they&#8217;d have to pay the money back if the pipeline didn&#8217;t get permits.\r\nThe alleged county attorney read from the contract\r\n which none of us have seen,\r\nsaying paragraph 16 has a reverter clause which says\r\n&#8220;if you want to look at it&#8221;, that the land would revert and there would be no reimbursement.\r\n<p style=\"font-style:normal\">\r\nCommissioner Demarcus Marshall wanted to know whether there was some conflict with the resolution against Sabal Trail they adopted last year,\r\nand whether there was some need to deal with this now.\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nThe CEO of Waller Heating and Air said over 90% of landowners in the county\r\nhad signed with Sabal Trail already.\r\nCounty Engineer Mike Fletcher said 59 of 65 had, and this would make 60.\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nMarshall tried again, asking if there was some time limit on approving the easement.\r\nThe air conditioning executive said &#8220;I&#8217;m not sure I quite understand your question.&#8221;\r\nHe said he thought &#8220;primarily&#8221; this easement was\r\n&#8220;right along the same lines that would be done with any other utility easement in the county&#8221; such roads.\r\n&#8220;Again I believe the document has been drawn up in a fashion that protects the county that in the event that FERC does not approve the pipeline it rescinds the agreement and you&#8217;re back to where you started.&#8221;\r\nBy &#8220;the county&#8221; apparently he meant the county government as a business,\r\nbecause what he said sure doesn&#8217;t protect the citizens or taxpayers or water drinkers of the county from the invading pipeline from Houston, Texas.\r\nApparently he also doesn&#8217;t understand, even though he wrote it in\r\n<a href=\"http:\/\/spectrabusters.org\/2014\/04\/12\/sabal-trail-will-be-expected-to-adhere-and-honor-all-lowndes-county-ordinances-bill-e-slaughter-jr-to-ferc\/\">\r\na letter to FERC<\/a> and then in\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/11\/opposes-sabal-trail-pipeline-in-any-portion-of-lowndes-county-lowndes-county-commission.html\">\r\na resolution unanimously approved by all the Commissioners<\/a>,\r\nthat when he&#8217;s sitting in that chair he&#8217;s supposed to be acting on behalf of all the citizens of the county, not just as Chairman of a business called Lowndes County.\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nCommissioner Marshall tried again, asking &#8220;would there be any repercussions possibly&#8221; for not signing the easement agreement.\r\n<a name=\"eminent\" href=\"#eminent\">This time the alleged county attorney said<\/a>,\r\n<\/p>\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nBear in mind Sabal Trail has the right of eminent domain,\r\nso if agreement is not reached by the county and Sabal Trail, \r\nthen the county and Sabal Trail, then they would have the option of exercising that right and instituting a legal proceeding to acquire it using their power of eminent domain.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nThe household appliance CEO pushed harder to sell county land to a company from Houston, Texas, saying\r\n<blockquote style=\"font-size:100%\">\r\n<p>If time is going to change your time on the position of allowing Sabal Trail to come across Lowndes County property,\r\nthen yes, take it.\r\nIf it&#8217;s not going to make a difference in your decision\r\nthat if a pipeline gets approved, then it&#8217;s coming through Lowndes County\r\nand you&#8217;re going to allow them to come across Lowndes County property,\r\nthen there&#8217;s no problem in approving it tonight.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nBuilding contractor Scott Orenstein said,\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nI think that we can personally or collectively have our own opinions,\r\ndisagree about this whole pipeline issue, but I think that what we have here is\r\nwhat&#8217;s in the best interest, best business practice for the county.\r\nSo I think we have to keep this in mind, that this is smart business,\r\nregardless of how we feel personally.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nCommissioner Marshal tried again:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nAnd I agree totally, my only drawback is that we voted a resolution to oppose it,\r\nand that&#8217;s looking at me every second we talk about Sabal Trail, because we\r\nvoted on behalf of the citizens last year.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nReal estate broker Mark Wisenbaker <a name=\"wondered\" href=\"#wondered\">wondered<\/a>,\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nDid we actually oppose it, or did we have some stipulations we wanted to follow, like depth, removing of footprint?\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nThe air conditioning exeutive at least remembered:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nIt was a combination of all of the above.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nBut he wouldn&#8217;t leave it at that, continuing a hard sell for Spectra Energy of Houston, Texas:\r\n<\/p>\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nBut again, this is not an issue at this point of whether we oppose it or whether we approve.\r\nThe issue is that in the event that FERC approves the pipeline, and then it&#8217;s out of our hands, this is an agreement between Sabal Trail and Lowndes County to allow them to come on the property for the purpose of the easement to put the pipeline in, again making us number 60 out of 65 property owners that would have approved the easement.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nCommissioner Marshall asked if there was any special permitting needed for the landfill.\r\nCounty Engineer Mike Fletcher said the pipeline didn&#8217;t go through the main landfill, merely through additional land used as &#8220;an inert landfill&#8221;.\r\nHe also revealed they had &#8220;revised the agreement originally sent to us&#8221;.\r\nWhen was it sent and when was it revised?\r\nSomeone (I think Wisenbaker) asked if there were any other permits required.\r\nThe Engineer said no because &#8220;they&#8217;re not going to be disturbing any of our monitoring wells, so everything is fine.&#8221;\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nWisenbaker wanted to know if Sabal Trail would parallel &#8220;the Southern pipeline&#8221;,\r\napparently referring to the existing Southern Natural Gas pipeline.\r\nThe Engineer said yes.\r\n<\/p>\r\n<p style=\"font-style:normal\">\r\nMarshall wanted to know where those still opposing the pipeline line\r\n&#8220;on that map&#8221;, which presumbaly those sitting behind their desks could see,\r\nbut we the people could not.\r\n<a name=\"dontknow\" href=\"#dontknos\">Answer from the County Engineer<\/a>:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nNo sir, I don&#8217;t know who they are.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nThe AC CEO asked for a motion.\r\nWisenbaker moved:\r\n<\/p>\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nMr. Chairman, giving the fact that by approving this we&#8217;d be number 60 out of 65, an overwhelming percentage in favor, I motion that we approve and authorize you to sign the agreement for\r\n$54,300 consideration to the county.\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nThere was a barely audible second, I think from automobile dealer Clay Griner.\r\nThen the AC exec. asked for hands raised.\r\nFor raised their hands for, and only Commissioner Demarcus Marshall raised his hand high for no.\r\n<\/P>\r\n<li>\r\n<a name=\"just-a-bit-more-on-the-business-of-it-all\" Quarterman (regarding the pipeline vote)\" src=\"http:\/\/i.ytimg.com\/vi\/FHa30zuXupQ\/default.jpg\"><\/a>\r\n<p style=\"font-style:normal\">\r\n<a href=\"http:\/\/www.youtube.com\/watch?v=FHa30zuXupQ&#038;index=13&#038;list=PLshUv86fYkiEkYgaJs9zJ4Z4rej_Xr3bi\">Video.<\/a>\r\n<blockquote>\r\n<p>\r\nI&#8217;m curious how a pipeline that provides nothing to Lowndes County is like any other utility.\r\nI&#8217;m also curious what this process was that was referred to.\r\nI&#8217;ve kind of searched\r\n<a href=\"http:\/\/www.valdostadailytimes.com\/news\/local_news\/county-to-vote-on-easement-for-sabal-trail\/article_dca5895f-4724-5a0e-be18-f0297bc3b531.html\">\r\nthis newspaper article<\/a>, and I see nothing in here\r\nabout in here about the landfill, or about the EPD permit that in\r\n<a href=\"http:\/\/spectrabusters.org\/2014\/04\/12\/sabal-trail-will-be-expected-to-adhere-and-honor-all-lowndes-county-ordinances-bill-e-slaughter-jr-to-ferc\/\">\r\nthe Chairman&#8217;s letter of last April<\/a>, it said item number 11 was required.\r\nNothing was said about any of this at\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2016\/01\/videos-board-appointments-sabal-trail-easement-lcc-2016-01-25.html#Return-from-closed-session-to-add-Sabal-Trail-item-to-agenda\">\r\nyesterday morning&#8217;s Work Session<\/a>.\r\nAnd this was scheduled with less than a day&#8217;s notice.\r\nSo I wonder, where is this process?\r\nThe public has not seen any process.\r\n<p style=\"font-style:normal\">\r\nAnd, I&#8217;m not big on quoting the Bible, but 60 out of 65.\r\nI&#8217;m going to quote Exodus 23:2:\r\n<\/p>\r\n<blockquote>\r\n<p><strong>\r\nThou shalt not follow a multitude to do evil.\r\n<\/strong>\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nJust becaouse a bunch of other landowners took the money doesn&#8217;t mean the county had to.\r\nAnd I can tell you Sabal Trail will not treat this as just another landowner.\r\nThey will be trumpeting Lowndes County took the money, signed the easement.\r\nThat resolution you all agreed to unanimously a year ago, I guess you didn&#8217;t mean it.\r\nBecause you&#8217;re now actively working against it.\r\nYou had a chance to represent the citizens of Lowndes County,\r\nand you took the money instead.\r\n<\/P>\r\n<\/blockquote>\r\n<p style=\"font-style:normal\">\r\nThey immediately moved to adjourn and laughed.\r\n<\/p>\r\n<\/ul>\r\n<p>\r\nCommissioner Clay Griner, who earlier said on the telephone he didn&#8217;t want to argue about it,\r\nstopped in the door on the way out to argue with me.\r\nI pointed out, as I did yesterday in\r\n<a href=\"http:\/\/www.wwals.net\/2016\/01\/26\/reject-sabal-trail-easement-payment-tonight-wwals-to-lowndes-county-commission-2016-01-26\/\">\r\na letter as president of WWALS Watershed Coalition<\/a>,\r\nthat the Commissioners could have helped stop pipeline permits by\r\nasking state and federal elected officials to do so.\r\nHe answered &#8220;I don&#8217;t think so&#8221; and went out the door.\r\n<p>\r\nAfterwards I congratulated Spectra Energy&#8217;s Brian Fahrenholdt for turning\r\nanother one, noting at least he&#8217;s doing the job he&#8217;s paid for,\r\nunlike some others in the room.\r\nFor example, the county attorney whose answers led many to believe eminent\r\ndomain could be invoked right now, when he knows full well FERC hasn&#8217;t issued\r\na permit, so there is no federal eminent domain.\r\n(One could argue about Georgia eminent domain, because of several cases where Sabal Trail has sued local landowners and judges have granted survey access.\r\nBut none of those cases apply to any other landowners, and even Sabal Trail has repeatedly said they&#8217;re only about surveying, not about right of way easements.
