The case represented an attempt by\r\nthe applicant, Devcon, to seek relief from the Unified Land\r\nDevelopment Code&#8217;s Valdosta Regional Airport Overlay District\r\nstandards through a vested rights application. Accordingly, the\r\napplicant found meeting several areas of the June 12, 2007 standards\r\nunreasonable, including the 30-foot maximum height within the zone,\r\nand inability for restaurants and retail stores to be located within\r\nthe zone.\r\n<\/p>\r\n<p>\r\nRepresenting Frank Bird, Bill Holland Jr. spoke on behalf of Devcon\r\nstating, &ldquo;We are attempting to preserve what rights we have\r\nand the money we&#8217;ve spent.&rdquo; After an executive session, the\r\nCommissioners returned, and VES-2007-02 Devcon was denied 2-1, with\r\nCommissioner Edgar Roberts the dissenting vote.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nThen the landowner sued, resulting in a much longer VDT story,\r\nexcerpted here.\r\nBilly Bruce, VDT, 13 December 2007,\r\n<a href=\"http:\/\/www.valdostadailytimes.com\/news\/local_news\/airport-authority-gets-update-on-runway-protection-zone-lawsuit\/article_89cf3933-3e6e-5b57-8a06-b190fe9ae5e3.html\">\r\nAirport Authority gets update on Runway Protection Zone lawsuit<\/a>,\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nBuilding a tall building or a restaurant in a Runway Protection Zone\r\nisn&#8217;t such a good idea, according to Lowndes County Uniform Land\r\nDevelopment Code and Federal Aviation Administration (FAA)\r\nguidelines&#8230;.\r\n<\/p>\r\n<p>\r\nYears ago when the Valdosta-Lowndes County Airport Authority\r\nextended the RPZ boundaries for Runway 13\/31, a short runway that\r\nruns southeast to northwest, from 1,000 feet to 1,700 feet onto land\r\nthat is owned by Exit 13 DEVCON LLC on Old Clyattville Road, DEVCON\r\nManaging member Frank Bird claims he was not informed of the\r\nauthority&#8217;s decision.\r\n<\/p>\r\n<p>\r\n&ldquo;No one asked me anything about it,&rdquo; Bird said Wednesday\r\nevening.\r\n<\/p>\r\n<p>\r\nThe airport authority extended the RPZ because it wanted to allow\r\nMoody Air Force Base C-130s to use the short runway for practice\r\nruns&#8230;.\r\n<\/p>\r\n<p>\r\nDEVCON filed suit against the county in civil court on Sept. 27. The\r\ncase has not been resolved.\r\n<\/p>\r\n<p>\r\nThe restrictions in the county&#8217;s ULDC bring the code into compliance\r\nwith FAA rules concerning RPZs that are geared to keep the public in\r\nthe air safe from tall buildings or the public on the ground safe\r\nfrom potential plane crashes, Casey explained to the authority\r\nmembers Wednesday morning at the airport.\r\n<\/p>\r\n<p>\r\n<a title=\"1275x1650 Lowndes County, GA, next to Valdosta Airport, in Sabal Trail Contractor Yards, by John S.
