      \r\nCOUNTY ACTION REQUESTED ON: Hahira Extraterritorial Water and Sewer\r\nService Extensions\r\n<\/p>\r\n

      \r\nHISTORY, FACTS AND ISSUES:\r\n

      \r\nThe Board has received the attached notice of annexation and\r\nrezoning which incorporates Hahira’s making extraterritorial\r\nextensions of water and sewer services into the County’s water and\r\nsewer service areas.\r\n<\/p>\r\n

      \r\nThe subject property is approximately 36.75 acres depicted on the\r\nenclosed aerial photograph and Rezoning Map. It is the northern\r\nportion of the 64.32 acre parcel depicted on the Rezoning Map. It is\r\non the north side of Hahira on the east side of Highway 41.\r\n<\/p>\r\n

      \r\nSection 2 of the Special Settlement Provisions of the Lowndes County\r\nService Delivery Strategy Agreement effective July 1, 2008, provides\r\n“Any party may make an extraterritorial extension of water and\r\nsewer services upon approval of the affected party.” It also\r\nprovides “Such approval shall not be unreasonably\r\nwithheld,” considering the factors listed in the Agreement.\r\n<\/p>\r\n

      \r\nThe attached notice evidences Hahira’s intention to make\r\nextraterritorial extensions to provide water and sewer services to\r\nthe subject property. The Annexation Petition and Rezoning\r\nApplication signed by the property owner enclosed with the notice\r\nevidence the property owner’s request for water and sewer services\r\nby Hahira.\r\n<\/p>\r\n

      \r\nThe proposed extraterritorial extensions will not negatively affect\r\nproperty owners in the County’s service areas or existing County\r\nwater and sewer customers. The subject property is contiguous to\r\nHahira’s existing water and sewer service areas. The County has not\r\nmade investments in infrastructure planning to serve the subject\r\nproperty or other properties in the immediate area and does not have\r\nplans to serve the subject property or other properties in the\r\nimmediate area. The proposed extensions will not otherwise\r\nnegatively affect the County’s plans for the provision of water and\r\nsewer services to other properties in the County’s service areas.\r\n<\/p>\r\n

      \r\nA proposed letter from Chairman Slaughter to Mayor Cain\r\ncommunicating the Board of Commissioners’ approval of the proposed\r\nextraterritorial extensions is attached. It states the Board of\r\nCommissioners’ approval is conditioned upon Hahira’s annexation of\r\nthe subject property and that if Hahira does not annex the subject\r\nproperty it will remain in the County’s water and sewer service\r\nareas.\r\n<\/p>\r\n

      \r\nOPTIONS: 1. Approve the proposed extraterritorial extensions on the\r\ncondition Hahira annexes the subject property and authorize Chairman\r\nSlaughter to sign and deliver the attached letter to Mayor Cain.\r\n<\/p>\r\n

      \r\n2. Redirect.\r\n

      \r\nRECOMMENDED ACTION: Approve the proposed extraterritorial extensions\r\non the condition Hahira annexes the subject property and authorize\r\nChairman Slaughter to sign and deliver the attached letter to Mayor\r\nCain.\r\n<\/p>\r\n

      \r\nSince that’s a pretty good description and it’s public,\r\nseems to me there was no need for county staff to email\r\nfurther information.\r\n

      \r\nI do wonder, since the letter from Hahira City Planner Matt Martin\r\nwas sent to Lowndes County August 1st, why County Manager Joe Pritchard\r\nonly brought these annexation and rezoning items up in the Work Session\r\non August 13th.\r\n
