\nSir,\n

\nThank you\n\nfor suggesting that I continue to address my concerns of the\nFoxborough McDonalds with the Lowndes County Board of Commissioners.<\/a> I\ntruly hope that with the Board\u2019s help, the neighbors and the Foxborough\nMcDonalds can come to some mutual agreement as to acceptable hours of\noperation.\n

\nAttached is an e-copy of what\n\nI presented to the Lowndes County Board\nof Commissioners at last night\u2019s Citizen\u2019s Wishing To Be Heard<\/a> meeting.\n

\nI\u2019m a little frustrated that I\u2019m unable to obtain a copy of\n<\/blockquote>\n

\nLowndes\nCounty Ordinances. I don\u2019t fully understand why. Where are they? I\nunderstand that ignorance of the law is not an acceptable defense in a\ncourt of law, however when one wants to know and is making an earnest\neffort to find out what the law is and the law is unavailable what is\none to do?\n

\nThe Lowndes County Ordinance thus far researched that shows most\npromise in helping to at least curtail the Foxborough McDonalds hours\nof operation is the\n\nordinance on noise, Lowndes County Ordinance 97-0704.<\/a>\nThe Foxborough McDonalds will violate ordinance 97-0704. I\nbelieve a compromise can be reached whereby the Foxborough McDonalds\nwill agree to stop all food preparation and selling operations at 10:00\npm on weeknights and at 12:00 am on Friday and Saturday nights. If\nMcDonalds is permitted to operate 24hours a day it will establish a\nprecedent for the area. We need not to allow this to happen. Currently\nthere is no store as such in the area that operates 24hours a day. The\nclosest store as such is the Burger King that is on the other side of\nI-75, well over a mile away. That store has no residential neighbors.\nLooking forward to hearing what Chief Guyton has to say on this issue.\n

\n\n<\/a>\nNext question if I may. Last night I received some information through\nan open records request on the Foxborough McDonalds from Lowndes County\nClerk, Paige Dukes. I have only briefly scanned a few of the documents\nand have already found some interesting and disturbing issues. I\nbelieve I\u2019ve stated to you that I have a copy of the Lowndes County\n\nUnified Land Development Code (ULDC)<\/a> and that I have spent considerable\ntime in studying it. My question is who should I address these issues\nwith? The paramount issue thus far concerns the road Foxborough Ave\nitself. I don\u2019t believe that unless a variance was granted that the\nroad Foxborough Ave is so designated to permit a commercial enterprise.\nNearly a year ago I made this argument before the Lowndes County Board\n\n<\/a>\nof Commissioners and Commissioner Lee directed the County Engineer, Mr.\nMike Fletcher to look into it. I never received an answer from\nCommissioner Lee or Mr. Fletcher.\n

\nIf not sooner Commissioner Raines, I will see you at the next Citizens\nWishing To Be Heard meeting on 14 June at 5:30pm.\n
