Peevey, 2 April 2013\" src=\"http:\/\/www.l-a-k-e.org\/blog\/wp-content\/uploads\/2014\/09\/a18a9957646221deb15fa23ea1f3f269.jpg\"><\/a>\r\nA utility didn&#8217;t stop at blowing up a Calfornia neighborhood,\r\nit also demanded the Public Utilities Commission (CPUC) get a favorable judge\r\nfor that 2010 San Bruno natural gas pipe explosion.\r\nThe CPUC president&#8217;s chief of staff just last year wrote slides\r\npraising his Legacy as Best Practices.\r\nDoes that legacy include suborning justice?\r\nHe&#8217;s still there, although she was fired, and three PG&amp;E executives\r\n&#8220;ended their employment&#8221;.\r\nHow many other PG&amp;E and other utility executives and CPUC and other\r\nstate regulators follow those same Best Practices?\r\n<p>\r\nEllen Knickmeyer, Associated Press, 15 September 2014,\r\n<a href=\"http:\/\/abcnews.go.com\/US\/wireStory\/pge-officials-removed-improper-communications-25522565\">PG&amp;E Officials Removed for Improper Communications<\/a>,\r\n<blockquote style=\"font-size:100%\">\r\n<p>\r\n<a href=\"http:\/\/www.techeblog.com\/index.php\/tech-gadget\/gas-explosion-san-bruno-pictures-video\">\r\n<img decoding=\"async\" style=\"float:right;border:none;width:300px\" src=\"http:\/\/media.techeblog.com\/images\/gas_explosion_san_bruno.jpg\"><\/a>\r\nFour senior officials with Pacific Gas &#038; Electric Co. and the state\r\ncommission regulating it were removed or resigned over emails\r\nreleased Monday showing the utility and state regulators appeared to\r\nnegotiate which judge would be assigned to hear one of the utility&#8217;s\r\nrate cases.\r\n<\/p>\r\n<p>\r\nThe emails show the commission ultimately assigned to the case a\r\njudge for whom PG&amp;E had expressed a preference, rather than another\r\njudge who PG&amp;E said &#8220;has a history of being very hard on us.&#8221;\r\n<\/p>\r\n<p>\r\n<a href=\"http:\/\/www.cpuc.ca.gov\/PUC\/aboutus\/Commissioners\/01Peevey\/\">\r\n<img decoding=\"async\" style=\"float:right;border:none\" src=\"http:\/\/www.cpuc.ca.gov\/NR\/rdonlyres\/E3C21756-FAD7-424E-A0E8-5A63677F0900\/0\/MichaelPeevey_lg.jpg\"><\/a>\r\nAlso Monday, California Public Utilities Commission president\r\nMichael Peevey, who was included<!--more--> in part of the January email\r\nexchange, removed himself from involvement in that rate case and in\r\nanother, bigger case pending before the utility commission involving\r\nPG&amp;E, California&#8217;s largest utility.\r\n<\/p>\r\n<p>\r\nThe developments deepen the growing controversy surrounding the\r\nstate utilities commission&#8217;s oversight of the utility in the\r\naftermath of a 2010 explosion of a PG&amp;E natural-gas pipeline that\r\nkilled eight people in the San Francisco suburb of San Bruno.\r\n<\/p>\r\n<p>\r\nIn July, earlier emails released at the request of San Bruno city\r\nofficials showed Peevey and his staffers consulting with the utility\r\non matters including how big PG&amp;E&#8217;s fine should be in the blast. The\r\ncommission&#8217;s decision on that fine is pending.\r\n<\/p>\r\n<p>\r\nOn Monday, PG&amp;E released a January email exchange featuring Brian\r\nCherry, PG&amp;E&#8217;s vice president for regulatory relations, asking\r\nrepeatedly for Peevey&#8217;s chief of staff, Carol A. Brown, to change\r\nthe administrative law judge who was assigned to hear an unrelated\r\nrate case involving PG&amp;E.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nAmusingly, <a href=\"http:\/\/www.pgecorp.com\/aboutus\/our_team\/BKCherry.shtml\">\r\nBrian Cherry&#8217;s page<\/a> in <a href=\"http:\/\/www.pgecorp.com\/aboutus\/our_team\/\">\r\nPG&amp;E&#8217;s &#8220;Our Team&#8221;<\/a> now gets &#8220;404 not found&#8221;.\r\nHis <a href=\"https:\/\/www.linkedin.com\/profile\/view?id=10833962&#038;authType=NAME_SEARCH&#038;authToken=d4ss&#038;locale=en_US&#038;srchid=1141201410958494913&#038;srchindex=5&#038;srchtotal=90&#038;trk=vsrp_people_res_name&#038;trkInfo=VSRPsearchId%3A1141201410958494913%2CVSRPtargetId%3A10833962%2CVSRPcmpt%3Aprimary\">LinkedIn profile<\/a> still lists\r\nhim as &#8220;Vice President &#8211; Rates and Regulation at Pacific Gas and Electric Company\r\nSan Francisco Bay Area&#8221;.\r\nThe AP story says he and &#8220;two other senior officials ended their employment with the utility as a result of the emails released Monday.&#8221;\r\n<p>\r\nThe story says CPUC fired Carol A. Brown gone, who will update those Best Practices slides\r\nto explicitly include suborning justice and getting your chief of staff\r\nand three PG&amp;E executives fired?\r\n<p>\r\nThe AP story includes:\r\n<blockquote style=\"font-size:100%\">\r\n<a href=\"http:\/\/www.turn.org\/press-room\/press-releases\/item\/773-pge-should-be-sanctioned-and-president-peevey-should-be-removed.html\">\r\n<img decoding=\"async\" style=\"float:right;border:none\" src=\"http:\/\/www.turn.org\/images\/banner\/turn-logo.png\"><\/a>\r\nThe Utilities Reform Network, a consumer group pushing for action against PG&amp;E in the wake of the 2010 blast in San Bruno,\r\ncalled on Peevey to resign,\r\nsaying the emails showed &#8220;PG&amp;E was calling the shots in Peevey&#8217;s office.&#8221;\r\n<\/blockquote>\r\n<p>\r\nPreviously\r\n<a href=\"http:\/\/www.turn.org\/press-room\/press-releases\/item\/773-pge-should-be-sanctioned-and-president-peevey-should-be-removed.html\">\r\nTURN called on Peevy to recuse himself<\/a>, which he has done.\r\nThat was apparently before the emails were revealed.\r\nTURN also suggested <a href=\"http:\/\/www.turn.org\/issues\/energy\/item\/784-san-bruno-penalties-should-go-to-safety-and-rate-reductions.html\">\r\nthe judge&#8217;s proposed $1.4 billion penalties was a good start<\/a>,\r\nbut more of it should come from shareholders than from ratepayers,\r\nand more of it should go to pipeline safety.\r\nAnd if that was the utility-friendly judge, maybe all of that would already have happened\r\nwith a less friendly judge.\r\n<p>\r\nI wonder if that kind of collusion between a regulated utility\r\nand its regulator could be a problem in Georgia, where\r\n<a href=\"http:\/\/www.l-a-k-e.org\/blog\/2012\/07\/4-of-5-incumbent-ga-psc-commissioners-accept-massive-utility-campaign-contributions.html\">\r\n4 of 5 incumbent GA PSC Commissioners accept massive utility campaign contributions<\/a>?\r\n<p>\r\n<a href=\"http:\/\/www.mercurynews.com\/business\/ci_26538265\/puc-undertakes-shakeup-and-review-over-email-flap\">\r\n<img decoding=\"async\" style=\"float:right;border:none\" src=\"http:\/\/extras.mnginteractive.com\/live\/media\/site568\/2014\/0804\/20140804__pge~1_300.JPG\"><\/a>\r\nHey, I&#8217;ve got an idea: let&#8217;s just not build any more of those\r\nexplosive fracked methane pipelines that bring Georgia nothing\r\nbut hazards!\r\n<p>\r\n -jsq\r\n<\/p>","protected":false},"excerpt":{"rendered":"A utility didn&#8217;t stop at blowing up a Calfornia neighborhood, it also demanded the Public Utilities Commission (CPUC) get a favorable judge for that 2010 San Bruno natural gas pipe explosion.
