{"id":10974,"date":"2014-10-19T20:14:24","date_gmt":"2014-10-20T00:14:24","guid":{"rendered":"http:\/\/www.l-a-k-e.org\/blog\/?p=10974"},"modified":"2014-10-19T20:26:57","modified_gmt":"2014-10-20T00:26:57","slug":"idaho-fractivist-ejected-from-jail-on-own-recognizance","status":"publish","type":"post","link":"http:\/\/www.l-a-k-e.org\/blog\/2014\/10\/idaho-fractivist-ejected-from-jail-on-own-recognizance.html","title":{"rendered":"Idaho fractivist ejected from jail on own recognizance"},"content":{"rendered":"<p>\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/10\/county-planning-commission-arrests-citizen-for-speaking-in-public-hearing.html\">\r\nArrested for standing silently in the back of a public meeting<\/a>,\r\nAlma Hasse refused to cooperate with booking or to eat,\r\ninstead helping prisoners with grievances.\r\n<a href=\"http:\/\/www.theepochtimes.com\/n3\/blog\/alma-hasse-meets-andy-and-barney-in-payette-county-idaho\/\">\r\n<img decoding=\"async\" style=\"float:right;border:none;width:300px\" src=\"http:\/\/brightcove.vo.llnwd.net\/d21\/unsecured\/media\/1927032138001\/201408\/250\/1927032138001_3710808551001_video-still-for-video-3711017886001.jpg?pubId=1927032138001\"><\/a>\r\nAfter a week, the Payette County, Idaho jail ejected\r\nher on her own recognizance with no bail.\r\nShe says they still plan to charge her with something.\r\nMeanwhile, she&#8217;s back to filing open records requests,\r\npresumably about the Planning and Zoning Commission that\r\nhad her arrested and that has a record of not divulging\r\ninformation even in response to FOIA requests.\r\nI smell a lawsuit, and not by P&amp;Z.\r\nMaybe they should have gone to\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/10\/lowndes-county-officials-at-open-government-symposium-ogs-2014-10-17.html\">\r\nthe VDT&#8217;s Open Government Symposium in Macon Friday<\/a>.\r\nMaybe some of our local elected and appointed officials\r\nhave learned that this isn&#8217;t the answer:\r\n<blockquote style=\"font-size:100%\">\r\nSo it&#8217;s just if you disagree you&#8217;re disruptive.\r\n<\/blockquote>\r\n<p>\r\nAlma Hasse&#8217;s husband Jim wrote on her facebook page 16 October 2014,\r\n<a href=\"https:\/\/www.facebook.com\/photo.php?fbid=968716726488392&#038;set=a.343100725716665.102373.100000502211949&#038;type=1\">\r\nAlma is FREE!!!! No Bail!\r\n<\/p>\r\n<p>\r\nWhile she was in jail she was working on helping female prisoners\r\nwith their grievances against the jail.\r\n<\/p>\r\n<p>\r\nThe first thing Alma did when she was released was to pull a public\r\nrecords request for a project she was working on before she was\r\nunjustly incarcerated. Honestly, it was each and every one of YOU who made it\r\npossible for me to stand strong. I feel fine&mdash; not quite up to\r\nrunning a marathon yet, but think I&#8217;ll be back to 100% in a day or\r\nso.\r\n<\/p>\r\n<p>\r\nNo, this is NOT the end of the legal battle. I was released OR (on\r\nmy own recognizance). Honestly, I had no choice as they escorted me\r\nto the door so to speak. I would rather still be there protesting\r\nthe complete disregard of the civil rights of ALL of our fellow\r\ncitizens. I think the pressure YOU all exerted and YOUR blasting my\r\nsituation around the GLOBE may have had a lot to do with their\r\ndecision&#8230;\r\n<\/p>\r\n<p>\r\nThe County of Payette is still moving forward with my &#8220;prosecution&#8221;.\r\nIn the end, I hope to have a ginormous lawsuit against Payette\r\nCounty. The level of corruption and collusion in this county knows\r\nno bounds!\r\n<\/p>\r\n<p>\r\nI&#8217;m looking forward to a GOOD nights sleep in MY bed, and in the\r\nmeantime, I&#8217;ve got some close friends, here for a small celebration!\r\n<\/p>\r\n<p>\r\nBack soon with some more information&#8230;.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nHere&#8217;s the\r\n<a href=\"http:\/\/media.spokesman.com\/documents\/2014\/10\/Hasse-incident-report.pdf\">\r\nPayette Police incident report<\/a>,\r\nwhich lists charges of Criminal Trespass, subclass Trespassing, Government Property,\r\nas well as Resisting and Obstructing Officers,\r\nsubclass Obstructing Police, Other.\r\nYou can see\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2014\/10\/county-planning-commission-arrests-citizen-for-speaking-in-public-hearing.html\">\r\nthe video of her being arrested<\/a>.\r\nDoes it look to you like she&#8217;s resisting arrest or obstructing officers?\r\n<p>\r\nWhile Alma Hasse was in jail, her daughter Shavone Hasse and others\r\nattended an oil and gas lease auction in Boise and were told they couldn&#8217;t \r\nhold signs in an area clearly marked Protest Area.\r\nBlair Koch wrote for Enviro News Idaho 17 October 2014,\r\n<a href=\"http:\/\/environews.tv\/fish-and-game-cop-tries-to-gag-fracking-activists-and-is-stuffed-by-boise-pd\/\">\r\nFish &#038; Game Cop Tries to Gag Fracking Activists and is Shut Down by Boise PD<\/a>,\r\nwith video, in which you can hear telling Shavone Hasse\r\nto leave because she was speaking <em>before<\/em> the public meeting started,\r\nand &#8220;this is our building&#8221;.\r\nAt a building of the Idaho Department of Lands (IDL),\r\nwhich, silly me, I would have thought was owned by the people of Idaho.\r\n<p>\r\nThe video includes this gem by Shavone Hasse:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nThese guys are being pretty loud now, and none of them are disruptive.\r\n<p>\r\nSo it&#8217;s just if you disagree you&#8217;re disruptive.\r\n<\/blockquote>\r\n<p>\r\nWhen the Boise Police finally showed up, they listened patiently\r\nto the situation.\r\nIncluding to Shavone Hasse, whose shirt read\r\n&#8220;Free Alma Hasse&#8221;, who proposed to video silently from the back of the room.\r\nWhen asked by police if that was OK, IDL stuttered and said yes.\r\nThe video enda as the auction startes, with another protester\r\nholding up a protest sign behind the bidders.\r\n<p>\r\nThe day after she was home, Alma Hasse posted a link to\r\nBetsy&#8217;s post in The Spokesman-Review&#8217;s Eye On Boise 17 October 2014,\r\n<a href=\"http:\/\/www.spokesman.com\/blogs\/boise\/2014\/oct\/17\/anti-fracking-activist-released-payette-jail-after-refusing-go-through-booking-process-week\/\">\r\nAnti-fracking activist released from Payette jail after refusing to go through booking process for a week<\/a>,\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nOnce taken to the jail, &ldquo;The officer gave her the opportunity\r\nto be cited and released if she would provide the information that\r\nwas needed,&rdquo; said Payette Sheriff&#8217;s Capt. Toby Hauntz.\r\n&ldquo;She refused to do that. The jail deputies that were trying to\r\nbook her let know that if she went through the booking process, they\r\nwould just issue her a citation and release her.&rdquo;\r\n<\/p>\r\n<p>\r\nInstead, Hasse remained in the jail for seven days, during which\r\ntime she went on a hunger strike and refused all meals. She appeared\r\nbefore a judge last Friday morning but refused to provide\r\ninformation on arraignment to the judge as well; that was repeated\r\non Tuesday. At that point, the judge issued a $10,000 bond\r\n&ldquo;because she wouldn&#8217;t answer his questions and complete the\r\nbooking process,&rdquo; Hauntz said.\r\n<\/p>\r\n<p>\r\n&ldquo;I finally went to her on Wednesday and just told her we&#8217;ve\r\ngot to get this done, the judge had told us we need to get the\r\nbooking process completed,&rdquo; the sheriff&#8217;s captain said.\r\n&ldquo;She finally started talking to me and within five minutes we\r\ngot everything taken care of.&rdquo; Going through the booking\r\nprocess, by state law, requires fingerprinting and a photograph,\r\nalong with providing identifying information; Payette County\r\nrequires a full name, date of birth, and medical questionnaire.\r\nState law, in Idaho Code Section 20-601, says, &ldquo;Any person who\r\nrefuses to submit to the entire booking process will be held in the\r\ncounty jail until the process is completed, or until ordered to be\r\nreleased by a magistrate or district judge.&rdquo;\r\n<\/p>\r\n<p>\r\nHauntz said Hasse went back before a judge on Thursday who released\r\nthe bond and agreed to release her on her own recognizance; she has\r\na court date in November and a jury trial set for December.\r\n&ldquo;We knew who she was, she had no prior criminal\r\nhistory,&rdquo; Hauntz said. &ldquo;Not even 30 minutes after she\r\nwent to court and the judge reduced the bond, we had her out of\r\ncustody.&rdquo;\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nThe Idaho ACLU points out the jail could have booked her as a Jane Doe,\r\nbut chose not to do that.\r\nIdaho ACLU is looking into the case.\r\n<p>\r\n -jsq\r\n<\/p>","protected":false},"excerpt":{"rendered":"Arrested for standing silently in the back of a public meeting, Alma Hasse refused to cooperate with booking or to eat, instead helping prisoners with grievances.
