{"id":17767,"date":"2016-11-07T07:54:21","date_gmt":"2016-11-07T12:54:21","guid":{"rendered":"http:\/\/www.l-a-k-e.org\/blog\/?p=17767"},"modified":"2016-11-07T07:54:21","modified_gmt":"2016-11-07T12:54:21","slug":"3-hospital-authority-appointments-3-road-abandonments-lcc-2016-11-07","status":"publish","type":"post","link":"http:\/\/www.l-a-k-e.org\/blog\/2016\/11\/3-hospital-authority-appointments-3-road-abandonments-lcc-2016-11-07.html","title":{"rendered":"3 Hospital Authority appointments, 3 road abandonments @ LCC 2016-11-07"},"content":{"rendered":"<p>\r\nOn this morning&#8217;s\r\n<a href=\"http:\/\/lowndescounty.com\/AgendaCenter\/ViewFile\/Agenda\/11082016-220?html=true\">\r\nWork Session agenda<\/a>,\r\nLowndes County is replacing 3 of its 4 Hospital Authority board members.\r\nOf those, 2 of 3 are on the Hospital Foundation board, so how much change is this?\r\nAnd why does the Lowndes County Commission seem to be doing this appointment backward to the way Georgia law requires?\r\n<p>\r\n<a href=\"https:\/\/www.sgmc.org\/about_sgmc\/hospital_authority.aspx\">\r\n<img decoding=\"async\" style=\"float:right;border:none\" src=\"https:\/\/www.sgmc.org\/images\/SGMC_logo_2013.png\"><\/a>\r\nThese appointments are especially interesting after the <a href=\"http:\/\/valdostatoday.com\/2016\/09\/city-of-valdosta-calls-for-hospital-authority-resignations\/\">\r\nValdosta City Council&#8217;s call for Hospital Authority resignations<\/a>\r\nback in September.\r\nThe city&#8217;s <a href=\"http:\/\/www.valdostacity.com\/hospital-authority-of-valdosta-lowndes-county\">list of Authority board members<\/a>\r\nis out of date, still listing<!--more-->\r\n\r\n\r\n<blockquote style=\"font-size:100%\">\r\n<H4>City<\/H4>\r\n&#8230;\r\n<ul>\r\n<li>\r\nBill Rountree (Member at Large) &#8211; Term Expires 02\/01\/16&#8243;\r\n<\/ul>\r\n<H4>County<\/H4>\r\n&#8230;\r\n<ul>\r\n<li>\r\nDr. Lynn Feldman &#8211; Term Expires 08\/01\/17\r\n<\/ul>\r\n&#8230;\r\n<\/blockquote>\r\n<p>\r\nThe\r\n<a href=\"http:\/\/www.lowndescounty.com\/339\/Hospital-Authority\">\r\nLowndes County list has instead<\/a>:\r\n<blockquote style=\"font-size:100%\">\r\n<table>\r\n<tr>\r\n<th style=\"text-align:left\">\r\nName\r\n<\/th>\r\n<th style=\"text-align:left\">\r\nTerm Expiration\r\n<\/th>\r\n<th style=\"text-align:left\">\r\nAppointed by\r\n<\/th>\r\n<\/tr>\r\n<tr><td>Tim Dame <\/td><td>2\/1\/21 <\/td><td>City of Valdosta\r\n<tr><td>Dr. John D. Roan <\/td><td>2\/1\/21 <\/td><td>Lowndes County\r\n<\/table>\r\n<\/blockquote>\r\n<p>\r\nAnd indeed, back in January County Manager Joe Pritchard said\r\nDr. Lynn Feldman had resigned and\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2016\/01\/videos-sold-out-to-sabal-trail-lcc-2016-01-26.html#Hospital-Authority-of-Valdosta-and-Lowndes-County-Board\">\r\nthe county appointed Dr. John D. Roan<\/a>, selecting from\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2016\/01\/appointments-to-3-boards-lcc-2016-01-25.html\">\r\na list of three candidates<\/a>, which also included\r\nDr. Steven Brian Dawson and Dr. John W. Devine.\r\nHe did not say who recommended that list, nor how the candidates knew to apply,\r\nnor any qualifications or resumes for them.\r\n<p>\r\nSouth Georgia Medical Center\r\n<a href=\"https:\/\/www.sgmc.org\/about_sgmc\/hospital_authority.aspx\">\r\nlist the same Authority members<\/a> as does Lowndes County.\r\nSGMC also lists a\r\n<a href=\"https:\/\/www.sgmc.org\/foundation\/board_of_trustees.aspx\">\r\nFoundation Board<\/a>:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nSGMC Foundation board is a volunteer organization comprised of\r\nmembers of the community. Mathis\r\n<br>\r\nMs. Brenda DeLoach\r\n<br>\r\nMr. David Shepard\r\n<\/blockquote>\r\n<p>\r\nYou can see two of the three names on there that\r\nare also on the Lowndes County appointment list for this morning:\r\nMrs. Suzan Prince\r\nand\r\nMr. Ben Copeland.\r\n<p>\r\nI&#8217;m told that the Hospital Authority submits the list of candidates\r\nfor appointment and the county must appoint from that list or ask\r\nfor another list, and nothing prevents the Authority from submitting\r\nthe same list again.\r\nCan anyone confirm or refute this?\r\n<p>\r\nSGMC says <a href=\"https:\/\/www.sgmc.org\/about_sgmc\/hospital_authority.aspx\">\r\nThe Authority is subject to the Hospital Authorities Law of the Code of Georgia.<\/a>\r\nThat appears to be\r\n<a href=\"http:\/\/law.justia.com\/codes\/georgia\/2010\/title-31\/chapter-7\/article-4\/\">\r\n2010 Georgia Code,\r\nTITLE 31 &#8211; HEALTH,\r\nCHAPTER 7 &#8211; REGULATION AND CONSTRUCTION OF HOSPITALS AND OTHER HEALTH CARE FACILITIES,\r\nARTICLE 4 &#8211; COUNTY AND MUNICIPAL HOSPITAL AUTHORITIES<\/a>.\r\nSee <a href=\"http:\/\/law.justia.com\/codes\/georgia\/2010\/title-31\/chapter-7\/article-4\/31-7-72\/\">O.C.G.A. 31-7-72(b) (2010)<\/a>,\r\n<ol>\r\n<li> The governing body of the area of operation shall submit a list of three eligible persons to the board of the hospital authority;\r\n<li>The board at its next regular meeting shall either select one of the three persons named in such list or decline to select any of the persons named in the list. If the board declines to select any of the persons named on the list, it shall so notify the governing body; and\r\n<li>\r\n Upon receipt of notification that the board has declined to select any of the persons named in the governing body&#8217;s list, the governing body shall submit a second list of three eligible persons, no one of whom was named on the first list, to the board of the hospital authority. The board at its next regular meeting after receipt of the second list shall select one of the three persons named in the second list.\r\n<\/ol>\r\n<p>\r\nIn case it&#8217;s not obvious who the &#8220;governing body&#8221; is that should prepare\r\nthe list of three names, just a few sentences before, in\r\n<a href=\"http:\/\/law.justia.com\/codes\/georgia\/2010\/title-31\/chapter-7\/article-4\/31-7-72\/\">O.C.G.A. 31-7-72 (2010)<\/a>,\r\n<blockquote>\r\n<p>\r\n(a) There is created in and for each county and municipal\r\ncorporation of the state a public body corporate and politic to be\r\nknown as the &#8220;hospital authority&#8221; of such county or city, which\r\nshall consist of a board of not less than five nor more than nine\r\nmembers to be appointed by the governing body of the county or\r\nmunicipal corporation of the area of operation for staggered terms\r\nas specified by resolution of the governing body.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nSee also in &#8220;Definitions&#8221;:\r\n<a href=\"http:\/\/law.justia.com\/codes\/georgia\/2010\/title-31\/chapter-7\/article-4\/31-7-71\/\">\r\nO.C.G.A. 31-7-71 (2010)<\/a>:\r\n<blockquote>\r\n<ol start=\"3\">\r\n<li>\r\n&#8220;Governing body&#8221; means the elected or duly appointed officials constituting the governing body of a city or county.\r\n<\/ol>\r\n<\/blockquote>\r\n<p>\r\nClearly the &#8220;governing body&#8221; is the Lowndes County Commission\r\nand the Valdosta City Council for this joint Authority.\r\n<p>\r\nSo according to the law, the county should be submitting a list of three names\r\nto the Hospital Authority.\r\nInstead in January it got a list of three names and picked one.\r\nAnd today it&#8217;s considering only one name.\r\n<p>\r\nSo what&#8217;s going on here?\r\n<blockquote style=\"font-size:100%\">\r\n<p style=\"text-align:center\">\r\nLOWNDES COUNTY BOARD OF COMMISSIONERS\r\n<br>\r\nPROPOSED AGENDA\r\n<br>\r\nWORK SESSION, MONDAY,&nbsp; NOVEMBER 7, 2016, 8:30 a.m.\r\n<br>\r\nREGULAR SESSION, TUESDAY, NOVEMBER&nbsp; 8, 2016, 5:30 p.m.\r\n<br>\r\n327 N.
