\r\nOnly a bit more than three years since\r\n\r\n<\/a>\r\n\r\nthe pictured incident<\/a>,\r\nNydia Tisdale gets some of the recognition she deserves.\r\n

\r\n\r\nGeorgia Woman Wins First Amendment Award for her Citizen Journalism, Fighting for the Right to Record<\/a>,\r\n

\r\n

Georgia citizen journalist Nydia Tisdale is in the news again but this time, the story doesn’t involve her getting thrown out of a public meeting<\/a> or arrested in a pumpkin patch<\/a>.<\/p>\r\n

Tisdale is being honored by Georgia’s First Amendment Foundation<\/a> for her work in making public meetings available to the citizens of her community and for her dedication to keeping government open for everyone’s participation.<\/p>\r\n<\/blockquote>\r\n

\r\nAfter \r\n\r\ngetting thrown out of the Cumming City Council for videoing in April 2012<\/a>,\r\nNydia got\r\n\r\n\r\n\r\ninvited back to the front row that May<\/a>.\r\nEventually, with the help of Georgia Attorney General Sam Olens,\r\nNydia settled the Cumming case for $200,000<\/a>.\r\n

\r\n\r\n<\/a>\r\nIn August 2014\r\n\r\na pumpkin farm landowner had Nydia ejected<\/a>\r\nfor\r\n\r\nsitting in the front row<\/a> of a Republican campaign rally\r\nthat she had helped advertise.\r\nWhen she got her camera back from the Sheriff’s office,\r\nshe posted\r\n\r\nher own video of getting arrested and assaulted by a Sheriff’s deputy<\/a>.\r\nThe video had gotten curiously truncated during its stay with the Sheriff’s office.\r\nBut another journalist, sitting one row back, recorded the sounds of\r\nNydia screaming for help while a Republican candidate laughed<\/a>.\r\n

\r\n<\/a>\r\nWhile<\/strike> Before waiting for justice about that pumpkin farm assault,\r\n\r\n\r\nNydia was thrown out of a local Republican Women of Forsyth County, GA event<\/a>.\r\nShe asked for an apology, and, getting none, filed for a criminal arrest warrant.\r\nThe culprit, Peggy Green, still refused to apologize until the court date\r\narrived, when\r\n\r\nshe apologized to Nydia to avoid jail time<\/a>.\r\n

    \r\n\r\n<\/a>\r\nElected officials, candidates, and party functionaries who don’t like being\r\nvideoed at public meetings better watch out.\r\nCummings<\/strike> got off easy for that $200,000.\r\nIn Idaho,\r\n\r\nAlma Hasse has sued for $1.5 million for wrongful arrest by a local appointed body<\/a>.\r\n

    \r\nIf you don’t want to be videoed at a public meeting you yourself advertised,\r\nwe the people may just do it anyway.\r\nAnd if you eject or arrest the videographer, you may find your self\r\nin a whole heap of trouble.\r\n

    \r\nRemember, Georgia has an Open Meetings Law<\/a>,\r\nwhich says in\r\nO.C.G.A. §50-14-1(c)<\/a>:\r\n

    \r\nVisual and sound recording during open meetings shall be permitted.\r\n<\/p>\r\n<\/blockquote>\r\n

    \r\n\r\n<\/a>\r\nIt doesn’t say whenever or\r\n\r\nwherever the Chairman feels like it<\/a>,\r\nor\r\n\r\nonly by people the Chairman deems to be reporters<\/a>,\r\nand not according to an alleged ordinance not on the agenda, not read to the public, and still not in a county’s online list of ordinances<\/a>.\r\nIt says “shall be permitted” with no qualifications.\r\n
