\r\nA\r\n\r\nbusy morning’s agenda<\/a>\r\nstarts with approving\r\n\r\na new annual budget<\/a> and related\r\n\r\nhotel and motel taxes<\/a>.\r\nPlus a\r\nContract with Valdosta Continuing Land Bank Authority<\/a>.\r\n

\r\nParks and Rec is negotiating a $3 million loan from Ameris Bank for improvements to Freedom Park<\/a> and wants\r\n\r\nthe county to guarantee its 1.25 mil tax base<\/a>.\r\n

\r\nUtilities wants\r\n\r\nabout $20,000 for impellers and wear rings<\/a> for the pumps in the\r\n\r\nFrancis Lake Lift Station<\/a> and about $275,000<\/a> to improve the\r\n\r\nLand Application Site (LAS)<\/a>, where they spray sewer waste onto a field\r\nwhich they then rent out for hay production<\/a> (the county does not have a wastewater treatment plant).\r\nSee also WWALS blog post<\/a>.\r\n

\r\nThe mysterious\r\n\r\nout-of-state apartment bonds<\/a>\r\nactually get an explanation<\/a> this time:\r\n

\r\n

\r\nThe Board of Commissioners is requested to adopt the attached\r\nrevised Resolution approving the issuance of bonds by a Wisconsin\r\nPublic Finance Authority. A portion of the proceeds of the bonds\r\nwill be used for a project located on Old Statenville Road. The\r\nproject is a 204-unit multi-family affordable housing development\r\nknown as Brittany Woods & Park Chase Apartments.\r\n<\/p>\r\n

\r\nThe reason for this revised Resolution is\r\n\r\n that the borrower\r\ndetermined to finance all of a multi-state project with tax-exempt\r\nbonds. This necessitated a new TEFRA hearing and Resolution of the\r\nBoard of Commissioners.\r\n<\/p>\r\n

\r\nThe requested Resolution provides the Board of Commissioners’\r\napproval of the Authority’s issuance of the bonds is for the sole\r\npurpose of complying with certain requirements including federal tax\r\nrequirements and that in no event shall the Board of Commissioners’\r\napproval constitute an obligation on the part of the Board of\r\nCommissioners or Lowndes County.\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nTEFRA\r\n

\r\nAcronym for “Tax Equity and Fiscal Responsibility Act”\r\nof 1982. As a pre-condition for the exclusion from gross income for\r\nfederal income tax purposes of interest on all qualified private\r\nactivity bonds, TEFRA requires, among other things, that the issue\r\nbe approved (a “TEFRA approval”) either by an elected\r\nofficial or body of elected officials of the applicable governmental\r\nentity after a public hearing (a “TEFRA hearing”)\r\nfollowing reasonable public notice (a “TEFRA notice”) or\r\nby voter referendum of such governmental entity.\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nSo the county is facilitating a tax break for a private developer.\r\nWho is this developer, and why are they getting this favor?\r\n
