\r\nAmong the contractor yard maps\r\n\r\nSabal Trail filed with FERC 20 February 2015<\/a>,\r\nthere’s this one:\r\n\r\n\r\n

\r\nAccording to the Lowndes County Tax Assessors online database, that’s in\r\nparcel 0127B 001<\/a> owned by\r\nEXIT 13 DEVCON LLC,\r\nMailing Address\t435 N W 18TH PLACE, Jennings, FL 32053.\r\n

\r\nThere’s no such company listed by the Florida Secretary of State,\r\nbut there is by the Georgia Secretary of State,\r\n\r\nEXIT 13 DEVCON, LLC Control Number: 0544474<\/a>,\r\nwith principal office address 2200 N. Patterson St, Valdosta, GA 31602,\r\nand registered agent Frank Bird III.\r\n

\r\nAfter a series of tabled motions, one of Lowndes County’s longest\r\nrunning disputed vested rights cases finally reached a decision\r\nafter a brief executive session. The case represented an attempt by\r\nthe applicant, Devcon, to seek relief from the Unified Land\r\nDevelopment Code’s Valdosta Regional Airport Overlay District\r\nstandards through a vested rights application. Accordingly, the\r\napplicant found meeting several areas of the June 12, 2007 standards\r\nunreasonable, including the 30-foot maximum height within the zone,\r\nand inability for restaurants and retail stores to be located within\r\nthe zone.\r\n<\/p>\r\n

\r\nRepresenting Frank Bird, Bill Holland Jr. spoke on behalf of Devcon\r\nstating, “We are attempting to preserve what rights we have\r\nand the money we’ve spent.” After an executive session, the\r\nCommissioners returned, and VES-2007-02 Devcon was denied 2-1, with\r\nCommissioner Edgar Roberts the dissenting vote.\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nBuilding a tall building or a restaurant in a Runway Protection Zone\r\nisn’t such a good idea, according to Lowndes County Uniform Land\r\nDevelopment Code and Federal Aviation Administration (FAA)\r\nguidelines….\r\n<\/p>\r\n

\r\nYears ago when the Valdosta-Lowndes County Airport Authority\r\nextended the RPZ boundaries for Runway 13\/31, a short runway that\r\nruns southeast to northwest, from 1,000 feet to 1,700 feet onto land\r\nthat is owned by Exit 13 DEVCON LLC on Old Clyattville Road, DEVCON\r\nManaging member Frank Bird claims he was not informed of the\r\nauthority’s decision.\r\n<\/p>\r\n

\r\n“No one asked me anything about it,” Bird said Wednesday\r\nevening.\r\n<\/p>\r\n

\r\nThe airport authority extended the RPZ because it wanted to allow\r\nMoody Air Force Base C-130s to use the short runway for practice\r\nruns….\r\n<\/p>\r\n

\r\nDEVCON filed suit against the county in civil court on Sept. 27. The\r\ncase has not been resolved.\r\n<\/p>\r\n

\r\nThe restrictions in the county’s ULDC bring the code into compliance\r\nwith FAA rules concerning RPZs that are geared to keep the public in\r\nthe air safe from tall buildings or the public on the ground safe\r\nfrom potential plane crashes, Casey explained to the authority\r\nmembers Wednesday morning at the airport.\r\n<\/p>\r\n

\r\n\r\n\"300x388<\/a>\r\nBird, however, says he considers the county’s action as an unfair,\r\nillegal taking of his land and felt he had no alternative but to sue\r\nthe county to retain his development rights.\r\n<\/p>\r\n<\/blockquote>\r\n

\r\nThe irony that Exit 13 Devcon now seems to be involved in what many local\r\nlandowners and taxpayers consider to be Sabal Trail’s unfair\r\ntaking of local lands and tax-paid resources.\r\n

\r\nThe other contractor yard shown on Sabal Trail’s maps is just west across I-75,\r\nand according to the Tax Assessors databsae is\r\n\r\nParcel\t0127A 001<\/a> owned by\r\nWAGNER RICHARD LEE & JMR LLP,\r\nMailing Address\t5282 DANIELI DRIVE, LAKE PARK, GA 31636.\r\n

\r\n\r\n\"600x522<\/a>\r\n

\r\nBoth those parcels, according to\r\n\r\nValorGIS<\/a>, are partly in an aquifer recharge zone (the grey area at the\r\nbottom of the map).\r\nThe Exit 13 Devcon contractor yard appears to be at least partly in\r\nan aquifer recharge zone.\r\n

\r\nThat aquifer recharge zone also seems to correspond with the\r\nred “High (Drastic Rating)” aquifer recharge zone on this\r\nLowndes Water Resource Protection District Ordinance (WRPDO) Overlay Map:\r\n

\r\nMaybe the Airport Authority, the Lowndes County Commission, the Valdosta City Council, and Moody Air Force Base\r\nmight want to look into this land use.\r\n
