt.\r\n<p style=\"font-style:normal\">\r\nIn support, nobody but strutting Tom Call, representing the landowner,\r\nspoke.\r\nHe repeatedly referred to the County Commissioners as &#8220;you guys&#8221;.\r\nHe claimed the house prices hadn&#8217;t changed, and the lot sizes\r\nhad changed due to requests from &#8220;you guys&#8221;.\r\nHe said the average one and a half acres per lot\r\nwas plenty of room for children,\r\nand there were less than ten acres of wetlands on the property,\r\nall accounted for in the plan.\r\n<p style=\"font-style:normal\">\r\nCommissioner Clay Griner asked what the actual size of the lots was.\r\nAnswer: they vary.\r\nWith more questioning, he said the 1.66 acres was land per house\r\naveraged across the whole development, which does include the roads\r\nand the wetlands.\r\nHe seemed to say the wetlands would be divided among the lots.\r\n<p style=\"font-style:normal\">\r\nCommissioner Mark Wisenbaker referred to a letter from Tom Call\r\nof September 4, 2018 that said this development would\r\n&#8220;contribute to the solution of the growing shortage of affordable housing\r\nin rural Lowndes County.&#8221;\r\nWisenbaker asked,\r\n&#8220;Is $250,000 to $275,000 affordable housing?&#8221;\r\nCall said certainly for many people, since in the MLS about 60%\r\nof sales is between $200 and $300,000.\r\nWith more questioning,\r\nCall clarified, &#8220;I don&#8217;t mean low income housing.&#8221;\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nCommissioner Scottie Wisenbaker asked &#8220;Mr. Call&#8221; if his proposal\r\nwas 60 lots total.\r\nAnswer: yes.\r\n<p style=\"font-style:normal\">\r\nCommissioner Demarcus Marshall wanted to know how many acres were wetlands.\r\nAnswer: between 9 and 10.\r\nExact amount to be determined before development.\r\n<p style=\"font-style:normal\">\r\nCommissioner Mark Wisenbaker asked, &#8220;Can we summarize the facts on this case?&#8221;\r\nThe Chairman seemed confused, but said Wisenbaker could do that.\r\nThe Chairman asked if there were any other speakers in favor.\r\nThere were none.\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nWisenbaker said he is sensitive to this development, because\r\nhe lives in an area &#8220;real similar to this,&#8221;\r\nHickory Grove Road, narrow, a lot of traffic, old family farms,\r\nwith some smaller lots.\r\nHe said the traffic is a real issue to him.\r\nHe summarized the future development map shows it&#8217;s in an\r\nagricultural and forestry character area.\r\nIt&#8217;s outside county water and sewer.\r\nR-1 zoning is not supported by the Comprehensive Plan in such a\r\ncharacter area.\r\nLast time there were 5 neighbors opposing the request.\r\nTonight there are 9 or 10 neighbors opposing the request.\r\nTechnical Committee and Planning Commission both recommended denial.\r\nHe said he thinks they should pay attention to staff and the Planning Commission.\r\n<p style=\"font-style:normal\">\r\nMarshall said at 60 lots with 98 acres &#8211; 10 acres wetlands  is 88 acres\r\nthat could be developed,\r\nand that doesn&#8217;t divide out to 1.66 acres a lot.\r\nHe wondered if the plat was correct.\r\nThe Chaiman said he had to assume since it was done by a surveyor\r\nit was correct.\r\nThere was further discussion about sizes,\r\nresulting in some lots would be about one acre.\r\nThe Chairman said one acres is the minimum required for well and septic.\r\n<p style=\"font-style:normal\">\r\nCommissioner Wisenbaker made a motion to deny, &#8220;given the facts,\r\nwhich are undisputed.&#8221;\r\nThere was no second.\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nCommissioner Wisenbaker moved to approve with 60 lots maximum.\r\nCommissioner Griner seconded.\r\nOnly they voted for.\r\nThe motion failed.\r\n<p style=\"font-style:normal\">\r\nCommissioner Marshall moved to approved with lot size &#8220;2.5, as recommended by staff.&#8221;\r\nCommissioner Wisenbaker seconded.\r\nThey all voted for, visibly, for once, by raising their hands.\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nCounty Manager Joe Pritchard asked for the attorney to commit.\r\nWalter G. Elliott said that lot size was effectively rezoning it to R-A.\r\nSomebody (the Chairman?) said yes.\r\nElliott said the zoning map should reflect R-A.\r\nThey agreed.\r\n<\/p>\r\n<li>\r\n<a name=\"REZ-2018-19\" href=\"#REZ-2018-19\">\r\n      5b.REZ-2018-19 Old US 41 N.
