{"id":10671,"date":"2014-09-23T12:43:05","date_gmt":"2014-09-23T16:43:05","guid":{"rendered":"http:\/\/www.l-a-k-e.org\/blog\/?p=10671"},"modified":"2014-09-23T12:46:21","modified_gmt":"2014-09-23T16:46:21","slug":"ga-supreme-court-rules-against-deep-south-sanitation-dss-vows-to-keep-going","status":"publish","type":"post","link":"http:\/\/www.l-a-k-e.org\/blog\/2014\/09\/ga-supreme-court-rules-against-deep-south-sanitation-dss-vows-to-keep-going.html","title":{"rendered":"GA Supreme Court rules against Deep South Sanitation: DSS vows to keep going"},"content":{"rendered":"<p><a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/06\/how-much-will-trash-collection-rates-go-up-in-lowndes-county-lcc-2012-10-09.html\">\r\n<img decoding=\"async\" style=\"float:right;border:none;width:300px\" src=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/waste\/solid-waste-table.jpg\"><\/a>\r\nLowndes County suing a local business with our tax dollars\r\nhas produced a preliminary Georgia Supreme\r\nCourt ruling overturning the appeals court and favoring\r\nthe county&#8217;s &#8220;exclusive franchise&#8221; with ADS, a company owned\r\nby New York City investors.\r\nLocal company Deep South Sanitation vows to keep going.\r\n<p>\r\nDo you think this lawsuit is a good use of your tax dollars?\r\nWhat will you think if ADS&#8217; rates go up from Veolia&#8217;s bid of $13.05\/month\r\n($156.60\/year) just before ADS bought Veolia,\r\nto ADS&#8217;s bid of $13.39\/month ($220.68\/year)?<!--more-->\r\n<p style=\"text-align:center;font-size:80%\">\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2013\/06\/how-much-will-trash-collection-rates-go-up-in-lowndes-county-lcc-2012-10-09.html\">\r\n<img decoding=\"async\" style=\"border:none\" src=\"http:\/\/www.l-a-k-e.org\/govt\/loco\/waste\/solid-waste-table.jpg\"><\/a>\r\n<\/p>\r\n<p>\r\nEven Veolia&#8217;s bid is 50% more than we were paying Lowndes County\r\ndirectly for those waste disposal sites.\r\nIf the county had simply raised its rates by that 50%, there would\r\nhave been no shortfall.\r\nInstead, the county chose to funnel profits to investors in New York City\r\nand to spend tax money trying to put a local company out of business.\r\nDoes that seem right to you?\r\n<p>\r\nColter Anstaett wrote for WALB 22 September 2014,\r\n<a href=\"http:\/\/www.walb.com\/story\/26597829\/ga-supreme-court-delivers-ruling-in-lowndes-sanitation-suit\">\r\nGA Supreme Court delivers ruling in Lowndes sanitation suit<\/a>,\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nThe county sued Deep South Sanitation in 2013, saying the small\r\nprivate company did not have a right to collect trash in the\r\ncounty&#8217;s unincorporated areas because the county had already entered\r\ninto an agreement with Advanced Disposal.\r\n<\/p>\r\n<p>\r\nBut Deep South&#8217;s attorney, Rob Plumb, said Monday afternoon that he\r\nbelieves the court did not consider the fact that the county&#8217;s\r\nstopping Deep South from operating would violate the business\r\nowner&#8217;s rights of protected property.\r\n<\/p>\r\n<p>\r\n&#8220;The court declined to rule on that, saying that the trial court\r\ndidn&#8217;t address it. But, I don&#8217;t think that&#8217;s correct. We&#8217;ll be\r\nfiling a motion for reconsideration on that issue,&#8221; Plumb explained.\r\n<\/p>\r\n<p>\r\nPlumb has 10 days to file that motion. Deep South will continue to\r\noperate for now though, as a formal injunction against Deep South\r\nhad not been issued as of Monday night.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nJoe Adgie wrote for the VDT 23 September 2014,\r\n<a href=\"http:\/\/www.valdostadailytimes.com\/news\/local_news\/article_7885b0d0-42da-11e4-ac11-97b3c227c976.html\">\r\nDeep South plans to keep going<\/a>,\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nCary Scarborough, who runs Deep South, called the ruling a\r\ndisappointment.\r\n<\/p>\r\n<p>\r\n&ldquo;It&#8217;s very disappointing, especially here in Lowndes\r\nCounty,&rdquo; Scarborough said. &ldquo;I was in business a year\r\nbefore they ever decided to do this type of deal, and it&#8217;s just very\r\ndisappointing here in my home county where I was born and raised and\r\nwhere I raised my children that local politicians would do this to a\r\nsmall local business.&rdquo;\r\n<\/p>\r\n<p>\r\nScarborough said that his company is looking at legal options to\r\npossibly appeal the court&#8217;s ruling.\r\n<\/p>\r\n<p>\r\n&ldquo;We&#8217;re looking at our options right now, see what options we\r\ndo have,&rdquo; Scarborough said. &ldquo;As far as Deep South\r\nSanitation, we&#8217;re business as usual right now.&rdquo;\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nHe said it was equally disappointing to DSS&#8217; customers.\r\n<p>\r\nDeep South Sanitation facebook page statement 22 September 2014,\r\n<a href=\"https:\/\/www.facebook.com\/DeepSouthSanitation\/posts\/794981010567586\">\r\n&#8220;APPEALS COURT RULING&#8221;<\/a>:\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\nDear Friends of Deep South,\r\n<\/p>\r\n<p>\r\nThe Supreme Court of Ga has &#8220;reversed&#8221; the ruling made in November\r\n2013 by Judge Altman and ruled that Lowndes County has the &#8220;right&#8221;\r\nto stop Deep South Sanitation from providing curbside trash service\r\nbecause it violates a &#8220;new&#8221; local ordinance. An ordinance that gives\r\n&#8220;exclusive&#8221; rights to Advanced Disposal.\r\n<\/p>\r\n<p>\r\nHowever friends, we (Deep South) has responded &#8220;today&#8221; to the\r\nSupreme Court ruling with a motion to reconsider. It would be safe\r\nto say that the ruling already made is not the &#8220;final&#8221; ruling until\r\nwe hear back from the Supreme Court regarding the request for\r\nreconsideration. Deep South &#8220;WILL&#8221; continue to operate.\r\n<\/p>\r\n<p>\r\nIf you are a Deep South Customer and you are reading this, please\r\nknow that &#8220;you&#8221; are our main &#8220;priority&#8221; and we will continue\r\nbusiness as usual!\r\n<\/p>\r\n<p>\r\nThis lawsuit has been &#8220;wrong&#8221; from the very beginning and has been\r\nvery &#8220;costly&#8221; to Deep South as well as the taxpayer&#8217;s.
