\nIn regards to your email of February 6, 2012, CCA has not given to the\n\n<\/a>\nAuthority a “Development Schedule” and has not received from CCA a “Notice\nto Proceed.” Under paragraph 1.6.2, except for some due diligence provided\nfor in the agreement, the Parties have no obligation to proceed with design,\npermitting, installation or construction of the Project, prior to receiving\na NTP from CCA. CCA has absolute discretion in issuing or withholding the\nNTP. After the issuance of the NTP the parties shall proceed with the\ndevelopment of the project in accordance with the Development Schedule.\n

\nDear Andrea, I didn\u2019t notice that either the Notice to Proceed from CCA\nto the VLCIA or the \u201cpreliminary specifications,\u201d both required by the\ncontract with CCA were in the documents given to me in response to my\nrecent open records request. The site survey was received on Nov. 19,\n2010, which means that, according to the contract, the Preliminary\nSpecifications for the project should have been received at the VLCIA\nover 6 months ago. It seems from the contract that either the\nPreliminary Specifications or a Notice to Proceed should have been\nreceived by now if the contract is still in force. Can you clarify this\nfor me please?
